      On November 27, 2023, the truck of S&S Trucking hit my car on Interstate 880 South just before the exit to 23rd Avenue. The driver of the truck, *****************************, apologized and said when he changed the lane he did not see my car. There was no damage to the truck as it hit the car with its tires. However, my side view mirror was wiped out and also had scratches on the left side of the car. My insurance company State Farm fixed the car but I had to pay $500 as down payement which I am supposed to get back when the claim is settled by the Trucking company. However, the trucking company has refused to take any responsibility for the accident asking me to provide video of accident as a proof. How would I know that an accident is going to happen so that I can take a video. My insurance company says they are unable to get me my downpayment back because of the refusal by S&S Trucking. They advised me to take legal action. I am a senior citizen living on fixed income. I do not want to get into expensive legal battle with a company who can hire high power law firm. I am sure it will cost me lot more than $500 to hire a lawyer and ultimately it will be spending more money than getting back my down payment.

      The following is in response to the complaint filed by Mr. ****** on 2-4-24. After reviewing the statement of facts submitted by our driver, *************************, we deny being at fault for the accident. To be clear, it was not our insurance company that denied the claim, it was actually the insured's insurance company that determined and ultimately decided not to file a claim against our company for the accident as they apparently agree that their client was at fault. This is a case where our truck turns on his directional signal to change lanes, the insured was at least three car lengths behind our vehicle and as it happens so often, decides that this big truck is not going to get in front of them for any reason. The insured speeds up in an attempt to not accommodate our truck to change lanes and makes contact with the truck as a result. The claimant should have asked his insurance company why they did not pursue the claim before filing a complaint on BBB.

      I am rejecting this response because: Their response is completely fabricated. We were already in the lane when the driver hit us. The damage is all in the front driver side. The driver immediately after the accident apologized and said it was his fault and that he did not see us in his mirror when changing lanes. The driver of the care was going less than the speed limit and did not try to overtake the truck since we were about to take our exit off the freeway. Also giving a signal to change lanes is not enough to be not at fault. It is still the responsibility of the truck driver to check and see if a car is in the lane. My insurance company did not say that it was our fault. This company is stating lies to pass the blame and responsibility.
