Government Action: BBB reports on known government actions involving business’ marketplace conduct:

Consumer Financial Protection Bureau v. Bank of America

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

On May 4, 2022, Bank of America entered into a Consent Order with the Consumer Financial Protection Bureau. The Consent Order settles allegations that Bank of America unlawfully froze customer accounts, charged garnishment fees, garnished funds, sent payments to creditors based on out-of-state garnishment court orders that should have been processed under the laws and protections of the states where the consumers lived, and inserted unfair and unenforceable language into customer contracts that purported to limit customers’ rights to challenge garnishments. Under terms of the Consent Order, the business agreed to refund or cancel imposed fees from unlawful garnishments, review and reform its system for processing garnishments, and pay a civil penalty of $10 million.

This action is final.
