On 9/27/21 I paid $800.00 "to get on the schedule" to have dirt trucked in and graded around the foundation of my house and yard. I was told we would be 2-5 days out on the schedule. A contract was signed by both parties also on 9/27/21 to have the beforementioned work performed. Contract was signed with ****** of kansas city dirt works. Another $800.00 due upon completion of work. The work was never completed or started whatsoever. No contact was ever initiated by ****** with kansas city dirt works. I texted ****** on 10/8/21, was texted back that it would be another 5 days out on the schedule. I texted on 10/19/21 and was texted back ******** father had passed away and he was now in Pennsylvania for the funeral. I texted on 10/21/21 offering my condolences and he texted back that it would be another 5-6 days. I texted on 11/3/21 asking for a firm date and received no response. Badly needing dirt and it now being 5 & 1/2 weeks later I texted on 11/4/21 requesting contract be terminated and $800 "get on the schedule fee" be reimbursed immediately, no response. I texted again on 11/8/21, ****** left a very rude voicemail. I texted on 11/9/21, ****** texted asking for my address so he could mail me a check for the $800.00, he texted "sorry it didn't work out". ****** texted on 11/9/21 he would absolutely refund our money. This was after 6 weeks of waiting for work that was originally 2-5 days out. ****** texted back requesting my address so he could refund the $800.00, I texted address and requested a picture of the check but did not receive. On 11/11/21 ****** texted the check was going in the mail that day, I texted back thanking him. It's now 4 weeks later and no check has arrived. We are seeking a full refund of our $800.00 "get on the schedule fee". ******** cell phone number is ************.Business response

My father passed away from covid so I was on the east coast dealing with that. I was taking care of my mother. She ended up in the hospital dying. I was literally in the hospital saying goodbye to my mother and he is texting and texting and texting me. I asked him to give me a day or two. He said he didn't care. I apologized ten thousand times. I called him. He wouldn't answer the phone. I called him again. I told him I couldn't believe he was this cold while I was in the hospital with my mother passing away. That was the message I left. I just got back yesterday. I do owe them money. I didn't do the job, not because I didn't want to or couldn't. This was just bad circumstances. A check will be sent to him tomorrow.
