      I gave Sunview representative a $10,000 deposit and signed an agreement on July15, 2021 to build us a solarium at our cottage at ****** Lake. Reps name is ************. It never took place and there were no signs of construction. Builder always came up with excuses why no construction was taking place and so on September 17, 2022 I requested a refund. The general manager ********* only agreed to pay me a small fraction back and so I only received $2,000 back. I lost $8,000. ****************.

      We acknowledge that Mr. ******* did enter into an agreement with Sunview Renovation Services in July of 2021 to construct a solarium at his property located at ****** Lake.
      A letter written to Mr. ******* dated 09/22/22 references the contract that was signed in July of 2021 and the rights of both parties. It also states that a construction crew was booked and scheduled to begin the installation in October. The letter also indicates that custom windows for his project had been manufactured along with 2 - 8' wide custom doors had been ordered and were in transit. The letter also provided Mr. ******* the opportunity to rescind the cancellation notice and we would fully recognize the original deposit. Alternatively, if he chose to continue with the cancellation, a portion of his deposit would be retained as liquidated damages. Sunview Renovation Services is in receipt of a letter from Mr. ******* dated September 27, 2022, confirming the cancellation as well as acknowledging the financial terms outlined in the September 22 letter from Sunview Renovation Services.

      Sunview solarium renovations say in their retort that they were scheduled to do the job in October. How was I to believe them when they kept saying same thing for over a year and never came? **** ****** **** ** **** ******* why they did not do anything so this October date I figured was another extension they were not going to honor. How long does a customer put up with this before asking for a refund? This is why there are strict rules laid out in the Direct Sellers Act that dictate the rights of the seller and the buyer. It is within these rights that Sunview Renovation Services acted upon when we received Mr. *******'s notice of cancellation. Because of the costs associated with cancelling, Sunview Renovation Services provided Mr. ******* another opportunity to proceed or accept a financial offer. Mr. ******* decided to accept the financial offer. The financial offer may have been higher, however non-cancellable custom items were in transit for the project. If Mr. ******* wants the custom ordered doors, we will hold them at our Saskatoon Location for pick up. This offer is valid for 45 days (ending Jan 31, 2023) otherwise they will be disposed of.
