On 3/13/24, I paid a deposit to hire LKB Floral Design to provide florals for my wedding on 9/14/24. In the months leading up, she stopped answering me through all forms of communication. I was trying to reach her to find a date she was available to provide my bridal bouquet for my bridal portraits. Due to her lack of response, and because it was beginning to be too late for her to provide this in the timeframe I needed it, I was forced to search for another florist. I noticed she had been active on social media during the 6 weeks she refused to answer my texts, emails, and phone calls. When I finally received a response on 7/16/24, after not hearing from her since 6/7/24, she stated she would set up a call to discuss the details of my bouquet, which had already been discussed in our original meeting. I explained how long it had been since I heard from her in hopes that she would be apologetic and make things right. If not that, I requested she refund my deposit since I had not received any physical flowers from her. She instead responded stating that she has a day job which takes her attention away from the business and allows things to fall through the cracks quite often. She added a list of miscellaneous labor charges that I did not approve of in attempt to repurpose my deposit to benefit her argument. She later stated she is a "small business with small profit margins and [she] cannot justify refunding [my] retainer." She then stated she is not obligated to respond to me again since I did not want to continue with her services. After leaving a 1 star review on FB & TheKnot and posting about my experience in a Facebook group, she had my reviews removed, and threatened to sue for extortion and defamation. I believe this is unfair, as I was only stating my truth for those who needed to hear. A fair and reasonable resolution would be for her to refund my deposit to which I can then update my post stating she has resolved this matter.Business response

****** **** placed an order for wedding flowers to be delivered on 09/14/2024 with LKB FLORAL DESIGN. On 03/12/2024, ****** **** signed a contract and paid the nonrefundable deposit to secure our services for her wedding. After months of preparation and multiple proposals, ****** wished to terminate her contract on 07/26/2024. She made this request via email, and we allowed her to withdraw from the contract. However, ****** is demanding that we give her a refund for the nonrefundable deposit. All proposal versions contain the contract that specifies that the deposit is nonrefundable. Proposal version 2 contains ******’s signature and retainer payment.
******’s other complaints are pertaining to a separate order flower order for 07/30/2024. This order has nothing to do with her flower order for 09/14/2024. However, I did attach a timeline of interactions between ****** and me. She is claiming that I had not communicated with her for 6-8 weeks and this timeline shows that is not true.
I did apologies to her for the slow responses. I did go on a cruise for the first time, and I did not realize that I wouldn’t have cell service nor Wi-Fi. Therefore, I could only respond to emails once we made port, and I had access to Wi-Fi. Regardless, we had plenty of time to discuss fulfilling any requests.
I was unable to attach the full contract. ******** *******, Director of Operations of BBB, will attach all the documents I provided.

I am rejecting this response because:LKB Floral Design left me with no option but to terminate my contract due to the lack of help and response prior. The business owner mentions attachments, yet there are none provided. As I provided before, from message on 6/7/2024 to the next message I received from her on 7/16/2024 was forty days (5 weeks and 5 days) with no response. According to her Facebook, her first stop of vacation was on 7/11/2024, therefore she refused to respond to me long before the vacation she has mentioned.
I never received a receipt of signature of the proposal mentioned, nor did I sign any other proposals she may have sent pertaining to my order. My complaints do not pertain to a separate flower order, as I was reaching out to add an item to my current order, which states in the contract that this is acceptable leading up to my final payment. Being that she would not be available to speak with me until 7/21/2024, I believed this would be too close to the date I needed my mock bouquet and that she would not be able to provide. I also could not trust that she would provide this because of the lack of response for so long, and the carelessness of the circumstance.
The deposit was paid for physical flowers, and she did not provide that to me. She is attempting to repurpose that deposit for miscellaneous charges that were either stated as free of charge in her contract or were not approved of by me. I received no service that was agreed upon from the business.
I believe it would be the right thing to do to refund the deposit of $125.94.
