On November 3, 2021 I had a contractor from Safeguard Roofing come to my house and assisted me with my insurance claim for my roof. After that interaction I did not hear from anyone from the company Safeguard until May 3 of 2022 via text. The employee was going on vacation and said they would call me back after he returned. On June 1, 2022 I called the office of Safeguard and talk to a lady name *************************** and asked her if she could look up my contract for me. She then stated that she cannot find a contract and that I did not have a contract with Safeguard. I said OK and that I was going to use a different company because it took over six months for someone to contact me and I was going to use a different company to finish my roofing project. On June 27, 2022 I get a letter in the mail with big and embarrassing red letters that say PAST DUE! Saying I owe them 15% of the total job for work they never did. $1947.97. They are trying to tell me that their consultation paperwork is a legal contract when it does not dictate correct verbiage from the state of ******** attorney generals Consumers rights. They also never presented a project price, product selection, or a scope of work for the project. I tried calling the main office, I have left voicemails and I have never heard back from anyone from that office until I got another bill in the mail saying past due again in July 2022. I then reached out via email stating the facts and concerns about their contract and the misinformation and verbiage on their paperwork. As soon as I sent the email I got a notice from a collection agency stating that they sent my bill to collections. I believe this to be unfair and fraudulent behaviors by this company. I would like for Safeguard to drop the collection charge and we both go our separate ways. They did not work on this project and I should not have to pay them. I really could use any help that I can get on this matter and to make sure that this does not happen again.Business response

Contract was signed by Homeowner on 11/3/21; Contract is valid - due to nature of business, price is determined by insurance company and is stated as such on Contract
As Contract states: Work will start approximately **** weeks (weather permitting) after insurance claim is approved and after colors have been selected
Homeowner was told we would be doing his roof in Spring 2022 (cant roof in winter)
Sales rep was in contact with Homeowner in March and multiple times in May 2022 via site visits, phone calls and text messages
Sales Rep texted Homeowner on 6/1 to set up appt to go over roof colors, response from Homeowner same day was that he received an offer to work for a company that does roofing, siding and windows and he would be getting his work done thru them. Stated at this time, I will not move forward with your company. Sales Rep let Homeowner know that that there may be liquidated damages
Per Contract: "If Homeowner cancels agreement after ins provider has approved coverage for the work later than 3 business dayTherefore, HO will pay Safeguard as liquidated damages the lesser of $3000.00 or 15% of the total contract price for contracts less than $25,000."
His claim is $12,750.00. 15% of that is $1,912.50.

This matter has not been resolved . The safeguard company has continued to contact my insurance company and tried informing USAA that I am doing the work my self. - Per text to Sales Rep (attached), ********* was going to work for a roofing company and said that he would get the work done with them
- Per Sales **** ********* stated that he would be doing the work himself
- *********************** knew a Contract existed between the ********* and Safeguard Construction, it is standard protocol to inform the insurance company that we are no longer involved with the claim. This was done via email.
- ********* was sent an automated notice via email & text that provided a 2 week grace ****** in which to dispute the debt prior to the debt being recorded on the *********s Credit Report
- ********* did not respond within allotted timeframe and debt was forwarded to ************* from that point on, we have had no dialogue with ********* nor has anyone attempted to contact ********* for any reason
We have many more text messages to provide, however the system limits how many attachments we can include. If necessary, we can provide all correspondence by other means.
