I am the president of the board of directors of Highland Lakes condo two. In 2015 we contracted Bayside roofing to replace roofs on 4 of our buildings. The contract came with a 20 year manufacturer warranty and a 15 year warranty for labor.The amount that Bayside was paid for the four buildings was $28,800.Our management company, Frankly coastal, recently reached out to Bayside roofing to advise of a leaking roof at *************************************** They were contacted via phone and via email. After one week of not hearing a response from Bayside, I chose to pay them a visit at their business in *******, *******. The receptionist assured me that someone would get back to me within a day with a schedule to come and see the roof which needs to be repaired. It has now been two weeks and there has not been a phone call nor an email returned to us, nor has that been a schedule for someone to come and view the problem and schedule a repair. Since the roof repair is the responsibility of the association, we were forced to contact another roofing company for an estimate on the repair. We were given an estimate of $1650 although we still have between five and nine years left on the Bayside roofing warranty.Bayside should be responsible for that $1650 reimbursement. We sincerely apologize for the mishandling at *************************************** We acknowledge there was a lack of communication on our end. However, it is important for us to note that the warranty was voided due to the installation of a dryer vent and a new A/C unit being installed. The permit #: CBP-22-*****; run dryer vent through roof. This permit was issued 1/13/22 and our work was finished in 2015. Our permit #: PER-H-CW15-***** which was issued 6/5/15 was done per code at the time. Noting it passed final inspection at that time. We also, have pictures of a new A/C unit installed on the roof. The picture does not show a date of the install nor was there a permit pulled but there is a serial number on the unit. The way ******* (the manufacture of the A/C unit) distinguishes/recognizes dates is through the serial number. The first two digits is the year and the second two digits is the week of production. The serial number on this unit is **********, thus meaning it wasnt in production until the 10th week of 2022, several years after our work was completed. Due to having another company run a vent through the roof and the install of a new A/C unit the warranty is void. Thank you for your response, however, we are both aware the entire building is labeled ******************* but there are four units which comprise the building. There are 4 different owners with 4 different air-conditioning systems and 4 different roofs.
******************* is divided into four units A, B, C, and D. The leaking roof occurred in unit A.
That unit does NOT have a dryer vent nor have they had their ** replaced since the roofing was replaced in 2015.
Youll notice that the permit for the ** is for unit C not unit A. The picture you submitted is for the A/C at unit C. Not A.
The warranty for the roof on unit A should not be voided because there was no subsequent work done on that roof.
Had someone come out to see the issue they would have known that the area we were talking about was 2710 A. .rather then spending so much time
researching permits and taking pictures of air conditioners having nothing to do with the leaking roof.
We did not have the luxury of waiting more than we did, for Bayside to respond, we needed to remedy the issue, especially since we are in the middle of hurricane season.

Dear Better Business Bureau and Concerned Parties,We appreciate the opportunity to further clarify the situation regarding the warranty at ***********************************************1. The leaking pitch pan on Unit A's roof is shared with another air conditioning unit. Which is the unit that had the leak.2. One of the air conditioning units utilizing this shared pitch pan was replaced without our knowledge.3. This replacement compromised the seal of the pitch pan, leading to the leak.4. Aside, from the shared pitch pan, there are other factors that could have disrupted the integrity of the roof. Such as, foot traffic, transporting of old and new equipment, tools and debris left on roof, etc. For these unknown factors and for several others our warranties are Void after having any other contractor present on the roof.Any modifications or work done on the roof, including shared elements like pitch pans, should be reported to us immediately. This would have allowed us to ensure that such work was done properly and without comprise.We remain committed to providing quality service and maintaining the integrity of our work and company. We apologize for the inconvenience caused by this situation. Again, I thank you for your response however, the information in your response is not completely accurate.
Attached are pictures of the roof at ******************* which has four owners & four air conditioners.
You will notice that each air conditioner is on its own pitch pan. There is not one shared pitch pan for multiple air conditioners. And again the air conditioner that was replaced was the air conditioner in unit C and it does NOT share a pitch pan with the air conditioner of unit A
Admittedly, in the past, there may have been foot traffic on the roof, but I contend, it would be nearly impossible to try to get Bayside roofing out to review a roof & validate the warrantee just because foot traffic may have been there.
After all, It took a complaint to BBB to get a response from Bayside for a leaking roof - in the middle of hurricane season..I cant imagine how many phone calls or how much time it would have taken for someone to come out just because there may have been foot traffic on a roof.
If there cant be an honest conversation, I will spend no more time on this complaint.

Thank you for your highlighted picture however, your explanation is not accurate. Those two air conditioners that you have highlighted is for units A & D.Unit D did not install a new A/C.It was unit C .This is getting pretty embarrassing.So youre saying that someone from Bayside actually did go and look at the leak? How do you look at a leak if you dont enter the garage where leak is occurring? According to the homeowner, no one came to the home looking for entrance into the garage.Sounds to me that someone may have come out, just walked on the roof looking to find a way to void a warranty. I truly doubt that you can find a leak from just standing on the roof.Every other roofer I have ever had come to a unit had to have access inside the home.The most intelligent explanation I have been given so far is that the roof is considered one roof, regardless of how many sections it is divided into. I dont agree with it, but its the most intelligent explanation Ive gotten.Everything thing else is just.reaching.I have sent back your highlighted picture correctly marked with the unit letters.Again, I am done with this and with Bayside Roofing.Initial Complaint

I bought a new roof from Bayside roofing. In the 3 years prior to that they were happy to come and patch my 20 year old roof. With minimal effort and costs to get us through until we could save for a new roof. We were and still are grateful. However, fast forward, we hired them to put on a new roof. We have had more leaks with the new roof. And they have sent out crew after crew. Half of the crews will not even get on our roof because they are not prepared for the pitch. Again the company is very well aware what our roof looks like. The other half say they dont have the supplies to fix it. The latest complaint about a leak began around May this year. To this day we have had several crews 2 of witch got on the roof with a caulk gun and then left with in 15 minutes. I was very clear I dont want my new roof patched with caulk. I want them to to go in and replace any flashing or anything else that *** have gotten overlooked in the initial replacement. The reason I am specific, I have had to replace flashing on other parts of the house the it was not replaced when the new roof was put on. This was done by a contractor that came to redo stucco walls on the upper level. At my cost. I just want them to fix this one with the same professionalism at their cost. Good afternoon. We are aware of this issue. We have sent multiple crews out to rectify this issue, but we have been unsuccessful in making the client happy. ************* discussed fixing the issue with the homeowner but when our technicians went out, they were told by the homeowner they needed to do additional work than what was approved by the company, so they were unable to comply with their request. Finally,after several attempts the crew was able to do a permanent repair to fix the leak and the homeowner should not have further issues. We told the homeowner to notify us if the issue persists, but we will be willing to address future issues should they arise.Customer response

I am rejecting this response because: the company has not even bother to send anyone out since the complaint. I have spoke to ********* the owner twice and both times he was unaware of the situation. My roof still has a leak and has had one for two years since I paid ******. For a new roof. Caulking in my opinion is not a proper fix for a new roof. They had a contract assuring me they would replace any all flashing that was needed to. Clearly they did not. And now they dont want to go back and do the right thing. Also the contract had a life time warranty. Trust me I would love never have to deal with this again. There are also damaged drywall from the leaking that was never replaced or even painted.

I got nails in two different tires of my vehicle from this business working on the roof. The first nail was discovered when their tarp got wrapped up in my wheel. Apparently, there were nails under the tarp! I work in home health and have to drive for hours during the day, so I had to go get it fixed right away so that I could go see patients. An employee guided me when backing out, so that employee is aware of this situation. I got the nails taken out of my two tires, and that cost me $48. I got in touch with the company at least five times over the course of the last three weeks, and no one is calling me back. I left messages with receptionist, ****, every time except once when I left a voicemail. I told **** the first day that I had to get the tire fixed right away and get to work and that I would not be home until after dark that day. My son said a person stopped by that day, so I called again after I was notified. **** assured me that she told them that I would not be home. Nonetheless, they have not made any effort to contact me since that additional call, and I made several more calls since then. I have the picture off the tarp wrapped in my tire and also the nail on the second tire, as well. The company put up a sign about falling debris AFTER I left my house that day, probably to cover themselves since I called them that day about reimbursement, so this should be known in case they lie and say they had a sign up. Even so, the location of the sign was poor...I never would have even seen it when backing up even if they did put it up before this incident. It is absolutely poor business to not even return my call about this incident. But ultimately, I would like them to reimburse me for these nails as they are liable for this situation. We were advised that someone had gotten nails in their tires near a location we were currently working at and as a business were concerned. When we enter a contract with a property owner we do ask that each vehicle is out of the garage and driveway during installation as accidents can happen. We do our best to avoid unnecessary damage to all property during installation by putting down tarps and running magnets to pick up stray nails. Unfortunately, this does not always guarantee that an incident will not occur. When we were notified about this issue it did take us a little bit of time to figure out what was going on as we did not have a contract with the complainant or information regarding that specific address. The property owner we were contracted with is the owner of a duplex and we figured out that this individual was a tenant at the adjoining property. Once all information was gathered and understood by the company we spoke with the complainant and we issued a check to them directly mailed to their residence in the amount of $48 on 11/17/2022 which cleared our bank account on 11/23/2022. We have not heard anything else regarding this issue so we were under the impression this issue had been resolved directly with the complainant.

A formal contract was signed by the owner (***************************) of the company and myself. The contract was for Bayside Roofing to fix the roof area that was allowing it to leak in our 2nd floor ************ ceiling for an agreed upon price of $995. The contract was signed on August 29, 2022. The repair was done on September 13, 2022 by the technician ******. After Hurricane ******************* ******* on September 28, 2022 the leak reappeared. I called Bayside Roofing on September 29, 2022 and informed them the leak reappeared. They sent out a representative to verify the leak reappeared. The Representative said someone would be calling us to schedule someone to fix it. I called at least 9 times and multiple emails since September 29, 2022 and never got a call back. I NEVER got a call back from Bayside Roofing but ******, the technician that original tried to fix it came out unannounced on October 12, 2022 (I think) and checked it out the damaged ceiling and the roof. He said he patched the area that he was told to fix. He did say something about termite p*** was behind the siding but didnt say anything else about it and then left. He didnt attempt to fix the leak. Im wondering if this may be considered *********************** had done 3 other jobs for me in the past 2 to 3 years and I was very satisfied with their work. Roof work was done and the company subbed out an insulation company to come add attic insulation to my crawl space attic. This was NOT done at the same time as the roof work.. A week later the insulator came in and insulated the attic and while his machine was in the attic, pulled our drain line from for the ac condensation back into the house which caused a leak. The AC condensation has been leaking into the house for two weeks which caused water damage to my hardwood floors which now have to be replaced. Ruined my drywall and pain on three rooms and now has mold possible causing an issue. My son is on dialysis and cant afford to have his health compromised any more. Their solution is to call my insurance company and make a claim. NO way. I just paid over 7k for a new roof and insulation and all they can say is spend more money and do a claim.Business response

Business Response /* (1000, 10, 2022/05/24) */ I want to apologize for this unfortunate situation that the homeowners are dealing with. We at Bayside feel horrible about the situation, especially with a sick child in the home, however we are not the party responsible for it. Bayside Roofing obtained a roofing permit from the city of Tampa's building department on December 17, 2021 with work commencing on the property on March 14, 2022 and the final inspection conducted by Bob W. on March 31, 2022 with an approved status and no noted defects or deficiencies. We did send a crew back to the house a week after the roof was completed to install the insulation in the attic, but we never went in the attic. The attic on this home is too small and no machine would fit in the attic so we opened the roof up and installed the insulation from the rooftop. The machine in question is a 1500 lbs. piece of equipment that is bolted to a 14-foot trailer's frame and floor with a three inch diameter hose attachment. On April 17, approximately three weeks after this was completed the owners called me and told me I knocked their AC line loose and caused damage to their home. I sent my supervisor to the home the very next morning to see what exactly happened. When he arrived the AC was fixed by the homeowner and there were no photos taken to show us exactly what happened. We were told that we needed to fix the floors and drywall because they were afraid of mold. Unfortunately this home already had pre-existing mold in multiple areas along with ductwork that needed to be repaired which was told to us by the customer. It is hard to distinguish what the homeowners claim Bayside is responsible for and if those claims are valid so I did not feel it was my sole responsibility to repair the home. Had we been notified sooner (prior to three weeks), had we put a machine in the attic that could have dislodged their AC line, had we seen the problem with our own eyes or at least photos, we could have mitigated some of these issues. With all of that being said, I felt it would be best for the homeowner to call their insurance company. This is the reason we all have insurance and it's no charge to file a claim. I felt this was the fairest solution. I understand the owners frustration but to put sole responsibility on Bayside does not seem realistic. I would love to come to a happy and fair resolution for all parties involved. I have included four attachments which contain multiple pictures each of the roof installation process, the machine in question, follow-up pictures from when my supervisor visited the home, and screenshots of the permit information from the City of Tampa.
