      My wife is a server at Flappers Comedy Club in *******, ***On Friday April 5th, while my wife was on a smoking break in a designated area, another employee by the name of ****************** came up to her and hugged her without her consent. He grabbed her face, smeared her lipstick with his hand and said to her "you're so beautiful, you don't need the make-up." My wife told him she was uncomfortable, that it was not appropriate, and that she was mad. He then continued to stand right in front of her and would not back down. Another employee made their way out to the smokers area, and my wife used it as an opportunity to leave the uncomfortable situation. This is not the first time that ***** has taken liberties with how he treats my wife. While she was serving tables, he's repeatedly called her "gorgeous," "mama," "beautiful," and "sweetie" among others. My wife feels like since she started working there, he has made inappropriate advances at her. Initially she did not report the behavior because ***** explained to her he was a recovering alcohol and drug abuser, perhaps in an effort for her to feel sorry for him. So it worked. My wife later found out that later in the day of April 5, ***** had touched another female's face earlier in the day and made comments about another female worker's body. After the incidents on Friday April 5th, ***** was sent home for the night. He was back to work the next day with no punishment. My wife filed a complaint with the Owner/ Self proclaimed HR on April 10th and she said that she couldn't fire him because it was his first offense reported. My wife feels there should be a zero tolerance policy on harassment and I agree. This type of behavior should never be allowed and wife has now started looking for new jobs, as she doesn't feel supported by her place of work. And to top it off, ***** works "under the table" because there is an issue with his social security number. Pretty sure that's a violation of employment eligibility.

      Hello BBB, 

      First of all we have responded to the employee ********************* in house regarding her complaint.  **** is a Part Time server who works two days a week. We do our best not to schedule the two of them on the same shifts.    I have no idea who ***** is?..And ***** wasn't present at the workplace when **** had the issue.  But **** is my employee and we have discussed and addressed this issue with her immediately after she reported it to us (Me *******************************) and my General Manager.  All of my employees take Sexual Harrassment training as per the state of California.   Yes I have 38 Employees I am the HR Department in a small company such as this. No physical  harm or threats were  made toward **** according to her complaint, and when we discussed it with her she agreed that she was ok with going back to work.  We also explained that it is up to each employee to report their own incidences and we have not had any other incidences reported against the employee mentioned therefore we must also give that employee the benefit of the doubt and address the concerns on his behalf as well.  We immediately addressed the issue with ***** and explained that he shouldn't be giving employees compliments or touching them in any way even on the shoulder or face    In a verbal meeting last week with ********************* and My General manager ********************************* *********** to go back to work and that she didn't think it was a serious issue.
