      We notified Partners Real Estate (Partners) in April 2023 that we were vacating the home we were renting with them in May 2023. We set up a date of May 30, 2023, to have our move-out inspection and turn in our keys. Everything with the inspection went well and we admitted that we had not shampooed the carpets in the bedrooms. The carpet in the stairway was already slated to be replaced. As far as we knew, the bedroom carpet was the only item identified to us during our move-out inspection.On June 20, 2023, after not hearing anything from Partners, I sent an email to inquire about the security deposit. I was informed that the yard needed mowed and there was dog f**** left behind. We felt the yard was in decent shape given the amount of rain we had received prior to moving out and not being able to mow prior to the movers packing up the house and thought we had cleaned up all of our dog's f**** However, we did feel this was acceptable given the circumstances. I was informed that Partners was also having a problem getting the work done because of the weather. We never received an invoice from Partners, but the **** did have an image in the ************************* showing a mailpiece from Partners postmarked June 14, 2023. I can only assume this was the invoice as, for some reason, we never received it.During the exchange on June 20, 2023, I let Partners know that we would be departing ****** soon and asked if I should provide my ******* address. They asked me to provide that address since they were waiting on work to be completed and I complied. On July 16, 2023, I called Partners to once again inquire about my security deposit. I was told that they sent it to the ****** address and they would resend the check to our ******* address once they received it back in returned mail. I let them know that our mail was set up for forward from ****** to ******* so we would wait for it. It is now July 21, 2023, and we still do not have our security deposit.

      Hello,

      Thank you for expressing your concern for the return of your security deposit.  We do try to make sure that our properties are ready for the next tenant as promptly as possible and that is why we have the yard mowing and pet f**** clean ** in our leases.  We do understand that there was a lot of rain before your moveout but we have to hold all of our tenants to the same standard. Your security deposit minus the amount for the yard mowing and clean ** was sent to the address in ****** and we were informed that mail sent there would be forwarded.  If/when we receive the check back we will immediately send it to the ******* address.

      I am rejecting this response because: Persuant to email traffic on June 20, 2023, our ******* address was provided to Partners so that our deposit could be mailed. Why the deposit was still sent to ****** is unknown. However, mail which was sent from *******, **, to the ****** address on July 10, 2023, has already arrived at our ******* address and there is still no sign of our security deposit. This leads me to believe that Partners is in violation of the ****** Uniform Residential Landlord & Tenant Act, Sec. 34.03.070(g), which requires them to return our security deposit to us, less deductions, within 30 days of terminating our residency of their property. The Act does not stipulate that acts of nature constitute a whitholding of our funds. Partners had an obligation per the Act to provide our funds within that 30-day period and failed to do so, regardless of where our check was sent. Furthermore, the check would not be returned by the ************* *********** as we have an official change of address forwarding in place and, as of today, our check still has not arrived at our new forwarding address. This leads me to question if/when Partners actually sent our security deposit check.
