My name is *************************** and I am residing at **** Sun Valley Drive, **************. I have a rental property in ******** at ***********************************************. The tenant was not paying rent nor the utilities, since November 2021. I talked to the tenant a few times but they ignored my request to pay the rent and their utility bills. Then I hired the Valley Eviction Services, ************************ to provide the eviction services. She gave them the 60 day notice on January 25, 2022 and charged me $150.00 to give them the 60 day notice. After 60 days passed, ************* asked for $900.00, so she can file the eviction case with the court. I paid $900 to Valley Eviction Services (*******************) to file the eviction case in the court. I filled out the paper work on April 6th, 2022 but still she has not filed the paperwork with the court yet. For the last six months, I am making the payment for the property from my pocket and in addition to that, their utility bills. ************* charged me in advance to provide the eviction services but failed to do that. Now I tried to contact her by phone and emails and she has not returned calls or answered my emails. I am really suffering financially by making the house payment and utility bills from my pocket. I am losing $1700 rent per month and about $350 per month for utility bills. If Valley Eviction Services (*******************), can not provide the services she promised, then why is she charging the costumers in advance, she should not be running the business if she cannot provide services. I am requesting your service to intervene in this matter and help me to get the hard money that I paid to her plus the money I lost on my rent due to her ability to provide services she promised and charged in advance. If you would like to contact me please call at ************.

      Business response

      06/15/2022

***************************, who we know as "***" contacted our office in the third week of January to request legal help with a tenant. We informed her of the steps involved for evicting a tenant in ******** and in **********. We also referred her to the rental assistance program "El ********" and recommended she write to them to request assistance in recovering lost utilities and rent. We never received confirmation that she acted on it.

The money paid by *** was used to resolve the conflict and concern she has with her own tenant. She may have thought that contacting El ******** was our responsibility, however we are not a property management company, we are a law office. We indicated to her that this is something she would need to do in order to comply with the current laws in the *******************. If she is not ready and willing to do this herself, then she may want to hire a property management company.

We've done everything we can to help her, however she has ignored the things we've shared with her to resolve the concerns she presented to us. We've made several phone calls, but she has not returned our calls.

      Customer response

      06/20/2022

      Hello ******,
I reject the response from Valley Eviction Services, the majority of the statements they are making are not right. Let me tell you the whole truth from the beginning to date which is as follows:

On January 20, 2022 I called ******************* ( Valley Eviction Services) to evict my tenants from *************************************************. She told me, first we have to give them notice for 60 days to vacate the property and it will cost you $150, if you deposit the money in my account then I will start the paperwork.
I deposited the money in her account on January 25 , 2022 and she served them on January 28, 2022. She told me, we have to wait until March 30, 2022 for further action depending upon their response.
I called her March 31, 2022 to ask whats the next step because I have not heard anything from my tenants. She told me, we have to file eviction paperwork with the court and it will cost you $900. Once you deposit that money in my account, I will send you two papers to sign. After I paid her $900, on April 5th, 2022 she sent me two blank forms on April 6, 2022, I called and asked these are blank forms and can you tell me what I am signing and she told me, dont worry , go ahead sign and send it back and I will fill it out and check the boxes later. I signed it on April 6, 2022 and sent it to her.
She said she will file the case by Friday April 8, 2022.
On April 11th I called her and she told me she already filed the paperwork with the court.
Then I called her on April 20, *************************************** that the courts are running two to three weeks behind and it will take a little longer.
On May 11, 2022 I called her to check the status and she said the papers got returned because the lawyer forgot to sign it. She said we would have to resubmit it again after lawyers sign it.
I called the courts by myself at the number, ************, and they said they did not have any of my paperwork in May.
I called ************************ on May 24, 2022, and left her voicemail but did not get any response back. I waited a week or so for her to call back. She did not call back, I called her again and no answer and I left her a message each time I called her.
Then I called the court house again on May 24, 2022. The clerk told me Valley Eviction Services misspelled my tenants name wrong and the papers are being returned back to them. She got the money upfront but showed no responsibility for her services. I told her many times how difficult it is for me to make the mortgage payment and their utilities bills. She told me to file with El ******** for help. I called them and they told me that applications for rental assistance were closed by December 15, 2021.
I also called the housing authorities for help, the housing authority told me that since they are not paying utilities you can give them a 15 day notice, then I called ************************ and told her that the housing authority said to give them a 15 days notice. ************* said we can't do that because we already gave them a 60 day notice.
Because I was not getting the service I paid for, on May 25, 2022 I sent her an email to return my full money I paid plus two months worth rent ($3400) back and I would get help from someone else.
On June 1, 2022, I called the courthouse clerk  and she told me ************* filed a case on May 31, 2022.
On June 7, 2022 she called me and left the message to call her back. Same day I called her back and she told me we got a response from the court. It only took a week which clearly shows how much time she wasted due to her lack of responsibility.
On June 7-2022 ******************* told me tomorrow we will file the notice with the judge. It will take him 24 hours to sign it. Also, once we send them the certified letter they have 15 days to respond.
******************* from valley eviction services called me on June 13, at 11:20 am and left me a message about how it had come to his attention that I was unhappy with the service at Valley Eviction Services and to give him a call back.
Then I called him the next morning on Tuesday 6/14/2022 and left him a message about how ************************ is not doing her job that I had paid her for.
Then ten minutes later he called back and he was very aggressive, rude and used some racially discriminating language. He was enraged and was not listening to what we were trying to tell him. He kept on insisting that we insulted ************************. I tried to tell him about the whole situation but he just kept going and not listening to me. I told him multiple times to stop and listen. Please let me tell the truth, but he kept raising his voice and he was blaming me and kept saying If you do not know how to deal with American people with respect, you people need to go back to where you came from. Finally, I said ok if you dont want to listen to us then you can do what you have to do and we can do what we have to. We know our rights and we know who to contact for help. After that he calmed down, and started talking normally, and he said, ok tell me what you have to say. After listening to me, he said from now on I will deal with your case and asked me to send him the emails I sent to *************. He texted me his email and requested that I send everything that I sent to ************************ and forward it to himself. ********************** said ************* had been calling me and I never returned her calls, but it was the other way around. I always called *************, and she rarely picked up the phone but when she did, she was always rude to me like I was bothering her.
After investigating, ******************* called me on Wednesday  6-15-22 at 2:14 pm to talk to me for about 20 minutes and he apologized for being rude on Tuesday 6-14-22. He told me the judge signed the paperwork and they will post it on Thursday 6-16-22 at their door and I asked him how much longer it was going to take, in which he replied another month to a month and half. *********************** was explaining to me the reason it took longer was because I forgot to initial at one place but I was never told that by ************************ and they did not send me any paperwork to re-initial.To this day, I never received a paper to re-initial, who signed my initials? This was a lie because I was not given anything to sign again, which means that this was a poorly thought out lie to try and blame me for their own mistakes. They were trying to cover up how they mishandled my case.

Due to a lack of their responsibilities and professionalism they should get penalized, I should get compensated for the loss of time.

      Sincerely,
      ***************************
