      I signed to finance a 2016 **** Focus, I shouldve trusted my gut when the passenger door handle was missing, the locks didnt work and the seat adjuster had wiring issues. On top of that when the engine turns over youre met with this god awful race car sound, I know enough about cars and it seemed off, but according to **** @carrite/bluelagoon, that was normal as the car has a turbo So I trusted **** and started with the $800 deposit, deducted from a 5 week payment plan to complete that $3k deposit and Segway into the finance payments to start 3.1.24. I paid progressive insurance $360 to start car insurance. I left the car there on 1.12.24 that same day because, well theres no passenger door handle. Rear passengers literally cant enter the car or exit, unless they literally climbed out the window. Lets not forget I have to rush to start the car after manually opening the door with a key, or the alarm will blare. Picked up the car a few weeks later s i was "repaired". Went to gas the car as it was given empty. The car wouldn't start for like 30 minutes and was smoking upon filling it up. I Made my first payment besides my $800 of $440 towards the down payment, although I still have no vehicle to drive. As of now from January 12 2024-February 5th 2024 and counting, I still have no vehicle, no refund, and in my opinion since no owner of this "dealership has yet to communicate with me personally. I assume they are purposely waiting for the 30days warranty to max out so they dont have to assume responsibility. I have not had this vehicle since 1.12.24. Per the owner "We don't do refunds". No owner has spoken or reached out to me. I'm literally hanging on a limb, as the 30 day warranty quickly approaches the end. The resolution is that I need a letter in detail to provide ***************************************** Services INC(Finance), as to why I have no car. I can provide further details for said letter. Also a full refund of $1240.23

      THE CUSTOMER IS UNHAPPY MECHANICALLY WITH THE ***.  WE OFFER A 30 DAY 1000 MILE FULL WARRANTY.  IF THE CUSTOMER IS NOT HAPPY WITH US FIXING THE *** WE ARE WILLING TO OFFER THEM ANOTHER *** TO SWITCH INTO.

      I am rejecting this response because: Im unhappy with the car because you werent able to fix all the issues the car has within 30days and Im still without a car and paying car insurance and financing a car I dont have and is not functioning. I want my money back in full and a letter to provide consumer portfolio, as well as progressive car insurance, to let them know I had limited possession of the 2016 **** focus. I will be filing a complaint with the Department of motor vehicles and have filed a complaint with the attorney general.  I am experiencing financial hardship because I have no car. Your company said nothing was wrong with the car and that is very much false. Clearly youre unable to fix the car, and thats why no one has not reached out to me even once. The owner has not reached out to rectify the matter or just at this point refund me and provide the necessary documentation.

      Also theyve been fixing this vehicle for the second time since 1.29.24. I really need my money back to just go elsewhere with my money.  They are refusing to refund me and they have not held up the warranty at all.  If they had a replacement, they wouldve contacted me via phone call sms or email.  They havent done that at all.  I need a car now and have other options. Them holding on to my money and not giving me this letter is costing me a lot

      we are honoring our warranty we are waiting on a part that was on back order.  we offered the customer to switch out of the car and into another.  she refused.  we should have the car back to the customer this week covered fully under warranty and no expense to her.  we apologize for the delay.

      I am rejecting this response because:
      This is false, because I was told that I was to choose a replacement vehicle, as there was no word on the status on the vehicle.  I refused to chose another care from the lot because, obviously I want the vehicle I signed for, The 2016 **** Focus.  The reason I was in the words of "blue lagoon", unhappy with the mechanics is because, your company promised a working vehicle that was up to standards. For example the bulb that indicates to a driver that there is an engine or transmission concern was tampered with or not replaced or inspected.  ************************* has been blatantly ignoring me as the customer.  If a customer is unsatisfied time and time again.  Correspondence should be done to resolve the matter.  on 3.12.2024 it will be ********************************************************************************  I asked numerous times in person and over text, where is my car.  Or for better words where exactly is the 2016  **** Focus that belongs to Consumer Portfolio Services.  The compliance department wants to know as well.   

      I was told by your companies representative that it was at a **** Dealer, because the issues are beyond the scope of what your mechanic shop can bare.  Yet no one can tell me exactly where my car is.  So now I will have no choice, but to contact help me ******, because who in their right mind is going to sit around from 1.12.2024- and counting to have a car they paid hard earned money for.  I have kids to bring to school a job.  A life which your company just could care less about.  I need to know ASAP!!!!! where The 2016 **** Focus is so I can get the necessary documentation.  Where is the full diagnostics from January, 12th, 2024 until now in March.  I need the documentation(Diagnostics) from your mechanic shop, as well as the **** Dealerships DX, emailed to me at the email address Blue Lagoon has on file for me.  I also need the address and service department for the ****  Dealership I was told it was at when I came up to your location.  I don't like dealing with deceitful businesses or people.  You know you tampered with that car, which would have let all parties know that it has major issues, transmission or engine included.   If and when the car is "ready"  I will take it to get a diagnostics done on it at a **** dealer and if any fault is found, you will be sued.  I've been patient enough, and you got the wrong woman, try someone else.  So ************************* the owner of this "establishment"  needs to speak to me.  Because as far as I'm concerned that contract is NULL and VOID.  You did not hold up your end of the deal, and lied to the finance company CPS and told them Carrite is where I stepped foot in to get the car?  False I went to your Blue Lagoon Dealership.  So Either we resolve this or We can go to court.  Let me know so I can draft ,my demand letter and go from there.

      after consideration we are not willing to give ******************* a refund but we are willing to buy the contract back from the lender so that she doesn't have a repossession reported on her credit.  we will leave her money as a credit at the dealership and she can use that towards another purchase.

      I am rejecting this response because:  I already have another vehicle,  as I was forced to buy one because your dealership failed to provide me the consumer a functional vehicle. If you replaced the bulb that indicates theirs an engine issue, transmission, engine coils. We wouldnt be here. Yes you cant know all that is wrong with a used car, but come on you knew.  You lied and still cant tell consumer portfolio where that vehicle is.  You had no choice but to buy back the vehicle, because ****** is embarrassed and called the police on me because I wanted the loaner he promised me and the finance company. Id like the remainder of the money owed out of the $1,240. I disputed the $440.23 with my bank.  That leaves $800 cash that I paid for a product that wasnt up to standards. So I have a right to revocation of acceptance, these are remedies under the Uniform Commercial Code (UCC).  I already had dealer compliance speak with *** about the check. Im calling them today to get an update as to when that check will make it to CPS.  ** also going to follow up with the ***** regarding the complaint I submitted to the states attorney general.  ************************* is not only very unprofessional, but arrogant.  The only person that had respect was ****, who genuinely cared that I got scammed.
