      On 2/17/22 I contacted **** ****** of ******’s Tree Service, LLC, to come to provide me with an estimate for work in my yard. That day he came and provided me with an estimate of $4,800.00 for removal of 5 trees, stump grinding for those 5 plus a 6th stump in the yard, trimming back branches on two overhanging oak trees, and hauling of debris. The work was completed as agreed 2/18/22 and I paid the foreman $4,800.00 by check. Heavy equipment was used to complete the work. This created ruts on the right side of my yard and on the left side of my neighbor’s yard. The next week my neighbor advised me of the damage and said the equipment also ran over one of his in-ground sprinklers. That was not damaged, but my neighbor was very upset about the rut in his yard. I called *** ****** 2/28/22 to notify, and to ask him to come by and see the damage. He said he would be by the next day. On 3/1/22, *** ******'s workers arrived with yard tools to repair the damage but they realized the ruts would require at least fill dirt. My neighbor asked for his portion to also be resodded. They said they would be back later that week. I called *** ****** 3/4/22 to find out why they had not been back to make the repairs. He said the repairs would be made later the following week. I called *** ****** 3/16/22, 3/18/22, and 3/28/22 to obtain an update on when the repairs would be completed. His response was typically “the middle to end of the following week”. On Thursday, 3/31, *** ****** personally stopped by to see what needed to be completed. He said he would be back the next day with fill dirt to fill in the ruts in both yards. He said he would not resod the damaged portion of my neighbor’s yard as that was unnecessary. He went next door and spoke with my neighbor about the issue. No one came nor called the next day. I called *** ****** again on 4/11/22. He said we were “on the schedule” for 4/15/22. To date the damage has not been repaired.

      The complaint he signed a contract that we both have in our possession in the contract it states that ******‘s Tree Service is not responsible for ground covered or any type of underlying structures they are solely on the purchaser I explain to the customer before we started her job that there is never a war without collateral damage we took down some big trees for this customer and haul them away equipment had to be used in order to make this job happen for her safely I was called in reference to a little bit of damage on her neighbors property we went by there and reviewed the damage and it was so insignificant that there was no possibility for any repairs we did put pitchforks in the ground and lifted the ruts up the ruts were so minor that I cannot even understand why they would have even complained they insisted on dirt requested that grass and sod be brought in which is never the case  also she signed a contract that states we do not receive any money until the job is completely finished and the customer is satisfied that is also how we advertise in the Mini Mint magazine we do not request any money until the customer is satisfied she was satisfied and she paid the bill  after the job was completed this customer calls me back we can a half to two weeks later meaning that the damage could’ve been done by anybody just pulling on the grass in any type of vehicle, Reality and facts of this case is that she the customer ***** **** because she was 100% satisfied

      I do not see a question anywhere for me to answer although it says for me to respond to the question just for the record ::: you turn my business into the Better Business Bureau in hopes for encouragement ? Really ? Wow , ok :::: It is like you said you sign the contract we agreed on a , and that contract it says to be paid in full upon completion you paid me in full when your job was completed ! That is because you were happy with the work and it was completed otherwise you would have not paid me but to call me back 10 days later and requested I come back and do additional work for free is not satisfactory when I have a list of other customers in need of help you blamed an issue on us that I am not even sure we did and I told you that if I was in your area and I could bring you a little dirt and put in the roof that I would out of the kindness of my heart but I could not stop other people from getting trees that are falling down on their houses to come put dirt in a little spot that is 3‘ x 3‘ if even that and now I am certainly more encouraged to do so  (imagine that )

      I am rejecting this response because: *** ****** verbally agreed to me multiple times and to my neighbor twice to repair the damage caused by his crew. It appears he never intended to honor his word to either of us as this response confirms.
