      Dear BBB, unit #**** (semi truck) was dropped in ************************* for repairs to be done to unit on 11/25/2023 Gate was closed. There at that address it is rented by several companies including ******************* who he owns a mechanic shop there. All businesses there I personally have seen like four other trucking companies there and all use the same gate to access. Access was given by a person and ************************* driver of unit #**** parked inside of gated lot and left. Given a ride by ********************* another company driver since unit #**** was going to be there to get some details worked on unit and driver was going on his break. Israel was given a ride to our office to drop keys in mail box.11/27/2023 I asked ******************* shop owner if the unit # **** was already going to be worked or if he had an update on repairs to semi truck. Thing that he said the unit was not there. I sent him GPS coordinates and unit marks being there at his lot. In confusion **** went around the whole lot, around the whole block and unit was not there. I emailed Monarch Tracking my gps service provider and requested to locate unit since on my end it was showing at **************. Later Monarch support explains gps system had been disconnected because it was not showing signs of power or current. 11/29/2023 I went to ************************ and made a police report there with officer in lobby.01/03/2024 I receive an email stating Declination of coverage 01/25/2024 ******* never answered my emails or calls and finally her supervisor *********************** answered and stated my claim was submitted for consideration.03/20/2024 I get a call from ******* the adjuster letting me know the claim has again been denied due to the fact that they don't know who gave driver access to the driver to go into the lot and park. I have been going with ******************* to get my units fixed before and he would tells us to either park trucks or trailers inside the lot of if closed outside. At first Israel the driver told me he was going to leave outside since gate was closed but later when I spoke with him to give me a statement and ****** the driver who picked him up. They both stated that he parked unit inside. I have provided ******* and ****** the proof of email requesting Monarch help locating unit via gps, both drivers statements, police report stating unit being stolen from **************************** I feel they have been looking for excuses not to pay for my claim with all the proof in a bad faith.

      I was involved in an accident on September 7, 2023 at no fault of my own. Im a small business owner operator. My truck was totaled but not my trailer. I was without work for three months waiting on the settlement with this adjuster. I finally was issued a check on December 6 2023 and told to go pick up my trailer however, part of the load is on the trailer and the tow yard said the insurance company has not instructed him what to do with the load. The trailer could not be moved. The tow yard is charging $150 a day for storage and the trailer is still unmovable. You cannot get the adjuster on the phone and his mailbox is always full. This business is a joke, a sham. I am out a $30,000 trailer and cant get any help.

      We are the third-party administrator assignerd to investigate claims on behalf of the insurance company who issued the policy of insurance. We do not authorize coverage. We are not involved in underwriting decisions. We conduct investigations on behalf of the insurance company for review.

      In the subject case, we confirmed with the tow company owner, the trailer was not damaged. He stated some lumber fell off the trailer and he restacked it on to the trailer. He stated anyone could pick-up the trailer with the load of lumber any time. However, the owner of the company failed to move the trailer from the tow yard and abandoned the trailer and the cargo.

       Under the provisions of the policy, the insured cannot abandon the cargo to the insurance company.

      As stated above, the trailer was not damaged and there was no damage to the cargo. The trucking company is responsible for mitigating their damages; and this would include picking up the cargo and delivering it to the destination or returning it to the shipper. Therefore, the complaint is not justified.

      This insurance provider denied a cargo claim several times due to different reasons, each time we debunked the reasoning and then they would have a new excuse as to why the claim is being denied. Finally they stopped responding to calls, voicemails and and emails.

      We are a third-party administrator assigned to investigate the claims on behalf of Underwriters. We are not the insurance company and we do not issue any insurance policies. We are not involved in underwriting decisions or underwriting issues. We do not issue endorsements or amendments to the policy. We do not collect premium. 

      The complainant, ***** Transportation is not an insured under the insurance policy. ***** Transporation does not any standing to file any claims under the policy issued by Underwriters; and ***** do not have any rights under the policy issued to the motor carrier, Derek ************************ is our understanding, coverage was denied based on the fact, the insured motor carrier failed to give notice of any claim to Underwriters. Further, the insured failed to cooperate and provide any information or documentation related to the claim to support coverage for any covered loss. To the extent, there was any potential for coverage, the alleged loss or damages were the result of the shipper's improper loading or improper securement and the motor carrier would not be legally liable.
