I am trying to obtain copies submitted for our 3rd quarter inventories and borrowing bases for the period ending 9/30/2020 from FCS Financial. My husband and I were separated at the time but I was still fully active in the business. This paperwork was requested every quarter for our revolving line of credit for the cattle. On 10/5/2020 I emailed *********************** at the *********** office and requested copies of the borrowing bases and inventory sheets. I was an owner of the cattle at this time and listed on the loans. On 10/5/2020 she replied that she would send me the copies when she received them. On October 19, 2020, our divorce became final. On 11/10/20 I requested the copies from *******************************, our loan officer. He told me since I had been removed from the loans on October 28, he could not give me these copies. On 1/21/21 I emailed both *** and **** again stating I was an owner of the cattle and listed on the loans at the time I requested and was told at that time I could get the copies. They again refused. On 3/1/21 I emailed the executive VP ******************* requesting the copies. He refused my request stating I was no longer an owner of the cattle. On 3/15/21 I emailed *******************, Chief Counsel, and ***********************, CEO, requesting the paperwork, stating I was an owner of the cattle at that time and when I requested the copies, and told them their inability to provide the copies in a timely manner is not sufficient grounds to withhold the records from me. ******************* replied that I was not on the loans when the paperwork was received. He stated Federal regulation 12CFR 618, Subpart G. I have read Subpart G and would like to note this: 618:8325 Disclosure of Loan Documents (b).....Subsequently, upon written request of a borrower or a borrower's legal rep, a qualified lender shall provide, AS SOON AS PRACTICABLE, a copy of any loan documents...... According to this, I should have been given the copies when they were received after my written request.Business response

We did not receive the previous letter referenced by BBB. As we have explained to ************** on multiple occasions, any confidential information that *** have been provided to FCS by a business entity AFTER ************** was no longer associated with the entity is prohibited from disclosure to her by federal regulations absent the entity's written consent or order of a court of competent jurisdiction. The appropriate forum for adjudication of disputes between ************** and her ex-husband is the court with jurisdiction over the divorce.

I am rejecting this response because:I have contacted two attorneys in this matter. FCS Financial has ignored all letters sent regarding this. I had requested the information while I was still a client at FCS Financial and was told I could receive the information. Now they have refused. I have attached the email stating this and also the letter from the attorney sent most recently.
