11/22/22 ******* Tree Removal was hired to remove five trees. In the process the owner, ***********************, knocked down the conduit pole, the electric eye built, and siding. His **********************, remounted the conduit pole and the electric eye built. The owner did not return with to oversee this project. 12/12/22 upon return to replace the siding that was torn down off the house when ***** came to discount the electric they stated the electric eye built was not stably secured. I also stated to the ******* I felt that the brackets were not properly secure. The ******* showed me that the eye built had broken along with the fastener when it was torn down the first time and they had placed a nut on it due to not having a fastener, which is what should have been placed on the electric eye built. I purchased a fastener for them that was not placed on the electric eye built only the nut again because they could not file down the broken edge to get the fastener on. Due to being mounted improper on 12/23/22 the conduit pole and the electric eye built can down again. That evening I reached out to owner, no response. I reached out to the ******* he stated they would take care of this. On 12/26/22 spoke with the owner for his assistance he wanted to claim no responsibility. This house was built in **** and the conduit pole nor electric eye built had fallen down prior to him knocking it off the house with a limb. After having no electric on 12/29/22 I hired *****'s Electric to remount everything at the cost of $650. am seeking reimbursement of $650.Business response

On 11/22/2022 my business, ******* Tree & Limb Removal, LLC was hired by La'********************* to remove five trees from her yard. We ended up taking down six trees, the sixth one at no cost. In the process of cutting a pine tree limb out by the power pole, over the power line the tip of the limb swung down and hit the power line which in turn knocked the power line from the side of the house. When this happened the anchor to the power line pulled out of the house causing the conduit pole to come down also. This pole was only attached to the vinyl siding by 4 tiny wood screws. When this happened I took pictures of where the anchor point was in the house and then I showed the customer the pictures of where the anchor point was not anchored properly into the wood but only into the vinyl siding. I then proceeded to take the customer up into my lift and showed her where the anchor point was not properly anchored to begin with. She then began to tell me about a contractor that she had hired to move the meter box, conduit pole and anchor eyelet. In her complaint she stated that the house was built in **** and that the conduit pole and electric eye had never fallen before but she failed to mention about this contractor that she had hired having had moved it previously. I have pictures showing where it was moved. You can plainly see the outlines of where the meter box and conduit **** had previously been. After showing the customer that this had not been anchored properly to her house she agreed with me and asked me if I thought that she should "go after' the contractor that had moved the box and conduit pole because she agreed that it had not been anchored properly. She gave me the phone number of this contractor and I called him to come out to look at it. He was finishing up a job and he said he would be on his way. After waiting for approximately 2 hours the customer called him to see where he was. The contractor stated that it would be another 2 hours before he could get there. It made her mad that he was not on his way yet and the customer decided to tell him not to come. The customer then stated that if we could just get her power back up that she was not concerned with the piece of vinyl siding that had come down when the power company pulled the power wire down that was hanging over a phone wire. I have 4 employees that witnessed her stating this and she even said "y'all can be witnesses and hear me say that". I told the customer that I would get it back up to the best of my ability and she agreed with that. She then called the power company to see if a permit was required in order for me to do that. They stated that no permit was required but that they would have to inspect/test it to make sure it was held strong enough when they came out to reattach the power line to the anchor point. Even though it was the power company that pulled the vinyl siding down the customer insisted that I replace the siding. I went to multiple places searching for the vinyl siding to match her house. We returned to replace the vinyl siding and fix the conduit pole on 12/12/2022. When we arrived the customer stated that she was leaving and we would have to return at a later date. Two of my employees returned on 12/23/2022 and put everything back in place. ***************** then had to come out to inspect/test the anchor point before they would put the power lines back up. This passed their inspection and they then reinstalled the power line. The customer was satisfied and called and paid the $1000 over the phone that she owed for the tree removal that we had completed on 11/22/2022. The customer called on 12/26/2022 and stated that on 12/23/2022 the conduit pole and electric eye had come down again. What the customer failed to mentioned in her complaint was that on that day/night there was an arctic blast that had wind gusts of 30 - 40 mph. The last time that I spoke to the customer on 12/26/2022 I tried to have a reasonable conversation with her and she became aggitated and proceeded to hang up on me. I do not feel that I am liable or responsible for the $650 that the customer states she paid to have this replaced again. I did what the customer asked me to do and she was happy with it and paid for my services. If it had been put up incorrectly by me the power company would not have signed off on it during inspection when they reattached the power line. But they did sign off on it and reattach the line.

I am rejecting this response because: the owner tore down the power line that had never been knocked down until the owner knocked it down cutti g down a tree with a limb. If it was properly secured it would not have come back down in less than 30 days. The electric company could not see inside the walls and see that his workmen did not put the fastener up that they stated that they used and a too short eye bolt. The photos show that they used a too short bolt with no fastners. Photos also show that the c clamps weren't secure as well as placing the screws in the holes he damage. I am not an electrician to know whether or not the job was done properly. He only did it in a manner to say the electric was on. I put must trust in ***** to correct the issue properly not just to suffice to collect the payment.

I am rejecting ************** response because as I stated before in my previous response, the original contractor that moved the box did not secure it to the house. This is why it fell. While with ************** I called her contractor and had him on the way out to properly fix what he did not do originally and she called and cancelled him coming out. My employees put everything back the way it was the best they could because there was no proper anchor point. ************** stated that the power company informed her that when they came out to reinstall the power line that they would have to inspect the anchor point and everything before they would install the power lines. They did this and put the lines back up. If it had not passed their inspection they would not have installed the power line. But they did. The night that it all fell again there was an artic cold front with 30 - 40 mph winds. The contractor that originally moved the meter box and conduit incorrectly is who ************** needs to be filing a complaint against. And she stated to me that that is what she was going to do. I have attached pictures showing there was no proper anchor point. Note: The picture showing the anchor point shows the 2 x 4 that was supposed to be anchored to they drilled through the very end of the 2 x 4 and there were no nails in the 2 x 4 where the anchor point was. I have also attached pictures of the side of the house where it shows that the meter box and pole had been previously moved. I am standing firm in my response that I should not be held responsible for something that was incorrectly installed by someone else.Thank you,***********************;******* Tree & Limb Removal, LLC
