Andew Schmidt, the general manager of Discount Cardiology / C&R Medical, Inc., sold me a used EKG machine in place of a new unit. Neither our telephone discussion at time of purchase nor the sales reciept described it as a used uitn. Their website displayed a stock picture of the EKG and its functionality but does not state it to be used. Eventhough I returned it back to them within 5 days, they have refused to credit my account and claim they never got it back. I have a tracking number through a FedEx ticket as per attached. This merchant is guilty of false advertisement and is attempting to steal my money.Initial Complaint

An ECG machine was purchased from Discount Cardiology but after we received it we were disappointed with the quality and returned it (company has a full refund policy). Before the machine was received back by them, my husband called the credit card company to stop the $2995 payment. Discount Cardiology said once we resolve the dispute with the credit card company they’ll issue us a refund. The dispute was resolved in they favor (since it was filed before they received their machine back), but when I called them for a refund- since they received the credit card payment- they refused, stating that we wasted their time and they would only give us back 50% of the amount in the form of store credit. I spoke with the general manager over the phone to protest, he said it cost them to resolve the dispute ( which didn’t make sense since a CC card dispute is just a letter in the mail with inquiries about the transaction). I said I’ll pay the “dispute cost” if they send me the receipt of the charges incurred, and issue me a refund, they agreed over the phone. But since their story is made up, and they have no grounds to denying full refund nor to present proof of charges incurred, they’re still refusing to send my money back and are stalling. I’ve been going back and forth for several months with Discount Cardiology over this issue with no solution in sight.
