      - 16 Apr 24 Capitol ********************************************* sent estimator to provide garage footings and slab quote - 19 Apr 24, agreed to foundation/footing/slab work as outlined in attached contract. Paid $8000.00 to begin work. Workers dug hole and placed forms for footings only work accomplished to date.- 10 Jul 24, work inspected and passed by a Spokane Building Inspector. Per Capitol Concrete and Asphalt's employee's instruction, we asked inspector about a stem wall requirement. He stated it was not required but we could go either way and still be in compliance.- 17 Jul 24 Capitol sent estimator out again to reassess the work already completed. They quoted us an additional $10K more than original quote for a 4' stem wall. We stated we did not need a 4' stem wall but a 2' stem wall if we elected to go that route. Their quote did not change from the $10K and their owner, *************************, told my wife and I they already completed more work than agreed upon. We informed **************** we would not pay the additional $10K at which time he became extremely perturbed and elected to state outlandish comments such as, "You were suppose to do all of the work because you enjoy it," and "We didn't even plan to dig," even though he sent his folks out with an excavator. - 17 Jul 2024 we contacted **************** to ask he complete the work as outlined in the contract. He informed us that he would be able to complete the 57 linear feet of concrete the following week and would contact us to schedule. He did not contact us.- 22 Jul 24, we called ****************. He told us he needed to rebid the contract. We informed **************** it appeared he did not intend to complete the project. He then sent us several texts, one stating he wasn't changing the original quote, he just needed to rebid the project and another stating he would refund us $4K of the original $8K that we paid him. - 23 Jul 24, we informed **************** we would accept his refund for work not completed.- 1 Aug 24, we have not received a refund.

      He wanted to put a footing on top of the ground illegally, to match the other footing that was installed illegally. So we dig down 2' in the ground to install it properly,  formed up the footing according to code, and then waited 3 months to pull a permit. Then we came out to rebid the job, and that's when we couldn't come to an agreement. I owe him ***** out of the ***** that he paid me for the work we already performed. 

      This will be paid as soon as we get enough money to pay him back. We don't have the money right now.

      I am rejecting this response because they provide no evidence they simply state "illegal" to try and deflect attention and not accept accountability. Look at the facts: 1) we have a signed contract to perform work (if work was accomplished "illegally" and they performed more work, then they are in turn performing illegal work and should lose their Washington State and Idaho contractor's licenses). 2) They admit they did not complete the work they agreed to under the signed/agreed upon contract and have yet to complete the work or refund us the money. 3) They state they don't have the resources yet the company emailed us again (see attached) and stated they would refund us last week. Another round of false statements and promises as they failed to follow through. Simply put, if they are stating everything was done illegally, then they are culpable as the contractor for performing illegal work, and they also admit they have yet to refund us our money, which is also admittance the issue has yet to be resolved.
