      We had a major house fire in August 2023. We hired **** Davis Restoration in ********, ******* to restore our home. The job was started in February 2024 and was near completion in August 2024, when the restoration specialist for **** Davis asked my wife to sign off on a Certificate of Completion so that **** Davis Restoration could apply for final payment, from the insurance company. He stated that "it takes a long time for them to get paid from insurance" and he would give "his word to complete the Punch List". Shortly thereafter, the restoration specialist told my wife that president of Lakeland **** Davis, was not spending "any more money on this project". The bigger issues on the Punch List are left undone, and our home did not get a construction-cleaning prior to us moving in. To settle this complaint, I am requesting that **** Davis Restoration finishes the Punch List, specifically the bigger items, that their restoration specialist said he would honor: 1) Replace one section of the pool screen that was cut by their roofing contractor to detach and re-attach the pool cage while replacing the roof. My wife was told it was cut so that they could use a ladder to gain a grip on the cage in this process.2) Correct the light switch in the bathroom from a two-way switch to a three-way switch as shown on the blueprints. The electrician installed a two-way switch and combined lights and a vent fan, on the same switch. The other bathrooms were wired correctly, but this one was not.3) Connect the pool light to electricity that the architectural drafter (**** Davis hired) left off the blueprints. They hooked up the pool pump and the pump clock, but not the pool light. All of the wiring is in the same area and is easily accessible. 4) Install the cut glass vanity mirrors for all the bathrooms. **** Davis installed the hardware for the mirrors, but the mirrors remain uninstalled.

      Unfortunately, the homeowner is not current on payments.  No further work is to be completed until they are current on payments.  

      The homeowner was underinsured on their property and several things that they had before were not able to be completed for the monies being paid by the insurance company.  The homeowner admitted they reduced their coverage due to cost.  We provide a detailed estimate of the work to be completed, especially if the insurance is not paying for all the damage (or the homeowner is not paying the balance out of their pocket).  This lets everyone know what will be done.  They may have had some items in the past that would be their responsibility to replace since they were paid the maximum from the insurance company for their policy.  That has been explained to them.   Several of the items they list are being completed once they are current on their payments.  They are considered punch list items and very minor in detail.  I believe the comment about no additional money being spent was in relation to additional items they requested that were not covered in the payment from the insurance company.

      Once the money is received we can proceed with any punch list items needed.

      I am rejecting this response because:
      I do not make payments to **** Davis Restoration.

      **** Davis Restoration was hired through an insurance "Repair Program" that they are a member of--******************. ****************** works with ************* and dispatches the restoration company for restoration and repairs needed in a claim. ************* oversees the work and pays them directly. They report to *************. We have no control over payments because it is through the ************* Repair Program. ************* makes all payments directly to **** Davis Restoration.

      This is an example of the UN-professionalism of **** Davis Restoration, and highlights how they are dodging the completion of the Punch List. If they are not receiving a final payment from ************* there is a reason why, and they need to take that up with *************.

      Meanwhile, they are not honoring the completion of the Punch List that they agreed to do if we signed their Certificate of Completion so they could apply for payment from ***. Obviously if we have to sign off for them to get paid (which we did), we do not pay them.

      ***************** is paying the balance directly.  The punch list is already underway and should be complete this week.
