This is the demand letter sent to Keith C******. This explains most of what occurred. I did have to buy $803 worth of tile to replace the den tile. My revised demand is $3549. Thank you for our text discussion yesterday evening and for deciding to come and get your things from my property so that we can all move forward and put this behind us. I'm sorry that things did not work out, we were counting on you guys to do this job. Committing to be there working all weekend (in a message to ***), and then not showing up, has created some scheduling issues for us. The small amount of tile work that was done in our den on Friday was not acceptable. You had committed (in a message to ***) to remove the baseboards and install the tile under the baseboards, yet the work done in the den has tiles butting up against the baseboards since the baseboards were not removed. The tile is also significantly uneven in spots. It is not spaced uniformly and some tiles are hollow underneath, lacking mortar. The installation of the tiles in the den has to be done again. Again, so that we can all be done with this: -Please advise me, if known, of the location of all of the tile that I purchased for this job from T & M Floors. -Please schedule a time with me to pick up your work trailer and work tools that were left at my home. Please do not trespass on or enter my lot/land or home at any time. I will attempt to have police there during the return of your property so that there is no dispute about it's return. -In accordance with Florida Statutes, this letter is a written demand that you refund the amount of our deposit that has exceeded the amount of work that you have performed thus far. On 02/19/2022, *** sent you a ***** request for return of $2300 of the $2846.57 deposit that we paid to you on 01/03/2022. Please return that $2300 immediately. Failure to do so could be found as intent to defraud, a violation of Florida Statutes and a felony in the third degree.Business response

Business Response /* (1000, 5, 2022/02/23) */ These accusations are horrendously false attempt to have work done for free. The baseboards were not to be removed and quarter round was to be added to give the appearance of the tile run under look via contract. All tiles were evenly spaced and installed properly. If there were any discrepancies I was not made aware of or allowed to inspect. In regards to the deposit refund request. Work was already at 50% complete which included purchase of thinset and materials (delivered to customer and in their possession) delivery and unloading of all purchased tiles full existing flooring removal and disposal as well as a complete room set and layed. Furthermore, I was held up in my work process due to the customer scheduling their garage epoxy flooring to be done at the same time without notice until day of delivery. Within our contract agreement there are no set day or times of work to be preformed. The only verbal agreement I made was to make my best effort to have completed before interior shutters were to be installed (again told on a few days notice). The customer showed zero regard for my schedule and canceled the work after more than 50% completed and requested a refund. When in fact they're next payment was/is due Consumer Response /* (3000, 7, 2022/02/24) */ (The consumer indicated he/she DID NOT accept the response from the business.) Please view the attachment that I am including with this statement that contains my reasons and some of my evidence for not accepting the response from KC Home Services.
