The Crack Team repaired a foundation crack in 2007 & the warranty for water leaking through the repair is lifetime and transferable (normal LIFE OF THE STRUCTURE, TRANSFERABLE regardless of changes of ownership). Exceptions are "warranty is void if damaged by an earthquake or adverse soil conditions above or below grade", for which the latter is a catch all without proof.We purchased the house end of May 2022, took photos of the repaired crack, & saw no leakage/deterioration of the repair. In December 2022, we noticed leakage at the bottom of the ************************************************ within the repair. I reached out to *************************, sent before and after ******* ***** response was "From the pictures, you can see that there are cracks in the repair that are a sign of the wall continuing to settle. This settling is caused by adverse soil conditions which void the warranty. We cannot control the movement of the earth around the foundation. Its nothing to be alarmed about it just happens." He states this without even inspecting the repair & the claim of settling & adverse soil conditions is ludicrous considering the ********************************* in the repair appeared within an approximately 6-month period. We do not have the original contract for this work and ******************** is not providing any details.I made numerous follow-up e-mails ******************** with no response from him. He left a voice mail and I replied in an e-mail that I prefer e-mail communication for which I did not receive a response. I have asked **** to inspect the repair and prove that there was settlement or adverse soil conditions, which is the only way one can justify those reasons for not honoring the warranty. Yet, no response. We hired a structural engineer to look at the foundation and cracks and agrees that the notion of settlement and adverse soil conditions is weak. Once we receive his report, I will provide as necessary.Customer response

While I have heard from the business in response to my complaint, I had to choose this option because you do not have an 'unresolved' option, which is the case here. I have had several emails back and forth with ********************. I sent ******************** the engineering report and he called our structural engineer and tried to discredit his work and him personally. ******************** relented to take care of the repair yet provided me 24 hours in which to make a decision. I told him that I frankly do not trust him to do the repair correctly and I would prefer he pay for the repair after we hire a reputable firm for which I would send ******************** the estimate for the repair. His 24-hour demand was not within the window for having two firms come look at the deteriorating repair. ******************** has been rude the whole time and a very antagonistic person.
