Company removed my concrete walkway and deck/porch from the front door and front of home, also dirt and piled both dirt and concrete on top of adjacent stone driveway also blocking a *** storage container preventing it's removal (rented). The scope specifically stated to haul this debris away, off of property. They originally piled it next to the **** Then after they said (multiple times) they were going to remove the debris and failed to do so, they returned *** push the debris to a different location. They were also suppose to obtain a Building Permit (for the contracted work) the morning BEFORE they were to begin and the Lngacher member told me they did in fact have the permit. Later that morning, they told me they were NOT able to get the permit immediately and abandoned the work site leaving the debris pile blocking the *** and making a dirt pathway ON TOP of the gravel driveway from the excavated area to where they dumped the debris. This gravel pathway now has compacted dirt in it and is also preventing my use of the parking spot (gravel area) as well. After SEVERAL promises to remove the debris pile (which was my initial priority) they never did but did manage to relocate it. All that effort did not produce the removal of the debris, just move it elsewhere. A stop pasyment was put on their several thousand dollar check they accepted and cashed. I was originally told they would not deposit the check until AFTER they secured the Building Permit. The permit CAN be issued following the correct procedures. This was told to me by ************************************************* staff in an email and an oral call. I was provided many different excuses why they were not removing the debris and I no longer have access in or out of my front door as there is an estimated 4' drop immediately outside the front entrance. Only the side entrance is available and has 4 steps whereas the front door was formerly only 1 step up, much easier to enter and exit for certain people including myselfBusiness response

Hello, We are not able to get permitting for the attached deck that the customer wants us to build, due to the fact that the house is in a flood plain and the ***** ** building department only permits work up to 50% of the *************** if the structure is in a flood plain, this house has already reached its 50% of house value *** work permitted with previous work done by other contractors, etc, so they will not issue permit for a attached deck for this house, we are willing to work with the home owner to resolve the (step issue) and any other issue we can resolve, however we have been reaching out multiple times and have left voicemails with no response, please feel free to reach out at ************ Thank You *********;Customer response

I am rejecting this response because:
1. There are over 500 homes in the floodway and/or flood plain in the immediate affected area. It is allowed to build new structures / remodeling, so long as you go thru the correct people / departments and follow their required procedures. ***** County (**) told me they don't see any problems with the project Lengacher is involved with (and others on the same lot and adjascent lots so long as the plans/information is properly submitted to the **** of ********************** Additionally, there is STILL remaining sqft allowed on the property and a deck CAN be installed. The amount still allowed, the deck can be built within. Additionall, they should know there is an ADDITIONAL way around this to circumvent the *** allowed sqft and that would simply be to NOT attach the deck to the home. This method, there would be no size restrictions. ADDI#TIONALLY AGAIN, the fence and PVC could still be put up which was part of the project. I have emails from the *** and ***** County plainly stating you can do anything so long as the required people are involved and they NEVER submitted anything to the *** (which could have been considered/accepted or rejected) but again, as long as the requirements are met, the *** and ** will allow you to do anything. A fence does NOT ad to the sqft of a home and again, there is still room which will allow even an attached deck. When this home was built at this location, the exact same procedures had to be followed and they were approved as was the addition Lengacher specifically mentioned so this will support that it can be done so long as it's done according to the building departments / DN R's regulatioins. MUCH of FTW is in floodway and/or flood plain and the MAJORITY of these affected area's have improvements and EVERY ONE OF THEM, the contractors successfully perform the obligations required thru the ** Bldg **** and/ or ****. of **** Ressources / ***. Happens ALL THE TIME.So let's just be gracious here and say the deck could not be done (which it can) but under that premise, the fence can still be done AND another remedy could be employed such as a stone floor vs a deck, patio blocks/pavers vs a deck, even dirt and grass (which was originally there) surrounded by the privacy fence which is the most important component of the project. Again,the home has NOT reached it's capacity and again, even if it had, the deck does NOT have to be attached, it can be a floating deck. They do mention specifically "the attached deck"...
Other issues still remain as well.
2. The debris pile they took dirt and the concrete step/walkway from the front of the house and in the plain language of the contractual work, they were to remove it/haul it away. Instead they drove across the gravel driveway covering much of the gravel with dirt and dumped it on the property 1/2 on a distant part of the driveway and some of it on the grass alongside the driveway, blocking unrelated infrastructure of mine on the property, since the BBB is now involved, to assit in a remedy to all the components, it should go thru them, any communications and to do so they can use this situation to their benefit or to their detriment by failure to remedy one or more of the complaint components. They should communicate with me via the BBB platform since this was regrettably launched due to their failures and promises.
I took the time (in the last couple days) to text/explain to them that since I regrettably had to launch this complaint (after so many failed removal dates of rectifying one of the issues/components) where they said they were to show up and remove the debris pile they dumped, they never showed up several times.
This also prevented the removal of rented storage container on the property since along one side of the **** they dumped the debris preventing access of the removal hoist to access the ***
They apparently ***** nilly accept projects, initiate Agreements/contracts, accept monies for jobs without undertaking the necessary steps to do them in order to do what other contractors also have to do and manage to do (same as the recent additions onto this property they specifically denote, they make a mess and just arbitrarily cause damage to property (driveway and grass) and also create badly needed ingress and eagress to property/homeowners.
Finally, I understand that things happen but to repeatedly fail to remedy problems THEY CREATED and only exaserbate issues even more there is simply no excuse for but I hold no grudges and am employing the BBB to help out because they repeatedly failed to do what they said they were going to do to remedy one of the complaint components. I responded to them in the last couple days when telling them to communicate thru the BBB when they wanted to again set up a day/time to remove the debris (and they also said they wanted to discuss the remaining components of the Agreement). So lets get the debris pile removed so we can move forward with the other components of the complaint.

We cleaned up the debris and removed as much dirt as possible from the driveway also installed new gravel in his driveway, we put fresh gravel and patio pavers to create a ramp and small patio for easy access to the door.
This was ***** Response to our attempt to resolve issues, and my response like I said before he will not speak on the phone or meet as promised at the location to work through these issues so it has been hard to resolve
Ps were still having Wi-Fi issues at the office,
In the area where I coordinated the excavation and leveling of the area where the area is reserved for the deck to be installed by your company, you removed the large concrete landing and extra wide concrete sidewalk alongside the front of the house, past the house, extending to the driveway.
Tuesday 2/14/23, your contractors forced open/rearranged the fence panels and entered the fenced off area directly in front of the house and put a couple inches of gravel on top of the dirt, in the excavated area where the deck is supposed to go and rearranged some borrowed landscape blocks temporarily placed there in the dirt so my crew isn't in the dirt working. They did manage to bend the fence panels back to the way it was prior to their modification to this area.
No one asked for permission to forcibly enter into that fenced off area and no one asked permission to place gravel in that excavated area and re-arrange the blocks but it's already done. They also removed some of the blocks from the property.
Why did someone make these decisions on your end to alter this area, specific to this area without our expressed consent?

Also, over the top of the existing driveway (mixed with mud which occurred during your concrete sidewalk and porch/stoop excavation/removal by your company) you put a skim coat of gravel over the top of some of the affected area's.
The debris is removed which is appreciated and the area's have not been restored to as was condition, the surface is now slightly elevated covering the mud remaining in the driveway under the skim coated surface.

Your complaint was that you could not enter or exit your front door easily so we are doing our best to help with this,
We did remove a few broken pavers (approximately 3 pavers) but we also added 10 new pavers to your property which was far more then the broken ones,
We did add gravel to your driveway, we first removed as much of the dirt as possible before adding the gravel, however Im sure you understand that it is impossible to remove all of the dirt, and one would expect some dirt being tracked back and forth during an excavation/remodel project, ( I could bring more gravel if that would help?) let me know,
It would have been helpful if you could have been there on site so we could work through some of these situations with you in person, (I thought you had said you were going to be there?) with you not being on site and not answering my phone calls it has been complicated to know exactly what you want done, but we will continue to work with you as much as possible to resolve these issues,
