      Kirkpatrick **************************** at North Pointe Bay has allowed the *************** ********* laps January 31, ****. Without a new policy in place. A letter (dated 2-1-****) of notification was mailed approx 2-10-2022 stating they "hope" to have a new policy in place by March 14, ****. I need to sell my Townhouse and can not because NO mortgage company will take the loan.Kirkpatrick was notified NOVEMBER 2023. These decisions have left me in peril.

      The Kirkpatrick Management Company issued a warning letter to our family for leaving our trash can by the curb for less than 2-days while we were away for a vacation. When asked, they indicated the photo they took and the warning letter followed "routine" inspections and were "fully within the authority of the Board and management company." We also requested follow-up information about how long trash cans are permitted to be at the curb for pick up and rather than citing the rule, they simply referred us back to the covenants. Residents who pay nearly $1000/year for HOA support deserve slightly more professional treatment. Our family has had zero issues for 12-years in this neighborhood until this management company assumed responsibility. We have now had 2, both unsatisfactorily resolved. And all this does is detract from an otherwise healthy and happy residential experience.

      At Kirkpatrick Management we pride ourselves on excellent customer service and strive to improve the overall health, wealth and condition of our HOAs. We are sorry you have had two unsatisfactory experiences with our company, but I can assure you this is an anomaly. As a Management company we only take action, such as sending courtesy letters for Covenant Violations, if we are directed to do so by your ***** of ********** In the Timberstone HOA, your governing documents state: No rubbish, trash or garbage containers shall be stored or maintained outdoors except for such temporary storage necessary for immediate pickup of the trash and, in the event, trash shall be stored in appropriate containers. We encourage all residents to get involved with their HOAs by volunteering to be on the ***** of ********* or other Committees.       This company is not trustworthy and unethical. They use their own maintenance crew and contractors who over-charge for repairs or charge for work not completed. As a member of the ***** of ********* for our condominium association, I saw estimates and invoices with questionable charges. The property manager acted as if we worked for her and did not communicate or follow through with work orders or contractors we wanted to use. She did not work for what was in our best interest. She continued to use contractors we did not want working in our complex. Many residents complained about her negligence and deceit. She withheld estimates then told residents board members were causing delays in repairs. When we gave our 60 day notice of intent not to renew our contract, she did even less. After the contract expired, the property manager made an unauthorized payment to a contractor she was instructed a month prior to not pay, because the job was incomplete and yet she failed to pay the water utility, causing us to incur late charges. The company delayed transferring our records for over 40 days until our attorney compelled them to complete the transition. During this time, they did not provide any of our operating funds to the new management company. I do not recommend this company.

The only work order that was disputed was for $170.00 (work at your unit) and a response from contractor that this was labor and material. Previous work orders for the same thing were same pricing from other vendors. If you have any other workorders that was disputed, please provide dates and work order numbers. I have looked at the Vendors used since 2019 and these vendors were vetted and approved from the board members. Please provide any in question. All issues from co-owners were forwarded to the board to please advise. On estimates, please look at your board meeting minutes you submitted, and the estimates were given to the board and you as a board voted and selected the contractor. Our company gave anything that was requested via email, on the transfer of final we were waiting for the check from the bank on three accounts.In Service,*****************************, CMCA, AMSCommunity Association Manager

      The unauthorized payment in the amount of $48,000 was made in January after our contract had expired and ******* was told in December not to pay it because the job was not complete. ******* was told we did not want Pepa, LLC doing any more work in our complex and she continued to use them.
