I received two automated emails from All County Elite; claiming that I owe them rent for the month of January, 2024even though I provided over a months notice of vacancy before my lease expired on 12/31/2023. They are trying to charge me a month-to-month rate, a fee associated with this rate, as well as withholding $460 of my security deposit without first having mailed a notice of claim to that deposit within 30 days of vacancy. Similar fraudulent charges were posted to my account once before, when I was still within my lease, in December of 2023, as well. I have contacted the property manager multiple times today, with no response, & when I tried to log into my account on their portal, my credentials had been deleted.Business response

Dear BBB,
I am writing this email to provide BBB with additional information and clarification regarding the recent complaint we received online.
Here is a brief explanation of our process and the situation mentioned on the complaint.
1.When we tenant moves out, we start the process of the security claim/return upon receiving the keys from the unit. We require the keys because when a tenant/past tenant returns the keys, they are surrendering possession of the property. The tenant only legally moves out upon returning the keys, it's essentially the effective date of the move out.
In this cause, the tenant returned the keys to us on 01/04/2024 therefore, the security claim process starts on 01/04/2024 and ends on 02/04/2024
2.Upon receiving the keys, we coordinate a date/time with a vendor to meet us at the property to inspect the property and draft an estimate for any damages the tenant may have caused. If there's no real damages to the property, the tenant is still responsible for a professional cleaning and to leave the tenancy/property with a $0 balance. If the tenant still has a balance, we must claim it on their security deposit.
3.Once we've received completed the inspection and received the estimate, we move forward with either returning the security deposit,or initiating a claim. By ******* law, we have 30 days to send out the letter or return the check.
4.We send the mail to the address the tenant lived in, they are required to forward their mail to their new address, or mail it to an address the tenant provides us with. If the tenant DOES NOT provide us with a forwarding address, legally we have to mail it to the last known address.
5.Upon mailing out the security claim letter, we wait to hear back from the tenant. We include a breakdown of the ledger (Shows the balance and what we're claiming). If we do not hear back from the tenant,******* Law allows ** to continue as expected.The tenant was charged a $310 via security claim because he left owing $310.
The tenant was charged a $150 cleaning fee because the property was not professionally cleaned as it is required via his lease.Customer response

I am rejecting this response because:I did not owe $310 for anything when my lease ended. They did not provide evidence of any reason why I would owe this sum, either. I paid the balance towards the last months rent each time the rate increased, so there is no reason why I would owe them $310. As for the apartment not being professionally cleaned; I left the building in a cleaner condition than when I moved in. I can provide photos of this. When I moved in there was algae buildup in the grout, & mold on the toilet seat.

Dear BBB,
Unfortunately, the tenant left owing $310 in unpaid rent and according to our lease we can charge a minimum of $85 in cleaning fees, or the total amount charged by the cleaners.
My hands are tied in regards to claiming the unpaid rent and the cleaning charge. I am required to perform my fiduciary duties to my client(s), unless written permission is stated otherwise from my client(s).I understand the tenants possible frustrations if they did not understand parts of their lease, obligations or responsibilities. However, my client(s) and All County Elite Property Management cannot be held liable for this. It's incumbent upon the tenant to perform their due diligence in order to understand the contract they are signing.
A check with the remaining balance (after the claims) was sent out to the tenant, as per my previous message.
I hope this further clarifies any and all questions or concerns.

You have failed to provide any evidence that I left owing $310. I do not owe you any money. I paid my rent on time every month and paid all deposits in full. You can keep the cleaning fee, but you will not scam me out of $310. Send the check to my address and lets put this to bed.
