      I am filing the complaint on behalf of my brother Paul ***** against Indian Motorcycle of Panama City Beach Fl, I have already contacted ******* Inc Corporate office on 9/5/2024 and have not received any response from them. After paying a total of $7,945.04 to Indian of Panama City my brothers motorcycle is still having the original issue they claimed plus must more damage was done to his motorcycle both mechanical and cosmetic damages. The motorcycle is currently back in Indiana with the original Indian dealership that not only sold the motorcycle to him but that has also maintained it. They have supplied an itemized list of the damages done to the motorcycle by Indian of Panama Fl along with an itemized dated course of events leading to me having to contact you on the issue. On May 3, Paul had his motorcycle towed to Panama City Beach Indian Motorcycle while on a vacation trip. I will attach the original itemized work order given by Panama. A total of $6745.04 was paid for this service. June 4, this work was supposedly complete. June 28,2024 Paul returned to the shop to pick up his bike and there was still an oil leak, he waited all day for it to be fixed. The same day he traveled to Jacksonville Fl the Indian dealer there confirmed the motorcycle was still leaking oil. Panama picked up the motorcycle July 2 charged another $1200 never gave a receipt, claiming their computer system was down and did a bank draft for payment. Motorcycle was picked up July 18 took back to Indiana Aug 6 because it is still not working properly. $7945.04 later plus a $800 tow and now damages to fix the motorcycle correctly. Randy ***** and his wife Jennifer ***** of Panama have stopped all communication in regard to this issue. We are requesting a full refund of the $7945.04, a new motorcycle or the shop to pay all repairs of the motorcycle directly to Chris at the Indian shop in Indiana. Adding whatever additional cost.

      I am attaching the Repair Orders as well as a complete explanation from our Certified Master Mechanic, Kyle *****, as to exactly what was done.  This includes the fact that Mr *****'s motorcycle came to us broken and with extensive engine upgrades and miles that make the bike completely void of warranty.  We went above and beyond to try and satisfy Mr *****, including sending a truck and trailer to pick his bike up at the Indian Dealer in Fleming Island Ga along with a free Rental Motorcycle so he could continue his journey. We did this after Fleming Island was too busy too attempt to repair his motorcycle (a repair we would have reimbursed Fleming Island for).

      The repair we did when we got the motorcycle back to Panama City Beach, FL, was due to a faulty part from the factory and then the out of warranty motorcycle had 2 separate issues that had nothing to do with the initial repair.  We did not charge him to fix the initial repair.

      Once repaired, Mr ***** retrieved his motorcycle and headed to Indiana.  We have no idea how many miles Mr ***** has put on his motorcycle since our repairs, but once again, his bike has no warranty.  Initial repairs included issues that the dealership in Indiana had partially repaired incorrectly to begin with.  So, that dealership saying we caused a problem does not carry much weight.

      In conclusion, I am sorry Mr ***** feels the way he does (or the person that filed the complaint for him) but we can not warranty and out of warranty motorcycle that has had multiple issues forever.  The initial problems were caused by a dealer that now says whatever is wrong (i believe it is an oil while the 2nd repairs also were an electrical charging issue and a clutch issue) is our fault.  The customer feels he should get a full refund for both sets of repairs.  We do not feel the same way, and we are truly sorry that Mr ***** is having issues.  We would gladly look at the bike for free if it were in Panama City Beach at the dealership.  Motorcycles, much like just about everything we use, are man made and from time to time have to be repaired.

      I am rejecting this response because: Kyle has taken no responsibility for the issues remaining with my motorcycle nor the balance to get it restored again. This motorcycle has always been served at an Indian motorcycle shop; Kyle's mechanic signed my engine to further incriminate himself. The work was faulty, how dare Kyle try to insinuate in any form that I cause the mechanical and physical damages done to my motorcycle that were not present when the motorcycle was originally delivered to his shop. I have attached some photos of the damage there are many, many more. I need to be refunded the total $7945.04 given to this shop who not only scammed me but caused further damage to my motorcycle.

      How many miles are currently on the motorcycle?  Kyle did not accuse you of anything, but it is possible on your long trip the break in procedure was not followed.  As a rider, I understand how hard that procedure would have been on a long trip.

      I will tell you what I will offer to resolve this complaint.  i. Indian of PCB,  will reimburse $6000 f towards the first RO (10657).That Ro was a total of $6692.09.  The 2nd RO (10907) was  different set of problems that were corrected.  That RO was $1258.99 for a clutch and electrical  issue that was totally separate from the original issue.

      We did not SCAM you out of anything and do not appreciate that accusation as we went the extra mile your own dealership wouldn't help you with (considering the first issues were caused by them), and send a truck/trailer and a no charge rental motorcycle.
