The trade-in loan payment was due the day of the sale transaction. This payment was to come out of the complainants account and was not included in the loan transaction for this reason. That trade-in payment was returned by the financial institution for insufficient funds. We have had 5 conversations with the complainant regarding payments and the sale transaction. The transaction was completed with full disclosure regarding financial terms, trade valuation, payments and agreed upon by the complainant at time of purchase. if the complainant requires further clarification of the transaction we would accommodate an additional clarification at our office.

We stand by our previous response to this matter. Should the complainant prefer to review all documentation and explanation of same complainant would be welcome to arrange appointment to discuss with appropriate manager.

On Thursday December 21, 2023, at about 2:15pm, I drove my car 2012 ********* ***** LT VIN: 1G1PF5SC8C7155952 to Rallye Motors on 1810 Main Street Moncton for routine maintenance, an oil change to be precise. Unfortunately, my experience at their facility was far from satisfactory. Not only was my car subjected to damages during the service, but I also encountered an incident of dehumanization that has deeply disturbed me. Rallye's technician drove my car to their workshop to change oil & filter, & they damaged the car’s engine in the process. The service manager ****** ***** informed me that my car is not working, & they do not know the reason. I asked for clarification to know what he meant by “your car is not working”. I asked him the following questions further. “Did I not drive my car here in working condition? Did your technician not drive the car to the workshop to change its oil & filter?” At that point, ****** ****** (Director of Service) angrily walked up to me handing over my car key saying “take it and leave now. You’re no more a customer. Take your car away from here”. I asked him how he expects me to move the car and he said he does not care how I do that; that I should tow the car away. He said, “you are no more welcomed here”. I told him I do not mind being delisted from their customers database, but they should fix my car. I was bullied off their premises. I towed the vehicle from Rallye Motors that night; and have 2 other mechanic workshops diagnose the car & both confirmed the car's engine was damaged from the oil change. I sent a letter of complaint to ***** ***** the Director of Fixed Operations at Rallye Motors about the issue, and he contacted the workshop where my car is currently parked to confirm the cost to fix the car & he was told $6,159. Rallye is asking me to pay $4,000 to buy a used engine and they will pay $2,159 for labour. My demand is for Rallye to either repair my car at no cost to me or replace it without further delay.

      We dispute the complainants statement.
      The facts are as follows ;
Abnormal engine noise was noted by both the service advisor and the technician on check in for service.
The technician noted the oil filter was full of metal fillings and has kept the old oil filter.
The oil change was completed however on start up and removal from the shop the engine failed.
Determination of the engine failure would require diagnosis which the client refused.
Complainant became confrontational and aggressive. He was asked to leave..
Complainant later contacted our Director of fixed operation and stated it was our fault and he was advised the failure was due to the oil change completed by our shop which he claimed was confirmed by another facility.
Our Director contacted this facility and both the manager and the technician of this facility stated they did not tell the complainant this and confirmed the engine damage was not the result of the oil change. They also confirmed the vehicle was a high mileage unit and had suffered damage as the result of long term mechanical issues.
Complainant had purchased another vehicle from us prior to this incident and because of this our Director offered some assistance on the repair on a goodwill basis.
      The complainant refused this offer.
We pride our organization for our efforts to be inclusive to all races and in fact our staff represent a very diverse  multiculturalism with availability to our clients to receive service in 26 languages. The complainants claim of dehumanization is without merit. Any interaction with the complainant to de-escalate the situation was met by the complainant being confrontational and aggressive to our staff.
There will be no further good will offered to the complainant.

      Business response

      14/02/2024

We stand by our initial response. Complainants mechanical issue was not the result of the oil change as verified by a third party.

The Complainants actions towards staff necessitated our request he leave the building.

I am rejecting this response because: Rallye Motors damaged my car. I drove it in to their workshop for oil change and should be able to drive it out of the place in the same manner. They damaged it there & bullied me to tow it off the property. They should repair my car or replace it.

I bought a 2017 Chev Equinox from Rallye Motors Chrysler in January 2023. It had afresh safety inspection done in November 2022. Then the car sat until I bought it. All went well until I took it in for its first service September first. The mechanic noticed a large hole in the rocker panel while doing an inspection of the vehicle. I have called Rallye Motors on several occasions and they tell me it’s a Diamond Kote issue. But there should not have been a hole in the rocker panel after eight months and 6500km. Therefore in my opinion Rallye Motors Nissan who did the safety, falsified the condition of the vehicle and put an illegal safety inspection sticker on the car, and I can’t get Rallye Motors to call me back and Diamond Kote, also has so far refused to get back to me on who is going to cover the cost of the damage

      Business response

      22/09/2023

The vehicle was inspected by our certified technician In November 2022 and all necessary steps were taken to comply with NB safety standards. No holes were observed or noted.

The complainant is welcome to bring the vehicle back to the dealership for a visual inspection. If it is determined repairs are not covered under warranty then we would provide a repair quotation to the complainant at a reduced cost.

July 15 2023 I had bought a 2023 dodge Hornet gt from your dealership. I was under the impression the vehicle had a 4,914$ discount. Bringing the car to 39,966. When financed, they added the 2,095 back in for freight. Spoke with the sales manager **** and said that freight has to be charged. So why would you discount the price of the car by 4,914 and then add 2,095 back in? That tricks a customer into buying something for a lower price though having fees added back in again? The total finance was 57,563 before taxes. Minus the 15k for the negative equity. That is 42,563. So where did the 2,563 come from? The car before discount was 44,880 with freight included, then 4,914 discount bringing to 39,966 and add the AC $100 charge brings the car to 40,066 not 42,563. Not to mention, **** said he has pictures from before the car left the lot that day of the gas being full. When I received the vehicle, it was a 1/4 empty. And to add as well, the floors were full of grass and dirt which definitely was not a good impression. I'm hoping we can come to an agreement or resolution. Being told different ways of where the Money came from is not a way to resolve the issue. I did ask about returning the car and they said no. I thought it was fair to return since we could not come to the agreement that the discount that was supposed to be there did not reflect the actual pricing as we did pay more rather than less.

Complainant has had a clear explanation  from both a sales manager and the director of Finance.

Transaction details include the negative equity on the trade. Should complainant desire another face to face review  of the file please contact the Director of Finance.

The transaction details are correct and no adjustment is forthcoming.

Transaction Date, April 11, 2022 for the amount of 11000 for purchase of a used 2013 ***** Civic EX coupe. Vehicle when purchased had a March 2022 NB safety inspection sticker on it, It was also verbally communicated the vehicle was mechanically detailed checked out and sound. I was also persuaded to sign a disclosure agreement for "value vehicle" basically releasing Rallye Motors Chrysler of any responsibility for defect after purchasing. I was not presented this until after financing was approved with this practice I got a vibe of distrust. After arriving in Fredericton with my new to me ***** I took vehicle to local dealer as I had a problem with a drive belt worn and they looked over rest of vehicle I was told also the back rotors were not the best and this was after the recent "inspection" was done. Granted they did cover 1/2 the cost of the drive belt at the time. Today July 8th I took car for scheduled maintenance to Sutherland ***** in Fredericton for oil change I was told the rotors were now in bad condition and back rotors and pads were worn only after driving this car a couple of months putting only 4000km on it since purchased on April 11th. 3rd party warranty will not cover this as it is a "consumable" part and it cost me well over $500 to have rotors and pads replaced. My concern is the vehicle should of not had a legit 2022 NB safety inspection on it with rotors and pads in the shape they were in and not to mention I was told by Rally Motors Chrysler of Moncton this vehicle was mechanically solid. Thank You

The vehicle passed a New Brunswick vehicle inspection at time of sale which was the only requirement for a value priced vehicle presented for sale.

Complainant was made abundantly clear of the terms prior to delivery. The signed warranty disclaimer clearly identifies the vehicle has a valid NBI, there is no warranty and check engine, air bag or other dash lights are not covered after delivery. Pricing of value priced vehicles are consistent with this level of reconditioning. Purchasers have the option to upgrade any other requested repairs at additional cost prior to delivery. The signed value price disclaimer identifies no other requested repairs by the complainant.

Should the complainant present this vehicle to our repair shop we will endeavor to provide trade pricing for parts required as a good will gesture. No other compensation will offered.

There was full disclosure on this transaction identifying the condition and warranty coverage within the terms of the agreement. No further consideration will  considered.

      Customer response

      19/07/2022

I am rejecting this response because: Disclosure on this transaction identifying the condition and warranty coverage within the terms of the agreement
does not specify faulty inspection. As they mentioned before hand the warranty coverage provided by Rallye Motors excluded check engine, oil lights or any other said dashboard light indications however no mention of a faulty motor vehicle inspection is mentioned in said coverage.  When one buys a vehicle in good faith and a brand new motor vehicle inspection is performed on said vehicle this is in itself a contract of safe condition of a vehicle for a specified amount of time usually up to one year after purchase and longer then a few weeks. Rallye Motors does not seem to understand the guarantee of public safety and that brake rotors inspected by them or another third party they used should not need to be replaced with a time frame of under 3 months or 4000km after driving off their sales lot.

They seem to come back with this ""value vehicle coverage"" cop out, value or not a proper MVI is a proper MVI and from what I can see from them is that they are not taking responsible ownership of the situation and coming up with reasonable compensation. This is now will be a  mater for the Department of Justice and Public Safety I will be contacting them this week to get their perspective on this situation.
