Earth Systems conducted some diagnostic work on my property from 7/5-10/23 to identify the source of water seeping under my living room floor. When the person was initially here to set the job up, I asked if he would talk to my contractor when the results were in, and he said yes. I signed the contract for the work to be done, realizing that it would be expensive, on 7/3. A report on their findings was issued to me on 8/2 and the invoice was issued on 8/16. I paid their bill of $2478.00 within 30 days. On 9/20 (a month and ½ later), I received a subsequent bill of $234.00. I had no idea what this was for so I inquired. I was told that it was “in regard to final review of the recommendations report sent on 8/2 and for answering the call from my contractor. These charges were in addition to the ones on the previous invoice, which was for the site visits and most of the report preparation.” (I had already paid $990 for the report preparation and another $225 for drafting it as part of the $2478.) However, the report I received on 8/2 does not include the word preliminary on it anywhere and it does not say a final review would be coming. And I never received one. Nor was I told verbally that there would a second charge for the report, and the contract does not address this either. Further, I was never informed that I would be charged for the phone conversation the project manager had with my contractor when I asked him; nor is this in the contract I signed. I explained all this to the project manager yet he still thinks I should pay. His response was: “we prepare invoices for all jobs during the first week of the following month so there is a delay from issuing a document to your receiving the invoice.” But the invoice arrived two weeks after the report was issued. And this does not address the issue of notifying a client that there would be additional charges after a report was issued. My contractor thought this was unusual and told me not to pay it.
