On 10/7/23 my husband and I entered into a contract for the purchase of a travel trailer from RV One Superstores Connecticut d/b/a **** ******* **, ****** ** *registered business in ** as ** ******** *** ********* ***) (the "Dealership"), paid a $5,000 deposit, and filled out financing paperwork to obtain a loan with *** **** ** (the “Lender”). The finalization of the purchase was subject to our final inspection and acceptance of the trailer, as it was used and being delivered to the Dealership from another location. This is noted on the Buyer's Order from the Dealership. The Dealership was supposed to deliver possession of the trailer by 10/30/23, with the loan then taking effect, first payment due 11/6/23. Upon inspection, on 10/27/23, there were issues with the mechanical slide (not functional) and the flooring - the Dealership assured us that these defects would be fixed. After numerous follow up attempts to check on the status of the repairs, we cancelled the contract on 11/30/23 after being told by the Dealership the repairs would not be complete until mid-December. At no time did we take possession because the Dealership failed to deliver. Nevertheless, the loan was processed. We began receiving calls for past due payments - starting with the 11/6/23 payment – this has had a detrimental effect on our credit rating. The Dealership advised that it would "unwind the loan." The manager advised that they submitted the cancellation paperwork to start the process on 12/7/23 – putting it out of the Dealership’s hands until processed by the Lender. After repeated calls to the Lender to check on the status, on 12/27/23 the Lender confirmed that no cancellation was submitted and that the loan is still active, and that we needed to contact the Dealership to address the matter, particularly since we are not in possession of the collateral. Additionally, the deposit was never returned upon cancellation of the contract, despite being told that it was fully refundable.
