      There is an underground water leak and other situations that the *** has committed to provide yet, they do not. I and another resident have reached out several times to no avail to get this problem resolved. Nevermind the fact that this once beautiful community with a pool, tennis court and clubhouse cannot be used...I wouldn't let my dog take part in these so called amenities...It's a joke!!! It looks horrible! What is happening with the $215 they collect every month, because I, as a resident, cannot see it! My sliding glass door needs work! There are also too many squatters on the premises, it doesn't feel safe at all! There are issues with MOLD! The community could use a fresh coat of paint!!! It looks horrible! They fail to respond to our complaints with these issues and we are SICK Of IT!!!!

      First, I would like to say that I appreciate the opportunity to respond to this complaint.

      As soon this came across my desk, I set aside all other business in order to give this the undivided attention and seriousness it deserves.

      I could easily submit a multiple page response, but I will spare the long historical aspect as to the challenges we are all faced with regard to *******************************.

      But clearly we do not take any pleasure in not being able to take care of maintenance issues in a timely manner.  For the record, it is not willful neglect.

      Since the time American Dream Keepers was brought on to assist the ***** in the management of the association, we were and have continually been meet with a financial deficit from year-to-year. 
      Currently, out of 83 units, 32 of them have tenants as occupants.  This equates to over 1/3 of the units being used as an investment property whereby the owners live off-site.

      To add to this, we have an ongoing delinquency problem that gets larger each year.

      The only source of income for the ******************************* is in the form of membership dues.  When dues are not paid, in severely inhibits the association's ability to meet its financial obligations and fulfill its duty of maintaining the common areas and common elements for the safety and enjoyment of the owners and their guests.

      This is and has been the crux of the challenges the ***** of ********* and management company has faced on a daily basis, an ongoing list of maintenance issues that need to be addressed, but the financial resources not being there to meet those needs.

      The frustration is truly felt when unit owners call and feel as though their issues are being ignored.  But that is the furthest thing from the truth.  I cannot think of any rational person that would intentionally want to make unit owners irate by refusing to address maintenance issues if the financial resources were readily available.

      While we could easily hire vendors and contractors to resolve a host of maintenance issues that are currently known about, the problem is that the association has to be able to pay for the services as they are rendered.  Having work done knowing there are no funds to pay the contractor for said service is simply not a good business practice and would bring about liability and risk for the association.

      As we have been doing, we will continue to take targeted action to entice and induce delinquent owners to fulfill their financial obligations to Tiburon.  But until then, we can only work our way through maintenance issues as financial resources are available. 

      Thank you again for the opportunity to respond to this complaint, which we take very seriously.  I know this will most likely not give the complainant immediate comfort, but we hear you and all efforts will be made to see if there is a plumbing contractor will extend more time than usual for the invoice for the work to be paid.
