Contractor stated that this was due to lumber change, from 2" x 4" to 2" x 6" difference. Estimated upsell of $700.00 + tax. Business response

      07/12/2024

when the customer called me on the following day to let me know that he was not happy with the finished product, first thing i asked that he would tell me what the problem was and he expressed his frustration, than I offered to remove the concrete to have it redone and he would not let me, he did asked for us to meet to discuss the issued but I had gotten very sick that weekend and I was not able to attend to our meeting. I tried to get InTouch with him, but I did not get any response, I am still willing to re do the concrete pads, but I guess he just wants to use what we already did and continue with his project and not have to pay for our concrete work. I am willing to refund the rest of the money that he gave me, minus the cost of cement and gravel used, I will also refund part of our labor, if he is going to use the same pad.

please advise what is the next step. thank you.

The first installment towards completion of two contracts was paid July 10, 2023 with the final installment of the total $111,000 on the two contracts paid on December 15, 2023 to Jose Gonzalez/ J.G Home Remodeling and Renovations LLC . The work was to be completed by approximately September 8, 2023. As of today, July 2, 2024, the majority of the contracted work on room 6 also referred to as the 2 story building still remains incomplete. The contractor said he couldn’t complete the work because he needed additional funds and so a second contract for this space was signed in August of 2023 in the amount of $6000 for which the balance was paid on December 15, 2023. I contacted Mr. Gonzales at least 30 times and while he has responded to requests, he still has not completed the work. He agrees the work is not complete, he is now claiming that some of the remaining work I have discussed with him was not in the contract and that he also did “additional work” outside the contract. This is statement is false. The work he is referencing as “additional work” is clearly stated in the contract and he has already been paid for in full for that work. In essence, he now wants me to pay him twice for the same work. There are walls missing, and plumbing, flooring, vanities, toilets, and showers not fully installed or functional. At this point, I can see that trying to negotiate with him isn’t working and I must take other action. Therefore, I am requesting BBB’s assistance to avoid legal action which to me is a last resort. Also, it is important that this complaint be posted so that other customers are warned not to trust this company.

We have been working on the building but is been slow process because all plumbing is new to this building,  we are having to make and install new sewer lines, install a water heater and new water lines to a building that have nothing. This customer wants this building dine not understanding what it requires for all lines to work properly. We have just finished the bathroom in the upstairs room, shower is tiled and should be done by next Monday, dew to the 4th of July we have our workers going on vacation.

I reject this response. Neither bathroom is even close to being finished or is a usable space. The upstairs bathroom isn't even close to being finished as of last Sunday.

Your response lacks details that I've requested numerous times about what tasks you will have complete and the days on which I can expect to see them completed.
