Back in January 2024 I discussed settling my account with this company. I was provided all the information needed via text to qualify as a settlement agreement. Since then I have reached out multiple times for information regarding the settlement agreement as well as making payments towards fulfilling the settlement agreement. I have not received any response to any of my messages. Due to my work, I have informed this company that I cannot receive phone calls during my workdays and requested to communicate via email or text (both of which they have previously done) so I dont understand why they dont respond other than because they want to breach the terms of the settlement agreement as violate the ***** which they have. I, again, am requesting for email correspondence in response to the email I sent on 4/1/24 which I havent gotten a response to as well as the finalized statement showing that the account is settled and closed. Im hoping to resolve this issue without having to escalate to taking legal action against the company.Business response

NCD Financial's Agents have limited ability to send emails to Customers. We received this customer's email but there were many issues to discuss, such as did he want to settle for a reduced payment, which is notated in a different way from paying full balance. Please note that NCD Financial does not charge late fees or interest, so his balance never increased during the period he was not making any payments. To resolve this issue, NCD Financial accepted the amount the customer paid online and will report his account as Closed and Settled.

This individual made an Application Online 2/7/24 when we were CLOSED. It was the customer who set up a $19.99 payment which was fully refunded once we received notice that the customer wished to Cancel his account and receive a refund during working hours 2/8/24. All customers are accepted as part of our no hard credit check program, so NCD Financial sees no reason why this individual felt the need to file this complaint.Customer response

I received an email from NCD Financial after I inquired about my $99.99 refund: Our records show that the Refunds did not clear your bank. Do you have a block on your card or is the card you used no longer valid? The refunds were processed 3/5 but did not clear.I just got off the phone with the bank representatives regarding the debit card I used. They informed me that nothing was received to not clear and that there was no refund issued back to my account. They advised me to speak with the retailer. I am bringing a grievance against this business. My cancellation number is **********.Business response

NCD Financials Customer Advocate made a three way call with this customer and his bank, where it was determined that the bank was the source of the error regarding the refund not clearing.
The customer stated that he would change his complaint to remove NCD Financial.

I received my credit report in August of 2022 and noticed an outstanding balance of $96 for an account that should have paid with a zero balance. The late charges began in March, 2021 -Sept. 2022. I contacted NCD Financial and they refused to correct the error I paid the $96 in August/2022 even though I didn't owe it . NCD has refused to correct the errors on my credit report and I am being told there is nothing they can do . Their one mistake resulted late payments being reported March 2021 til September 2022 . I have been excellent paying and loyal customer and I need my account fixed . It is negatively impacting my credit score and I am trying to purchase a home . I understand businesses may make mistakes , but being unwilling to correct your error is unacceptable. They've made multiple errors on my account in past and I don't understand why they're refusing to correct their mistakes. I have tried to rectify the matter with NCD Financial and my attempts were unsuccessful. All of the late payments from March 2021-Sept. 2022 should be deleted from my credit report. I'm not worried about the $96 credit I'm owed from NCD Financial. My priority is getting the negative items off my credit report .Business response

We greatly value the loyalty of this customer and are disappointed that she felt like her issue could not be revolved beforehand. For the record, NCD Financial sends text reminders for upcoming payments so customers can make changes if needed, and we send texts and emails when a payment is returned with a link to resubmit. It also acts as a way to alert a customer if he or she believes there is a zero balance and a payment upcoming or returned.
Per the Fair Credit Reporting Act, particularly the Furnisher Rule, at 16 C.F.R. 660, NCD Financial must report accurately. This customer still has a balance from products ordered after the period in this complaint. There were several gaps in payments that cleared from 11/2/2020 to 4/23/2021 and again from 5/5/21 to 8/4/2022. When the customer threatened a previous complaint, we asked her to submit a Credit Dispute Verification to allow us to update the balance on the account prior to our next report. This account is being reported as Current for a period exceeding 12 months. We have sent the customer details of all transactions, and believe that this represents an amicable resolution.

To Whom It May ********* recently received a copy of my (Experian) credit report, and I noticed some late payments posted on my credit report:NCD FINANCIAL LLC (Acc#******)May 2023, June 2023, July 2023, Your company is in clear violation of the law. Under 15 USC ****b - permissible purpose of consumer reports, THE *** CLEARLY STATES:(b) IN GENERAL Subject to subsection (c) any consumer reporting agency may furnish a consumer report under the following circumstances and no other:(2) In accordance with the written instructions of the consumer to whom it relates. Did I give you written instructions to ************ on my credit report?Furthermore, the FAIR CREDIT REPORTING ACT 15 USC ****(2)(a)(i) Exclusions from a consumer credit report clearly states:(2) EXCLUSIONS.Except as provided in paragraph (3), the term consumer report does not include (A) Subject to section ****s-3 of this title, any(i) report containing information solely as to transactions or experiences between the consumer and the person making the report;Delete the above late payments from my consumer report, this agency is in violation of 15 USC ****.Failure to respond satisfactorily with deletion of the above referenced account, and send out a free copy of my report after the changes have been made will result in legal actions being taken against your company, for which I will also be seeking $ ***** per violation for:1. This company ask you for 35% down on a product. Then they want you to provide them with a copy of your SSI card, W-9 and a copy of you Driver's license. If choose not to provide these document after 30-days, you can not get your money back. They want to give a store credit as if you want to continue doin business with them. With all of the Identity theft that is going, why would I want to give them these document. all I want is my down payment of $330 sent to meCustomer response

This company had reported a 30 day late payment to my experian report. The company alleges that i didnt pay my bill due in sept 16,2023. I didnt pay my bill that day but i paid it on october 9. THATS NOT 30 days late, so ncd had no reason to report inaccurate information. When you provide information to a CRA, you have obligations under the **** to ensure the accuracy of the information you furnish. As a rule, its illegal to report information that you know or believe is inaccurate. You have "reasonable cause to believe" that information is inaccurate if you have knowledge, other than allegations from the consumer, that would lead a reasonable person to doubt the accuracy of the information. **** Section 623(a)(1)(A) .. I HAVE ALL MY BANK TRANSACTION TO PROVE I PAID MY SEPT 16 bill on Oct 9. Please REMOVE THAT NEGATIVE REMARK OFF MY CREDIT REPORTBusiness response

I paid for my item years ago and have not shopped with this company since. They are currently reporting fraudulent charges on my credit report as late. I have made several attempts to call and cancel/close this account. But the phone numbers dont work and emails are unanswered. NCD Financial was pleased to be able to have had this customer's report corrected. ********************** wishes the customer had contacted us as we have no record of calls or emails and our phone numbers are all still working. While we understand that customers may use the BBB to try and influence an outcome, NCD was not the source of this reporting error. I have never heard of this company until today when I woke up with a $359.99 charge on my debit card that I didn't make. I tried calling their number, they direct you to a website to login for answers. I don't have an account to log into. How does this happen!?!?Customer response

The company promptly contacted me Monday morning and verified that I did not have an account with them. They voided the transaction and the money was put back in my account today. This customer does have an Account with ********************** that was reported accurately. The customer opened the account in June of 2020 and validated his identity via our online Questionnaire that utilizes public records specific to the individual. The customer financed cologne which was delivered. The email address the customer provided with his complaint is the same email address where NCD Financial has sent all correspondences.
