      **** remodeling currently has a triple A rating from BBB. He has received nearly all the money on a contract to remodel bathroom and sent me a text today to say he is quitting the job. It is about 45% complete I have filed a complaint with Mastercard for a portion of the payments. ******************* does not deserve to maintain his current rating

      Tell us Roths Custom Remodeling entered contract with ***************************** with agreed upon start date of Tuesday 10/17/2023.
       Job was to include Bathroom remodel (attached is contract)
      -Demo of bathroom to studs
      -Redo all existing plumbing
      -Remove all old rope electrical and install new electrical
      -Build walk in shower
      -Tile shower and floor of bathroom
      -Dry wall and tape existing walls
      **** The above has been completed and photos are included for proof.******
      To be completed
      -paint of walls
      -Install vanity (on sight)
      -Install Medicine cabinet (on sight)
      -Install toilet (on sight)
      -Install built in cabinet (returned by owner not on sight)
      **** Estimated time remaining on job site 4 full days***********

      *** ********** services added for client with no price added*******
      -Front room electrical (Living room) Homeowner blamed Roths Customer remodeling for this. We had *************** come in and service. Problem was located at front door not associated with bathroom. No cost to client for services.
      -Homeowner had contractor pick up cabinet from ********** in *************, **. Client not charged for drive time or services rendered for that day (4 hours total drive time)

      Remaining balance on job $3971.22

      On December 27th text was sent from ******************* to homeowner to inform that Business associate (father, ***************) would be taking over the job due to personality conflicts with client. Client agreed to this with a phone call Between business associate (***************). A ************* was set for a sit down meeting to review remaining tasks on the project get an estimate timeline and discuss ***** further. ***************, Electrician and laborer (names can be provided if needed) showed up on 1/16/2024. It was at this meeting that and agreement could not be met and client asked **** remodeling to leave her home.  Client and *** did review contract in which she marked up stating that ***** was leaving the job. This was again in fact not the case.

      Original complaint by client states, " sent me a text today to say he is quitting the job." Both client and ****** Custom remodeling have both shown text message evidence showing this is not the case and that job was being transferred to associate to take lead on. It should be noted that client file complaint with BBB the day of text however agreed to meet with new lead and set date and time for them to come out to home. It was t this meeting that client asked ****** custom Remodeling to not continue. 3 employees present that can testify to this interaction occurring. 

      The 2nd part of the original complaint shows that job is only 45% completed. Photo evidence by both parties has shown more that half of the job completed negating this claim. 

      In new photos provided by client there is a text exchange that shows and estimated finish date of 11/17. To address this again electrical issue occured in the home at no fault of Roth's Custom Remodeling work. Issue was located at front door at fixed free of charge to client. Second bathroom cabinet purchased by client caused the delay and the issue to occur. Client purchased this and due to credit card company thinking it was fraud the purchase was canceled. This caused a delay in timing but also for the repurchase of the cabinet to occur outside the sale pricing. Client blames ***********;custom remodeling for this although we have no control over credit card companies. We are submitting text screenshots to show this interaction. Furthermore again once cabinet was purchased we provided pick of item free of charge with drive time of 2 hours each way. Supplied screenshots w3ill also show client agreed for company to be in home on 11/25 and discussing further work. 

      Due to the fact that client has also provided contract/invoice again it shows the original cost (in which has never changed) Client has a remaining balance of $3971.22. Due to  this being over her chargeback amount we are asking to walk away with no parties owing anything further. Client may seek new contractor to complete work.

      I am rejecting this response as written 

      Prior to **** Constructions demolition of existing bathroom, there was no electrical issue.  Therefore, electrical issue that was resolved in the adjoining room of the bathroom, was due to their demolition. A hole was put in the hallway during demolition. This is now my responsibility to put a new piece of drywall, tape and prime along with painting at my expense. Get over the 20 minute  electrical repair and stop whining. 
      Bathroom cabinet was purchased by me after ***** said he was not going to build the cabinet as first planned. That was an additional $2200 expense that I had to incur.

      I did meet with ****** dad in January after seeing all signs of worked ceased and all tools were removed. The father was never part of the contract. I met with him to thank him for the 85% tile job but realized that the father does tile and thats about all. 
      I would never have allowed anyone to  continue work that did not sign the original contract.

      Once the credit card realized the overpayment for work, they reversed the payment and have credited my account.
      That being said, I have hired a firm to complete the bathroom   
      I am now ready to walk away from **** Construction.

      In response: 

      the electrical issue was located at the front door and is not an anointing room. Also again electrician brought in free of charge for labor and fix to this issue. 
      Custom bathroom build in closet was never a part of original bid. And yes this would constitute as an additional charge as it would be a custom build. Customer opted to purchase store bought cabinet due to cost. Again company provided free pick up and delivery services. 
      Customer also entered contract with Roths custom Remodeling and not *******************. This does mean that all subcontractors and employees are included. Having someone take the lead on a job is normal in any business. Roths custom Remodeling had all intention of completing job which is why 3 employees showed up for ******* meeting. Again remaining balance of $3971.22 of original total bid of $18,975. The remaining balance reflects the work not completed thus all completed items have been paid to date.
