Hello,On March 17, 2022 Hardiman Construction initiated work on our property *************************************************** to replace our existing sewer lateral and related work. Unfortunately, we discovered an extremely expensive leak on our property as we found via our water bills and a visit by *********** to notify us of a potential leak on the property. We received our *********** bill with invoice date May 19 for $1,155.76 and felt this must have been a mistake. We looked around for any issues and did not note anything. We assumed it was an error.We were on vacation away from our home from June 22 until July 9. Shortly after returning we received our *********** bill invoiced July 19 for $951.29. On August 10 we received a notice at our house from *********** that a representative came and found the meter was registering, indicating a leak. So, I immediately turned off the valve we installed to the irrigation system to stop water to the irrigation system. First, I contacted Hardiman Construction via an email to ***** on August 9, 2022. I met with ***** from Hardiman Construction on Aug 22. *****/Hardiman did not take responsibility saying there could be a leak anywhere on the property such as a toilet and advised we hire a leak detection service. We contracted with ********** ******** Services who arrived on September 2. They uncovered several cracks up and down the irrigation line along the entire side of the house where the sewer work took place and no other leaks. We received pictures to accompany this report that Im sharing in this letter. I was present at this appointment and saw firsthand where he found the leaks.I hired our landscaping company to repair the irrigation system and ferns.To resolve the problem, I would appreciate you refunding us the outstanding costs that include:$877.50 leak detection $550 irrigation repair/replacement $390 landscape repair Total cost of $1,817.50.Business response

Hardiman Construction/Trenchless Titan (HCTT) installed the sewer lateral pipe serving **************. Item #** of the executed Contract (see attached) clearly states:
Homeowner is to remove any above-ground and **** any under-****************, sprinklers and irrigation systems as well as any other pipes/wires/structures that may be in the work area prior to construction and upon acceptance of the Contract; if said systems/pipes/wires/structures are not removed/****ed and are damaged or broken during the course of construction HCTT is to be held harmless from any/all liability and damage. Homeowner is responsible for any repairs/replacement of such systems/sprinklers/pipes/wires/structures and any damages caused as a result of the un****ed utilities and irrigation systems etc. Homeowner is responsible to pay for any damage and repairs at their own expense.
If utilities are unseen and un****ed, HCTT will not be held responsible for the repair of the utility per our Contract.Sincerely,

I am rejecting this response because: Hardiman Construction is taking no responsibility for the damage done to our property, included landscaping.I am writing to express my deep dissatisfaction with the responses and lack of taking responsibility for the damage Hardiman Construction has done to our property. As stated in the contract, Hardiman Construction is responsible for damage to our landscaping. In addition to the landscaping damage, there was significant damage to our irrigation system which Hardiman continues to take no responsibility for.
Even after sending several emails with pictures, receipts,and invoices and multiple in-person meetings, Hardiman Construction has not taken responsibility for the landscaping damage which is clearly in the contract as stated:
- If landscaping is disturbed/damaged, HCTT will replace it using the existing material;
Furthermore, Hardiman has caused significant damage to my irrigation system, which is an essential element of my property's landscaping. While Hardiman may claim that I did not identify or remove the irrigation system before the work began, it is your company's responsibility to identify and avoid any potential hazards before starting work on a project.
Therefore, I strongly urge your company to take responsibility for the landscaping damage caused by your work, including the damage to my irrigation system.
