      Both parties have met onsite with counsel present and have agreed to investigate for any corrective action needed to address the complaints. Corrective action will be taken for any item listed by homeowner that is found to be within the scope of work defined by the contract documents and/or not within documented industry standards.

      I am rejecting this response because: builder has hired an inspector biased by his poor response instead of fixing the real problem. 

      All other issues have not been addressed yet.

      The homeowner is requesting repairs for items that are not part of the scope of work as per the contract, work done by others, or work verified to be in compliance with industry standards. However, NVB has submitted a written offer to repair items included in the homeowner's complaint and has not received a response at this time.

      On October 14, 2022, someone associated with NuVision Builders or a contractor to NuVision Builders dropped something on our driveway pavers and sidewalk that does not come out. The person who did it trespassed onto our property. We contacted NuVision Builders the day of this event and they did claim responsibility for the problem and claimed they would take care of the problem but as of today nothing has been done to fix my pavers. I want my pavers cleaned of the dropping or replaced and the sidewalk cleaned. Attached are pictures of my destroyed pavers and sidewalk.

      Business Response /* (1000, 5, 2022/11/21) */ Complaintant did contact our office regarding the spilled substance on their pavers but we did not claim responsibility. A person from our staff told them we would investigate as best we can. We have investigated and found that the spilled substance is not something we use but continue to investigate. Please understand we cannot be expected to take responsibility for all contractors working in the community. There are other Builders, independent contractors, homeowner contractors, maintenance personnel, and other people working in and throughout the community. The complaintant also has their own contractors working on their property. However, if we are able to find out what it is and how to remove it we will advise the complaintant and help them anyway we can. Consumer Response /* (3000, 7, 2022/11/22) */ (The consumer indicated he/she DID NOT accept the response from the business.) The substance on the pavers in our trespassing zone also dropped onto the road and sidewalks leading up to house **************** which NuVision Builders was building. They were using the sidewalk and our driveway in front of my house to carry buckets with the substance to the dumpster. The dumpster was located at **************** which was another NuVision Built house still under construction next door to my house. All contractors that work for NuVision are agents of NuVision and therefore are the responsibility of NuVision Builders. A police report was made (Incident #**************) the evening that the substance was discovered which was October 14, 2022. The only people that worked the day of discovery or the day before were NuVision personnel or contractors working on pavers at ****************. Most of the time their contractors work without supervisors. Since the time of the incident NuVision Builders never contact us, never investigated, and has done nothing to help us with the spill. All they are trying to do is delay and hope the problem goes away. We have full video and pictures of the dropping that leads from the dumpster at **************** to ****************. Finally, Daryl, the NuVision Construction Supervisor for this subdivision, stated the same day of discovery that the spill leading from the two houses that NuVision was building was from a NuVision contractor. Attached are pictures of the sidewalk and pavers. What is NuVision Builder's evidence that it is not droppings from one of his employees or contractors??? Business Response /* (4000, 9, 2022/12/08) */ After investigating the substance spilled on the pavers and sidewalk it is determined that it is not a material used on any NVB house. It is believed to be a concrete stain material. This is a material used to seal and protect garage floors. It is commonly used by homeowners to seal garage floors. As stated, this material is not used at the houses down the street the complainant mentions. NVB will gladly help the police and or complainant investigate the trespassing incident but have not been approached by police or given anything other than pictures of the spill. It is a common occurrence for random people to dispose of all kinds of things in our jobsite dumpsters.
