      In Dec 2021 I called the business asking about a motorcycle they said the bike was available. called to see if bike was still available Jan 4, 2022 and was told it was still for sale. I told ***** that I was interested and I was on my way from Mauriceville, Tx to the dealership. I arrived early afternoon to see the bike. I said I wanted the bike and he told me it was sold. I challanged that statement and reminded him of our conversation about how to pay the dealership we discussed electronic transfer from my bank to theirs. I ask to speak to the manager, the manager said yes the motorcycle was sold and paperwork filled out yesterday afternoon and as soon as we put tires on the bike the purchaser will pick up the bike. I ask the manager if he would please contact me if the deal fell through because I wanted the bike. He said he would. On Tuesday Jan 25, my wife was told when she called that the bike was still for sale. I called after my wife did and ask that the dealership send me an invoice for the total price. I told them I would send them a cashiers check. The invoice stated the total price would be$ 6,949.50. I purchased a cashiers check and overnighted it to the dealership I called the dealership and informed them that the check was on the way. At 5:58 PM same day I was informed that someone had just purchased the bike. They said since my check had not been received yet they considered the bike still for sale. Morning of Jan 26 I pulled up web site and the bike was still listed but the price had increase by about $2500. They had lied to me about the bike being sold and changed the advertised price. I have copies of check and invoice. I think they should sell me the bike at the invoice price that they sent to me. Please assist me on this in justice. Please see attached documents will show the bike for sale same vin number for higher price.

      Business Response /* (1000, 8, 2022/02/22) */ Hello, We're sorry that Mr. ******* wasn't able to get the motorcycle that he'd hoped for. We did offer the motorcycle to Mr. ******* at a discounted price, far less than what we advertised. We also offered the motorcycle at a discounted price to other customers. Mr. ******* was sent a buyers order for the motorcycle on 1/25/2022 for the price of $5,999, a total price of $6,949.50 (Mr. ******* was going to pay his own tax) Mr. ******* got a cashier's check from ****** ********** Bank in Texas for the amount of $6,949.50 on 1/25/2022. Mr. ******* overnighted the check from Texas on 1/24/2022 to arrive in Baton Rouge on 1/26/2022 using USPS. The check arrived on 1/26/2022. Mr. ******* was told that the bike is still for sale until it is paid for. Also on 1/25/2022 Mr. ***** came into Baton Rouge Harley-Davidson and was offered and paid for the motorcycle at the same discounted price that Mr. ******* was offered. I've attached a copy of the bill of sale to Mr. ****** I redacted some information to protect his privacy. I've also attached a copy of the credit card receipt for Mr. ******** down payment. You can see the timestamp reads 01/25/2022 TIME 17:12:33. Mr. ******* stated that he was called "at 5:58 pm on (1/25/2022) same day I was informed that someone had just purchased the bike". 5:58 pm is 45 minutes after the credit card transaction taking payment for the bike, and about the time it takes to complete the paperwork. In summary, we called him as soon as possible after the transaction to let him know it had been sold. To his credit, Mr. ******* picked a very desirable model and a great value at the price we offered...unfortunately someone else was able to pay for the motorcycle before he was. We sympathize with his frustration. We are just as disappointed when we're not able to help someone get the bike of their dreams. We promptly returned his check to him. Again, we're sorry that Mr. ******* wasn't able to get the motorcycle that he'd hoped for and we wish him luck in his search and we wish him well.
