      THIS BUSINESS IS HOLDING MY SECOND CHECK FOR $ ******* FOR PAINTING THE EXTERIOR . THEY WANTED THIS MONEY FOR FIXING THE DAMAGES CAUSED BY THEM DURING ROOFING. THEY AGREED DO COMPLETE THE ROOFING FOR THE AMOUNT OF $20170.33. AND WILL GIVE ME THE SECOND INSTALLMENT 0F $ ******* TO COMPLETE THE PAINT JOB OUTSIDE SINCE THEY DONT DO PAINT WORK OR THEY CAN DO THE COMPLETE GUTTERS AND SPOUTS. MY INSURANCE TOLD ME THAT IT IS THEIR LIABILITY TO FIX THE DAMAGES CAUSED BY THEM. THE COMPANY DID NOT EVEN FIX SOME OF THE DAMAGES CAUSED BY THEM. ON 12/14 THEY SENT ME A LETTER THREATENING ME THAT THEY WILL PLACE A LIEN ON MY PROPERTY FOR $1666.64 WITHOUT GIVING ME MY SECOND CHECK. CLAIM #*******-231435, PROGRESSIVE INSURANCE, CLAIM ON 6/16/23, INSPECTION ON 6,21/2023 ,APPROVED ON 6,23/2023.JOB COMPLETED ON 07/01/2023

      To Whom it may concern.  ****************** signed a contract with A&D Home Improvement to complete the work at his home which was approved by his insurance company. I have attached the contract he has signed. The scope of work called for reroofing his home and repainting his of his ceiling in the living room. The scope of work which ****************** has attached himself to this complaint does not call for any exterior painting. Yes A&D during the installation of his roof has caused some minor damage to his ceiling, however A&D hired a contractor to repair the damage and paint Mr. ******** living room which was included in the insurance scope of work. Therefore all work from the scope of work was completed and the final check from Mr. ******** insurance company was mailed to A&D's office.  ***************** has refused to endorse the check therefore an intent of lien was sent to him. Again A&D home improvement strives to keep their customers happy, However ****************** owes A&D a final payment for our work and we will reserve our right for legal action.

      We are rejecting Mr ******** response because his statements are not factual. 

      1.Yes in order to cover his $1000 deductible the following items were not replaced. 

      26lf of gutter/downspout.-$400.17

      Flue cap -$192.38

      Chimney Chase Cover -$568.08

      Power attic vent cover -$192.38

      total $1353.01.

      Mr ******** Entire skylight was replaced including new skylight cladding and roof window step flashing at a cost of $950 minus $193.53 roof window step flashing kit and minus $230.23 skylight cladding which was covered by his insurance. This leaves a balance of $526.24 for the skylight. Since ***************** had a $1000 deductible and work not performed equals $1353.01 the $353.01 would then be substracted from the balance remaining on the skylight. This still leaves a balance on the skylight of $173.23. A&D waved this cost for ******************. ***************** Keeps mentioning paint work outside which I would respectfully ask him to point out in his scope of work, as I do not see it. We are not disputing that while working on the roof, the roofer caused damage to th ceiling of Mr. ******** family roof. However this room was already covered to be patched and painted in the insurance scope of work. which in the end was done and fixed. Our final invoice was sent to Mr. ******** insurance company and a final check was issued to us. ***************** was not expected to pay anything out of pocket. What ****************** fails to understand that any payments issued by his insurance company are for work performed at his house, It is illegal for ****************** to try to keep any proceeds from a claim. Since we cant come to an understanding on this issue with the homeowner our next step as any other companys is to place a lien on an unpaid balance.

      Even though Mr. ******** response is not truthful we are under impression that we will not come to an
      understanding on this matter. A & D Home Improvement has been in business for over 15 years with thousands of
      satisfied clients. Our priority is to grow our business and serve customers with reliability, integrity, and quality work.
      We decided not to move forward with this claim, therefore,we will send back the check in the amount of $ ********.

      I can accept the check and give back $200 to the Business as we agreed for the extra paint work they have performed,but before that the business has to fix the damages caused to my ceiling lights during their work.

      To Whom It May ************** are rejecting Mr. ******** response. A & D Home Improvement did not damage the ceiling lights during
      installation process. ***************** signed a contract in the total amount of $22,761.00 (see contract attached). As of
      today we received one payment of $20,170.00 In our opinion Mr. ******** actions are unreasonable. We would like
      to  send back the check in the amount of $ ******** (final draw that was issued by his insurance company) and close
      his file. ****************** does not need to pay us the $200.00 that he mentioned in his response. Please note that this is
      our final response and if needed we will move ahead with filing a lien. Again, we are kindly asking for the complaint

      I am rejecting this response because:

      during the roof replacement the ceiling as well as the ceiling lights were damaged , I informed this right away to *** , the sales rep and he even asked me to send pictures on september 6 at ***** am  and I sent him the pictures on thursday sept 7 at **** PM. On sept 18 at **** Pm  I contacted him again and he said they need to fix the lights. He then texted me back on November 20 at **** AM informing me  that "I will talk to my office today If we fix the lights Will you sign the check?" the same day at **** AM I sent him a reply saying that I contacted my Insurance and they informed me that it is the liability of the A&D iInsurance since it was caused during their work and they have to make a claim on their insurance. The Business can check with ***. Mr *** had all the pictures of the ceiling before work since he along with the independant adjuster took the pictures of the ceiling lights as well as the damaged sky light. he also have the pictures of the damaged ceiling and ceiling lights after work. If the business have any doubts they can check with the employees that came to fix the Drywall on the ceiling since they have seen all damages caused by A&D during the roof replacement. I do not want to make any unnecessary claims when Mr *** have all evidences. If A&D wanted to proceed with filing a Lien on my property please let me know ASAP so I can contact my insurance and ask them to send an adjuster to record all the work that is completed by A&D and the work that is not done as per their approval.

      Prior to having new roof installed I had no issues old roof with leaking ,it was 23yrs. old & worn ************** would have noted & suggested I replace .I had a new roof installed on my home around 9/26/2019 by A&D Home Improvements. .I noticed rainwater dripping from around bathroom ceiling around Oct. 2021. I contacted A & D .They came out & it appeared they corrected the problem ,an issue with the roofing around the exhaust vent that failed. Since then A&D has failed to come back out & access any damage that might have been done in my attic area by the leakage. I've attempted on several occasions to have someone come out with no response. I can't even get a call back to explain if is not necessary for them come out & inspect for damage.

      A&D Home Improvement installed a new shingled roof at property located on *************************************************. A&D Home Improvement obtained all necessary permits to install the roof and passed all corresponding inspections (Ice & Water Shield Inspection and a Final Inspection). ************* did not report any problems with the roof for the next 2 years. In October of 2021, ************* contacted our office and reported water coming in through the bathroom vent. Around the same time, high wind driven rain was reported in ***************** area. A Dispatch was sent out to ***************** house to inspect the roof for any issues. No issues were found, and the roof was reported to be in sound condition. Since then, ************* had no other leaks or water intrusions into his house. A&D Home Improvement does not warrant weather conditions such as wind, or hails storms. This was explained to ************* at the time of the inspection.

      I am rejecting this response because: I was not explained as to how the leakage had happened .I did observe the repair person do some repair at the time of his visit. Since then there has been no other issues .My concern was because ,I did not connect at the time but there was (water on the floor & soaked rugs) leakage prior to the repair visit on other occasions. Because of that I requested someone to come out to access damage to attic if any. Repair person could not access any damage at the time other than there may be some staining in the ceiling & referred me to contact office for follow up inspect. I called several times but never received any call back. I will assume they are satisfied, but I will have an independent contractor access if there is any water damage to the attic.
