      Business Response /* (1000, 5, 2022/04/13) */ Adley Homes, Inc., the employees and sub-contractors take great pride in producing one the of the best homes in our market. Our litmus test is always, what would you do if this was your home. We offer the following: Mrs. ****** and Mr. ******** did a walk-through of the home on 11/1/21, prior to closing, to inspect the home. The vinyl floors were never mentioned at the walk through. In addition, Adley Homes took pictures of the home prior to the closing. The pictures do not show any issues with the vinyl floors. Within two weeks after ****** and ******** closed on the home, they complained of problems with the vinyl flooring. Upon receiving the complaint, the installer of the floor inspected the vinyl. During the inspection, the sub-contractor indicated that there were only two planks that appeared to be damaged and that they would replace them. The subcontractor also observed that it looked like something had been put on the floors. The subcontractor agreed to also re clean the floor. When the subcontractor returned to replace the two planks and clean the floors, they noticed that whatever the homeowner applied to the floors, was coming off and balling up in little balls. At that point, the homeowner admitted they put something on the floors to "make it shiny." With that information, the subcontractor pulled off the job. That same day, the subcontractor met with the installer. They advised that the two planks that were to be replaced were coming from the same box as the original vinyl tile and they would not match because the floor finish had been altered by whatever material was applied by the homeowner. Please see attached email from subcontractor. The floor was also inspected by the **** ********** manufacturer's representative, the installer and Adley home representatives. They concluded that the product was not deficient, and installed per the manufacturer's guidelines. The homeowners were told that whatever they applied to the floors to "make them shiny" damaged the floors and voided the warranty. The homeowners were advised on several occasions that we provide a third-party warranty. Instead of filing a claim against the third-party warranty company as required by their contract, they instead seek to obtain compensation by threatening our good name and reputation. If they have a claim, they should simply file it with the third-party warranty company. Business Response /* (4000, 13, 2022/05/09) */ The floors were cleaned prior to the pre-closing walk through. Any cleaning necessary was from the foot prints from those present at the walk through. Again, the only issue with this situation is that the homeowners wanted a "Shiny" finish, however the flooring that they selected does not have that feature. They altered the original product therefore warranty is voided. Adley Homes does not agree with their version of the history. In regards to the third party warranty: the buyers signed the warranty paper work at the final walk through and would have received additional paperwork in the mail after closing. If they do not agree with Adley Homes, they can simply file a claim on the warranty and they can determine whether it is covered or not. Sincerely, Adley Homes
