      I took my car to this dealership to get a simple sensor replaced, when I came in to grab some of my stuff from the car well I waited on the part I saw my car parked nose into the curb which was leading to the bumper getting deformed. The also swung a lift arm into the side skirt damaging that as well. Not to mention the damage to my wrap on the top of the bumper. I tried having them resolve the issue but have countless emails and me even showing them the geo located pictures showing them the damage occurring on their property they are still saying they did nothing wrong and my car had that damage before I dropped it off but THEY can't prove anything they say.

      The vehicle was towed into our dealership.  For the repair done which was a knock sensor it is not required to be put on a lift so it was not put on a lift therefore the damage on the side was not caused by or at our dealership.  No pictures have been provided that prove that we did the damage and we questioned if the tow company did the damage or existed beforehand.  Mr. ****** in his email admitted that the front bumper already had damage. Mr. ****** requested in an email after going back and forth about damage responsibility that he just wanted a bumper so he could get his vehicle wrapped.  We offered the bumper per his request and he then asked if it would be painted and we stated no because he only requested the bumper so he could wrap his car.  Since we wouldn't paint the bumper, he didn't accept the resolution.  Attached you will find the email communication between us and Mr. ***************** offer remains the same, the front bumper (unpainted) so he can wrap his car.

      I am rejecting this response because:
      It makes no sense to me they feel they have any ground to try and blame the toy company. I take care of my car. I watched it get loaded and unloaded from the flat bed.

      I did mention that thier was existing damaged but that has nothing to do with what they did. I just feel like this is the big corporation not wanting to just own their mistake. I only attached 1 photo because that's all this program let's me do. But if some wants to call and talk to me I'm open 24hours a day to answer my phone and answer any questions. 

      As for the "lift damage" that's just what I assume caused that damage I don't know what they did exactly but again I have pictures of my car on the tow truck with no damage. I come to grab stuff out of my car because it will take a little over a week to get that sensor in. I saw this damage with my own eyes, my bumper was being deformed because this company doesn't care about it customers. I will do whatever I need to do to prove to you that this was all peak kias fault... this has bin over a month of fighting with them and I feel like I'm going insane over it.

      There is no proof that the damage was not caused by the tow company and the customer admitted in the email there was previous damage on the bumper.  Our good faith offer remains the same.

      I am rejecting this response because: this tow company was the most cautious tow company I've ever seen. I watched him load AND unload my car and there was never and damage done. I SAW my bumper being damage with my own eyes as it was parked against the curb in their parking lot (so I took a geo located picture). Yes I did say "I just want to wrap my car give me a bumper" it was implied it would be a paint matched bumped because you can not wrap un painted body parts on cars. You will never get proper adhesion. I figured with them being a auto shop they would understand that.

      Terrible! Absolute rip off merchants! Sold me a **** explorer for almost 26k with their power train warranty! Car engine blew up after 5 days!! They eventually replaced the engine which took weeks of excuses and being given the run around and Ive had nothing but issues ever since. Electrical ghosts (which is what the **** dealer called it because it all worked when tested), Battery randomly not connecting and leaving me stranded on multiple occasions for no reason, speedometer dropping to zero and car chocking at 70 on the highway again and again and so much more. Not to mention the last oil change they kept me waiting two hours and when I said I had to go to pick up my child they said it was ready but apparently forgot to put any oil back in it so I had to stop at the nearest garage and buy some so my car didnt seize!!I tried to return it because the ** PERSONALLY PROMISED ME IF I KEPT HAVING ISSUES AFTER THE REPLACEMENT HE WOULD TRADE IT OUT - BUT WHEN I WENT BACK HE HAD CONVENIENTLY LEFT AND NO LONGER WORKED THERE!! Of course, no one would do a thing about it!******** promised she would look after me, shes the service manager, so I go back and talk to her TODAY and ask them to keep their word on a swap out and she sympathized with me still having all these issues. She introduced me to the sales ** who offered me a pathetic 10k -so a reduction of 16k in 18 months!! I then went back to ******** and said since they are going to rip me off on a trade can she at least fix it under the power train warranty they sold me! She promptly told me to take it to **** because they dont have the tools to fix ****s!They sold me a lemon and endlessly lied to put it right and wont! This is why people dont trust dealerships anymore and they should have to be held accountable!

      We cannot do an exchange because the vehicle was purchased two years ago (10/2/2021) and used car pricing was drastically different then plus the vehicle has depreciated.  We did replace the engine with a brand new engine at no cost.  The last date of service was an oil change on 9/26/2022 and we haven't heard anything since.  

      You did purchase an extended service contract on the vehicle.  You can bring the vehicle to us and we bring it to **** for diagnostics or you can bring it directly to **** and we work with them if they have questions.

      I purchased from peak **** I asked them To please Remove the warranty a month ago. It still hasnt been removed one For **** and they added one for 399. They have yet after over 5 requests. The salesmen also lied and stated hail damage to windshield was repaired and. It clearly is not. The car recently at not even 30 stopped in traffic for a drivetrain malfunction. They arent responding to my request for repairs. I have a **** mile 3 month warranty. I am having so many issues with this dealership.

      Our sales manager has spoken to ************* via phone and email and emailed the form that needs her signature to cancel the Windshield contract.  We will also cancel the etch product (399) with the same cancellation form.  This money will be refunded to ENT since they are the lien holder.  She can email me the cancellation form ****************** so I will get this processed immediately.

      My story:Bought a used 2015 **** Escape from ******** of Colorado Springs Nov. 22,2021 picked it up about 5:30pm on Nov.23, 2021. Drove it home. Went to go to work the next morning and the check engine light came on flashing. Under 20 miles driven. Took it to have the codes read and then back to dealership Nov 24, 2021. They replaced a sensor. I told them the codes it read are more than a sensor. I picked it up Friday evening the 26th. Wednesday Dec 1 on my way to work lost power stuttered and check engine light on flashing again. Took it back and they have had it sense. They tried to get me into another car because it failed the compression test and they told me it needs a new engine. The choice they offered me for another used vehicle was way more money and I asked if they used the warranty I purchased for the car can they get the new engine put in. The ** **** said absolutely but we would have to wait for the 30 days before the warranty kicked in. Which we did. The dealer said they were sending it to ***************** **** for what they call an inspection. Know **** is gone. ************* manager will not return my calls. I still have their loaner and they only want me to pick up my car stating that is perfectly fine until I drive it putting myself and other commuters in ***** way so it can duplicate the codes they erased. So today I go to the **** dealer to find out my car was never taken to **** so this is the first lie they were caught in. And then I called the warranty company and not one phone call was placed to have any parts repaired on my car. I called ******** again today to leave a hand written message with the receptionist and she said That she had another manager names ****** in today. So she put him on the phone and i apologized as this was going to be new to him. I told him everything including that I went to **** and called warranty today and that I was lied to he said I have worked with this crew for a while & I find it hard to believe they would lie.

      I am rejecting this response because: they have not addressed any part of the issue and the lies. They cleared the codes putting my life and those of others in danger trying to get the codes to reappear. They are promising me that **** will fix the issue. **** is not involved in this, except where ******** is insisting they be brought in. Bottom line they said, they promised they would replace the engine that is no good but their service departments tests and that I had to wait for warranty to kick in. They never once contacted the warranty company and instead cleared the *** of all codes so that it would test fine to get out of fixing a vehicle they said was no good under my purchased warranty. I have yet to be apologized to but continue to be lied to and cheated out of a properly running vehicle. I do not believe that putting me behind the wheel of a no good vehicle and me trialing my life for the codes to reappear after they cleared them is proper business etiquette. They want to put me in another car based on what they get in and I have to return credit that they have ******* a dozen times already and depending on what vehicle they bring in you think I would trust that it would be ok. They bring them in and sell them the next day. How is any type of proper inspection being done. I wont charge another ***** for any longer term then what I have especially for a used vehicle they obviously will not inspect properly. I have a complaint into the CO dealer board for their actions. I have a lawyer walking me through how to address this problem without a **** lawyer ****. I can not do business with crooks and that is what has happened. I can not and will not trust them when their own service department is telling me what is wrong

      We have offered to let her out of the deal and give back her trade or if the engine fails (which will require **** to tell us this) then we will replace this under her service contract.  The vehicle was sent to the **** dealership in Motor City and no issues were found at that time.  The safety concern is why the option of unwinding the deal is an option.  ***************** is in one of our loaner cars which we have requested for her to return.

      I am rejecting this response because:one: I was never offered to get out of this deal and get my trade back. I asked for this the next day and was ignored. They promised to fix the car. I have NEVER been asked to return the loaner. Not once. I was offered a huh out of my purchased vehicle when a used vehicle came in that would match the specifications of the loan I have received. **** has NOTHING  to do with my car. They did not sell it to me. The warrant company said that not one person from *** called about Mt warranty and ***** at National Auto Warranty stated that the service invoice that I had from *** was enough to get the car fixed. *** never attempted to fix the car but instead cleared the codes from the *** and got another dealership,**** involved in hopes that they could get out of the situation. I will not tolerate anymore lies from this company. His lies to you on this BBB complain t are just added fuel to the already collected documents and recorded calls that will sink this dealership. I have been more than patient waiting for them to do what they promised.

      In our response dated 1/13/22 (which she rejected), we stated the two options were 1. If **** says the engine is bad, she has an extended service contract and we will work with her to get her engine replace (**** is involved because it's a **** product and know bullentins with **** products) , or 2. Unwind the deal and put her back in her trade.   **** Byerly sent a follow up email on 1/18/22 verifying her email and restating these options with no response.  On 1/18/22 at 11:08 am, ***************** left a voice message that she would not bring back our loaner and pick up the Escape until she received a letter from **** Byerly.  **** Byerly sent the email about the engine at 1:10 pm (copy attached).  The two options are still the same as previously stated.  We need for her to make a decision and bring back our loaner.

      I was promised miolte times this letter. Which I had to beg for to get somewhere. The letter is 100% a lie. Nothing in that letter was ever discussed. So I said that I wanted the truth in writing not lies. You are trying to make me look bad for your companies bad behavior. I don't stand for lies or makes people look bad. **** has nothing to do with this. *** involved ****. *** deemed the engine bad. *** never once called my warranty or tried to fix it. Read the attached texts between me and the *** *********** Oh and I asked for my trade back the next day and from what I was told it was gone. So I want proof that you still have it. Because if you do then that is another lie in the *** ***** of my life. My car only needed an oil change when I trafed it. New tires new brakes new caliper.
