      I hired Plumbing Express through my home warranty company to install a hot water heater. Plumbing express administrator pulled a permit through City of ********** but did not advise me of how to follow through with inspection. I recently found out that the hot water heater would not have passed inspection and called Plumbing Express to have them fix their code violations as of the date they installed the hot water heater. They are refusing. Per the Law they should have installed the hot water heater to code. they did not. They pulled the permit which would have needed to be inspected and would have been called out and fixed then. However I am concerned they did not tell me about the inspection process becuase they may have known the hot water heater might not have passed inspection. Other wise they should have had me pull the permit so I would have been aware of the process.

      I am rejecting this response because:

       

      To BBB and Plubming Express. 

       

      What Plumbing Express is saying is False. 

       

      1) per ********** City permitting department they told me two things. 

       

          A) generally the homeowner orders the permit so the homeowner is aware of the required inspection. 

          B) in my situation they gave me the name of Plumbing Express who pulled our permit. ********** city building permit department said that was not what typically happens because the job would then need to be inspected and generally the person who pulls the permit also calls for the inspection who in this case the entity who pulled the permit was Plumbing Express. ********** said they would have needed to have the hot water heater inspected and that if it was inspected even in 2014 it would have failed even to those standards at that time. 

       

      2) I never told ********* or any one at their company I received any documents from them regarding a required inspection. In fact my phone call was exactly the opposite.  I asked why I was not verbally told of the required inspection.  I asked why they pulled the permit and did not let me know if the inspection and why why would then weeks later send me a supposed notice of a required inspection which I never saw.   Additionally if that were the case as in my hot water heater that is not to code even as of 2014 law they would have been required to fix their installation. 

       

      It appears to me this may have been done intentionally.  Other wise why would Plumbing Express pull the permit but not schedule the inspection? ********** Building inspection was willing to only made the code to 2014.  However if Plumbing Express is not willing to bring their work up to the day of their installation I will be forced to file a civil complaint and have them bring it up to todays code.  I was not aware of the time of installation nor notified at all during installation that an inspection needed to happen.

      1). I approached ************************** department and they told me that if a company pulls a permit generally that company also then schedules the inspection because an inspection has to happen specifically on a hot water heater. 

       

      They said generally the home owner pulls the permit so they can then schedule the inspection.  

       

      In this case even if the inspection did happen in 2014 the hot water heater would have failed. 

       

      2) I spoke with Plumbing Expressed and never had any conversation about receiving any documents from them about me needing to scheduling an inspection.  In fact I asked them why I was not verbally told at the time of the install that an inspection was required.  Their representative said we pulled the permits and sent you the required paperwork weeds later.  Is what I was told on the phone.  Which does not make sense to me or ********** City because an inspection would have failed of this hot water heater and I never received any paperwork from this company that an inspection was needed.  

       

      Per ********** city building permit they were willing to have this hot water heater pass code requirement as of the date the permit was pulled.  However if this becomes a civil matter, and I have to pay another plumber to bring it to code, I will ask for it to be brought up to todays codes requirements.  Then I will ask for Plumbing Express to pay for those costs and fees which per the law is allowed.  Plumbing Express told me when I called that it was beyond their warranty however it was installed  not just incorrectly, it was installed illegally this is a FIRE DANGER.  There is a required 1 sleeve that is required to be installed before any combustible material which there is not.  Plumbing Express Plumber should have known this. 

       

      This is not up to code and would legally have had to have been repaired in 2014, 2015, 2016 and any year up through 2022.
