We signed the contract with Rych City Construction in 02/2023 for the construction of our basement, crown molding, accent wall, and patio door trim. During the construction/planning we enquired about the possibility of remodeling of our stairs for which ****************** gave us an estimate along with an estimate of the time frame to finish all proposed work (WhatsApp message dated 04/24/2023). This estimated finish time was to be 3 weeks after city inspection. The city inspection was completed sometime in 05/2023 after which drywall application was started. As per the time line Rych City Construction representative/ owner gave us, this whole project was to be completed in about 3 months or less, give or take a few weeks. However, Rych City Construction took the whole of 2023 and beginning of ********************************************* April 2023 Now we have waited more than 10 + months for completion and we want to move forward with another contractor to finish the partially completed work. The last contact we had with him was April 2024 when we mentioned to him that we wanted to move with a different contractor. Rych City Construction owner has threatened us in our chat (dated 4/6/24) that 1.We cannot decide to move forward with another contractor.2.According to Rych City Construction, they owe us $1.500.00 (the breakdown for which has not been shared with us) and the amount will be paid over a 6-month period starting May 15th ******.That his lawyers are briefed, are ready, and are drafting the documents with terms for signatures After this message we have not gotten any letters or messages from the owner of Rych City Construction. Rych City Construction owes us $******** from all the payments we have made till date. We want to fire Rych City construction for the uncompleted job and get our remaining $ ******** from him.We have pictures of his uncompleted work but cannot upload the file. However, we can email the document.

Hello thanks for bringing this complaint to our attention.

My name is ************************* and I'm the president/CEO of Rych City Construction.

We are extremely disappointed that any of our clients will have complaint against our company because, customer service and client satisfaction is core to our belief at Rych City Construction.

Looks like we fell short on this occasion. We do have some backup information that could better explain this particular case.

Rych City signed a contract with Manju and ****** to complete several home remodeling projects including basement remodeling.

The projects commenced and we created such a great relationship with ***** and ****** that they referred our company to several friends and neighbors. They decided to add a change order to the original contract which was modifying the basement entrance stairs.

After discussions we provided a quote for a ******** with spindle type configuration for the stairs leading to the basement. Our client agreed, made a payment and we begun the demolition. The basement was about 95% complete when we started to work on the stairs so we paused from completing the basement for focus on finishing the stairs.

Our clients then took a 3 to 4 weeks vacation, upon arrival, ********** became a little bit difficult due to travel and work for both Manju and ******.

Upon arrival ***** changed her mind in regards to the design on the stairs based on some designs she saw whiles in ***** on vacation. We subsequently spent the next couple of months trying to modify the design initially agreed upon. We started with a glass option and after several weeks and inquiry realized the lead times were too long for comfort. Some of the changes requested by Manju required extreme custom metal/steel work which we weren't proficient at. ***** then sent several other designs that she wanted to try.

After several meetings and attempts to meet her needs, we were informed that she found another contractor who can do what we couldn't. This happened on the very last meeting we had in which ***** didn't like the final design we agreed upon because she wanted to modify the entire stairs to accommodate a wider stair  thread. We immediately started discussions on compensation due to time spent, resourced and materials purchased including the demo that was completed.

We couldn't come to a final agreement on the balance and that was the last time we heard from our client.

Attached are some of our WhatsApp discussions and pictures of the markups we made for discussion. Text messages show our efforts. Timelines and dates are included in the images to show the extent in which we accommodated our client needs.

It's unfortunate we couldn't come to an agreement and we hope and wish Manju and ****** well.

      Sincerely

      Rich.

      Complaint: 21921767

We did read ******************** reply to our complaint and do not agree with what ************************* has offered or says.
As mentioned in our complaint we signed contract with ************************* business Rych City Construction during 2/23 to complete several home remodeling projects including basement remodeling.

However, we did not add a change order to the original contract as mentioned by ***************************** but had requested ***************************** to modify our basement stairs. ***************************** agreed to this and sent us an invoice for $ $8,493.00, with the cost and break down for each step for the reconstruction of our basement stairs.
No agreement was done verbally or in writing with Rych City Construction regarding the type of stairs that was to be built at the time of payment. (Please see attached whatsApp chats dated 8/31/2023 and 9/6/2023).

Rych city construction demolished our stairs assuming that we wanted the standard railings as accepted and mentioned by ***************************** in his 10/18/23 whatsApp message. The demolition of the basement stairs was done sometime in May 2023, before we departed for our 4 - week vacation and before we could decide on the type of stairs we want.

***************************** has mentioned multiple times in his chats dated 10/18/23, 11/27/23 that he will give us back our money and we can work with any other company to complete our stairs. However, as we had already paid 80 % or more of the contracted price to ***************************** to complete several home remodeling projects including basement remodeling, we wanted to retain the services of *****************************.

On 11/27/2023 ***************************** sent us a picture of the glass stair that he was getting quotes for and we agreed for this option. However, ***************************** was not able to find any company who he could work with for the glass stairs.

After discussing for many more weeks, waiting for 8+ months for the completion of the stairs, the basement, home remodeling projects agreed on in our contract, and compromising on what we wanted for our stairs ***************************** said that he would come with his ********* to finalize the stairs during the 1st week of Jan 2024. He did come on 1/4/2024 without his ********* to discuss the stairs and told us that he would get back to us with the date to restart the work on the stairs later as his workers were busy with a different job.
As we did not hear from ***************************** for more than 2 months, we informed him that we have decided to go with someone else and need the remaining money that he owes us.

After providing ***************************** with all the invoices with receipts for payments, asking for his breakdown of how he is calculating the money he owes us, and pointing out all the un -completed work still pending (which ***************************** agreed needs to be still completed in message dated 4/1/2024). ***************************** told us that we cannot fire him and threatened us that his lawyers are briefed and are drafting documents with terms for signatures (whats app messages dated 4/6/24).

This is the last we have heard from ***************************** and are still waiting for his breakdown of the costs from his side and the papers from his lawyers that he threatened us with.

I have already attached all our whats up messages with ***************************** that shows our efforts to accommodate his many needs that ranged from him falling sick, his workers falling sick, and his appointments to name a few and the compromises to the design we agreed to so that we can retain and complete all the paid for construction work with Rych City Construction.

Due to the threats and lack of completion of the original contract for several home remolding projects we would like ***************************** to refund us the balance of $4,603.00 that he owes us.

Please find attached the screen shots of the WhatsApp messages that I have mentioned in this email with date and time stamp and the document with the stairs invoice, payment receipt, and picture of the demolished stair.

      Sincerely,

      ******************

We do not agree with the response. The evidence is within the complaint.

I'm not sure how we can give a quote without knowing what is to be done. - "No agreement was done verbally or in writing with Rych City Construction regarding the type of stairs that was to be built at the time of payment"

The date of quote for the stairs versus the last photo sent based on what the client will like shows the timeframe.

We're not in agreement with this response and the evidence shows.

      Complaint: 21921767

I am rejecting this response because

We are not in agreement with what ***************** is saying.

Telling that I'm not sure how we can give a quote without knowing what is to be done. Even after I have attached a WhatsApp message, dated Oct 18 2023, where he agrees that he should have asked us what we wanted for the stairs before demolishing the said stairs and offering to give us back our money goes to show that ****************** does not care about evidence that is present.

****************** and his company have not completed the remodeling projects that were initially signed too.
I am emailing a document of all the unfinished work that ***************** failed to complete as per his contract to the ***************************************************** email address and also attached will be the  WhatsApp message where he agrees that he still has to complete work at our home (dated 04/01/2024).

Do let us know what our next steps should be. ***************** is just trying to slow the process of giving us back our money even after we showed evidence that he repeatedly kept offering us back our money in his whatsApp messages. I have already attached the said whats up messages in the previous response dated 10/18/23 and 11/27/23 and am also emailing the same again.

We work hard for our money, just as ***************** does and we are not ready to lose our money.

      Sincerely,

      ******************
