On 10/27/21, Joe M********* came to my house to evaluate/fix a leak in my roof. He charged me $150 to evaluate the leak. He stated that he would use the money toward the final cost of the roof repair. Joe never gave me a quote or a timeline or a specific plan to fix my roof. I contacted him via phone call, text and email. On November 1oth, he stated via email, "I'm currently working on two large projects and also inundated with new appointments. I will do my best to provide you with an estimate once I'm able. If you cannot wait, I suggest you seek another contractor." I never heard back from him on a plan to complete the work. He cashed my check on November 1st. I am requesting that Joe returns my $150 and I am also requesting that other potential customers are warned of this situation. My company charges a non refundable Service Fee of $150.00 to inspect and detect the cause and or causes of water infiltration that are affiliated with a roof/chimney, window, and or siding that requires accessing the areas with a ladder.
I was upfront with ******** and explained the terms of the service fee prior to performing the leak detection services. The following was explained: 1)Service Fee is non refundable and is for my time spent to inspect and determine the nature of the water infiltration.
2) Once the nature of the water infiltration issue or issues are determined, I provide a repair proposal of which the service fee of $150.00 is deducted from the REPAIR PROPOSAL.
3) ******** agreed to these terms of which my son was witness to.
4) I provided a verbal findings of her leak issues, exterior sealing of a window at her second floor bedroom and also asphalt shingle roof issue that was installed incorrectly over the front entrance.
I was contacted numerous times by ******** to SUBMIT a REPAIR PROPOSAL and also when I could perform the repairs. At that time, I was extremely busy with large projects and notified her that I was unable to provide a proposal and also perform the work.
******** didn't accept my response very well and mentioned that she would perform the window sealing part herself if I provided her with a recommended sealant. I recommended that she contact another contractor to fulfil her repairs that I IDENTIFIED as part of the $150.00 Service Fee.
I never heard back from her to see if I'm free to provide the repair proposal and perform the work. Yesterday, I received an email from her demanding a REFUND by December 29th?????????
I responded to her and clearly stated that I would work with BBB first to explain my business practices related to Service Fees and then contact her accordingly.

I am rejecting this response because:Joe's determination of the nature of the water infiltration was not the same as the 4 companies who evaluated the leak after Joe did not return or give a proposal to repair the leak. The 4 other companies stated that the roof needed to be replaced. Each stated the same reason for the need for replacement. Joe did not make this same determination. Joe never gave me a repair proposal. After I contacted him several times via text, phone call and email, he made the statement that he was too busy and was unable to provide a proposal or timeframe. He suggested that I find another contractor if I could not wait for his undefined timeframe and proposal. I stated that I did not have another contractor at the time of our last communication in November. i asked for advice on how I could seal the window and he did not provide it. I proceeded to contact other companies as mentioned above, since I needed to have someone to repair the leak in my front doorway. I asked for a refund since he never contacted me again to give me a proposal and/or a plan on how he would repair the leak. I agreed to pay the service fee because the plan was for him to repair the leak and use the money towards those repairs.
Joe was aware when he arrived on October 27th that I had contacted several companies who stated that they were too busy at the time to repair the leak. He boasted that he came out right away. Never did he state that he was too busy to give a proposal for the repairs. If I were aware of his lack of follow-through and unavailability, I would not have paid him $150 as a check written directly to him.
