  In March 2024, my husband and I contacted ******* Dastoli, owner of Dastoli Properties, to view an apartment listed available for rent in ***********, **. Along with the application, we signed a document stating there was a brokerage fee of 1 full months rent that would be reimbursed if application was denied. **** called back and informed us that he knew the landlord well and asked that I apply for the apartment on my own as my husbands credit would not be approved by building owner. I went back to his office and filled an application out independently and confirmed the check for the brokerage fee would be returned if not approved. 2 weeks later, I received a call from a person who stated they were the building owner saying my application was not approved and **** would be reaching out with a letter of explanation. I contacted **** Dastoli on 3/21/24 to inquire about my refund as he had already cashed my check for $1575. He asked for the address for a check to be sent to as his accountant cuts checks at the end of the month. There was no check sent in March, April, May, or June. Both my husband and I contacted **** multiple times with the same response that the accountant cuts checks at the end of the month until he completely stopped responding in June. His office number posted on his building front is disconnected and we have not been able to reach him at all to get the $1575 refunded.

  ******************** hired me to help her find a property for rent and for sale including 

  land, condo, houses after she wanted to keep looking at many other units after the initial one she applied to. She stated please retain the fee for your services. So I continued to look very extensively for her and relentlessly tried very hard with her and worked per agreement we had via text messages. She hired me then decided she would stay where she is after I put in weeks of work for her and told her in writing if she hired me and transferred the broker fee it would become nonrefundable and exchange for the work that it would take to help find a suitable property for her. When she tried to terminate the agreement. I told her the fee became nonrefundable when she hired me after she initially didnt get, the unit in March 2024. she knows the fee is now nonrefundable.
