      We closed on our home on October of 2023. We created a punch list of items that need repair or replacement. As of today none have be completed. We have complained to them numerous times with no responce.

      Good morning,

      We have been waiting on the tiles to comes in, **** our field ******* will be checking  with our sub contractor to see if he has received them. If he has the tiles we will schedule with the Foray on Wednesday the 29th at 9am to complete his repairs with the tile and installing of his microwave aft back splash goes in. I beleive they have a medicine cabinet that they want installedas well.  I apologize for the delay, as these items where not an emerency repair.

      Hello,

      Windemere has responded to them several times over the months, maybe not as quickly as they wanted.  We where out there last week to try to take care of there concerns, and they had to go out of towm, so it was reschedule Tuesday June 4th. ***** our tile sub contractor and **** our filed suoervisor where there to go over what needs to be done.  ***** and ************* decided not to replace the back splash.  As far as I know **** is taking care of all othere concerns.  Thank You  *********************

      Windemere has addressed all of ************* repair request. **** has his window ordered due in this week we where told and his screen had to be re order for a 2nd time as it comes from the manufacturer. **** has spoke to ************* and has explained the isse with the screen.       I submitted a change request to add electrical outlets to the back of the house for the future kitchen. **** paid in full.It is already 11 months since the house was completed, and work on additional electrical outlets for ******************* has not even started. I contacted Windemere Homes almost every other week and got nothing but the promises.Per the signed agreement, please refund the money paid.Please refund $660.00 for not doing electrical work.

      There was a issue with *************** when they went out there to install the outlets, that they would not be the correct outlet that he would need for a kitchen in the future. There for we have refunded his money. He was a very difficult person to schedule appointments with. Since my last conversation with him, he was find with us giving his money back.

      We moved into brand new house built by Windemere in May 2021. By March of 2022, the front concrete sidewalk leading from driveway to front door, sunk to the point it was out of code compliance for tripping hazard. Due to faulty construction. Windemere decided by their means and method, to grind the uneven surface, and texture the entire sidewalk and paint, to match the front door landing. By Sept. of 2022, the sidewalk continued to drop, yet again becoming out of code and an even higher tripping hazard. After over 5 months of excuses and delays, Windemere finally replaced the sidewalk. However, they refuse to pay for texturing or painting to match their original repair. I complained several times in writing and provided Windemere, a copy of the invoice for the texturing. I painted the concrete, and I am not seeking compensation for the paint. Windemere refuses to answer my request for reimbursement for the texture. Windemere repaired the faulty construction by grinding, then texture and paint. But refuses to complete the repair of their failed original repair. If we didn't have faulty construction, Windemere would not have to repair. It was Windmere means and methods as to the repair. The repair failed, and Windemere replaced the concrete. But refused to pay for the texture to match the rest of the sidewalk. I am seeking the cost of the texture. I supplied Windemere a copy of the invoice. $700.00

      There was a crack in the sidewalk so Windemere Homes went out, on our own accord.

      No other company would ever go out and do that. Windemere Homes went above and beyond and we feel that we did our best.

      Once again I feel Windemere replaced the concrete, to satified the customer concerns with the dip in th sidewalk. It was determine that it was not that big  of a dip, but we explained we replaced the sidewalk but he would be responsiable for re texturing and paint. Which has been done. Thank

      We started the contract with the Windemere homes in order for them to build the house. They gave us a list of their lenders we had to go through. The prices were saying 5-10% down and my credit is around 800, so not an issue with the bad credit. Their first lender provided very unfavorable terms of the contract with higher interest rates than the industry and requested 50% down. We did not accept the terms and tried talking with the office manager ****** who would yell over the phone said go to another bank from the list and hung up the phone. The other 2 companies we tried said that with current economic situation they are only able to give $100,000 in loan and we were seeking $250,00-$300,000. The third company (who ****** said she is her good friend) was on vacation for 2 weeks and would not return the calls or send us any estimates. So the time dragged, we tried numerous times to contact Windemere office and they would not return the calls to us, then we would call from another number they would pick up and put us on hold and then hung up. Nightmare dealing with them, we said we do not want to do business with them or any of their mortgage providers and we requested our deposit of $36,000 back. They refused and said we need to get a mortgage or they will not get us $$ back. We obtained our own mortgage company, got the standard rates and everything was ready to proceed when our law firm encountered the *** (lean on the property that was just a lot) we requested the office to remove the lean and she would not respond (and before the business responds and says they had hurricane that email went out weeks before the hurricane and still no one would respond). This will go into the court and we will continue to fight until we get our deposit back. We want BBB to review and help with this complaint and review their A+ rating as you can see there are multiple complaints about the business. thank you

      To Whom It May *************** to the limited amount of characters for this response, we have attached a Letter of explanation.  Please see attached. We went into contract with ************************************* on February 14, 2022.  (Please see attached the contract).  The customer had obtained a prequalification letter from *************************.  Windemere Homes has been trying for months to help the customer.  However, every couple of months, they change their mind about lenders.  We had two increases in pricing and never went up on pricing after they changed to several different lenders.Per the contract, it states the following:Buyers will immediately make an application for a Mortgage Commitment of $328,410.00 to finance this   Agreement. In the event Buyers are not able to obtain a Mortgage Commitment from loan sources acceptable to Builder within 60 days then this transaction shall be voided (at the discretion of the Builder) and, if there is a price increase after the 60 days, the Buyer is responsible for paying for this increase if they wish to move forward and continue trying to obtain the Mortgage Commitment for the new purchase *************** costs to the Buyer explained below. It is the Buyers obligation to track the progress of the construction of the home to lock-in their interest rate and prepare for final settlement.Furthermore, once ************************* was ready to close on the loan, the customer had decided that they were not happy with the rates and began shopping for a new lender, never once informing the builder of these changes, and the contract states.

      We entered into a building contract with Windemere homes inc. on 4/14/2021 with a completion date of 4/29/2022. While we have complied with our commitments and obligations under the building agreement, 80+ days past the completion deadline they have failed to complete the project and are barely half finished with the construction. Instead of providing the service that they committed to, they have provided delays, failed inspections, excuses, failure to answer questions and concerns, and refusal to commit to a future deadline. The original building agreement terms required 20% of the total project cost be paid at the signing with 5 equal subsequent payments upon completion of certain work. We have now expended more than half of the total project cost. At this point we have estimated cost requirements for the final 2 stages will require all of the remaining funds. At the completion of the 3rd stage with 2 stages remaining they will require 1/3 of the remaining funds. If we continue to pay in advance of work completed we jeopardize our funds required to complete the project with no guaranteed work completion on their part. At this point we question if it is even a valid contract for which they require payments. Our failure to pay at the end of phase 3 will result in their stopping work on the project. In light of the builders default, actions and inactions to date we cannot jeopardize the remaining funds committed to the project. We have insisted and continue to require a contract extension with a guaranteed completion date with a penalty imposed for non compliance and a new amended payment schedule requiring work completion before payment. If this cannot be achieved we will be at a stalemate. We may have to pursue a new general contractor for the completion, however there are no funds allocated for compensation for a general contractor. Windemere Homes inc. needs to be held accountable!

It has always been known that the deposit for this home, beginning a CASH deal, there is a twenty percent deposit due at the time of signing. Additionally, at the time of signing the contract, they were told that their balance owed for the home would be broken up into five draws. Again, they were aware of this from the beginning. We began immediately to process the package to start on their permit package. However, we have experienced some delays with this project. The first is, that there was a Gopher Tortoise found on the property. The second building department had several delays which are not under our control. Lastly, when we began construction we incurred many delays due to materials shortages. The construction completion can be delayed for reasons that are beyond the builder's control such as acts of God, adverse weather, theft, or a shortage of labor or materials. Furthermore, we are unable to give an exact completion date as we are waiting for materials to be delivered to the job site. We are constantly told by our suppliers that the materials will be delivered, only to find out that there has been another delay. In addition, we have never asked for any of the monies before the completion of each draw. Lastly, due to the delays and materials shortages, we the builder have to incur price increases from our vendors and have never passed ***** increased prices to our customers. Please be assured that we are trying our best to get this home, as well as others done in a timely manner. They had a 1 year contract completion deadline and are now 96 days past the deadline with no end in sight. There have been numerous delays, failed inspections,excuses and lack of construction advancement. We deeply regret placing our trust and confidence in the company. Although they acknowledged no obligation for their default, they continue to expect the customer's complete compliance with the original agreement terms. We would strongly advise potential customers to use caution and address all potential contract concerns of the builder biased agreement. Don't count on the contract to insure construction completion in a timely manner. When their children's home was built, we did not have these types of issues. In addition, we are building their relative's home as well and they live in Florida. So they are able to see that we are trying to get all these homes done in a timely manner. Windemere Homes is a family-owned business and we care about our customers. We are trying to get everyone's home done as soon as possible. Again, we deeply apologize for the delays and the inconvenience that this has caused the customer.
