On December 7, 2021 I signed a contract for Alexander Operations LLC to perform a job for us - to excavate and grade/level a 30'x68' area plus a 85'x12' driveway and to bring in gravel to fill the areas. He quoted us $6,850 ($3,850 for gravel and $3,000 for labor), and said it would take about 3 days to complete.Alexander Operations began work on December 9, 2021. He worked a few days and then stopped working, citing frozen ground. The following are the days I followed up with Alexander Operations to inquire about finishing the job:1. I followed up with Alexander Operations on February 9, 2022. He cited weather conditions as the reason for not working on the project. He said he would come out to look at the property within a week to see the conditions. He did not come out.2. I followed up with Alexander Operations on March 21, 2022. He cited weather conditions as the reason for not working on the project.3. I followed up with Alexander Operations on April 23, 2022. He said he was in ********* and will be back to Indiana the following week. He cited weather as the reason for not working on the project.4. I followed up with Alexander Operations on May 2, 2022 asking him to come to our house to create a plan to finish the project. He did not respond. 5. I followed up with Alexander Operations on May 25, 2022 stating he was not working on our project and hadn't responded to my previous inquiry from May 2. I requested return of our $3,850 deposit. He apologized for not being in touch with me and stated that he was planning to complete the project. He said he could resume work June 8. I asked if he could resume work before June 8, and he indicated he could not.6. On May 31, 2022 we notified Alexander Operations that we were no longer in need of his services. We needed the project complete, and I was not confident he would complete the project within another 1-2 months.Business response

Hello, we are sorry to hear your experience with Alexander Operations has it been what you expected. Alexander Operations does not make contracts with residential customers. The document you received was a quoted price with subject to change. One factor that *** change a quote is the price of fuel. The price of fuel has a major affect on most things in the world. I'm sorry you thought the job could be complete within 3 days unfortunately that wasn't true and Alexander Operations does not commit to completion dates as there is many factors that could delay a project such as weather and delivery of materials and we don't have any control over that. Alexander Operations committed 2 front loader tractors to the job site. We recorded 19 hours for our **** Deere and 16 hours for our Kubota. Our standard rate is $125 each running hour for our machines, that equals $4,375. We were able to dig 90% of the area out resulting in roughly ****** lbs of dirt also equal to 4 tri-axle dump trucks. We stopped production on the project because we needed to discuss the change of price on our estimate. We also stated verbally the ground is too frozen to dig also it would continue to rain and the ground didn't have the chance to dry. Alexander Operations intended on and verbally stated we were resuming production on the project as soon as the condition were well enough to actually make progress on the job. The dumptruck company that was hired refused to drive there trucks on the job site . They stated their trucks would sink in the mud and the condition had to improve greatly before they could deliver the gravel. Alexander Operations couldn't complete your project at the customers desired time frame because of these factors. Alexander Operations is very confident we could of completely your project in a timely manner and in the most profession way if we could of had the chance to get past winter and all the rain in the spring as this was not a small project by any means. Again here at Alexander Operations we take great pride in our work and professionalism. We strive to make our customers happy. From our stand point in this situation we believe we are owed $525. We also believe that a customers impatience is no reason to attempt to damage a business. We apologize for this situation and we strive to never let something like this happen again.
