************** was hired as a contractor to build a deck for me in 2021. The permit to build was issued on March 29, 2021, and construction began within a month or so after that. On 6/2/22, I noticed that some of the building materials were defective. Some of the boards were warped. I sent ************** a text message with pictures of the boards attached, I did not receive a response. I texted him again on 6/4/22, 11/27/22, 7/30/23/ 7/31/23, 8/1, 14, 24 & 25 of 2023. He did not respond. I also tried to contact him by calling his personal and office phone, but he will not respond. I would like to have all of the defective wood replaced. It was hard to get wood during the covid crisis, so I guess I just got a bad batch. I remember construction was delayed because he had problems getting wood. I have copies of the text messages and contract. His office is now located in ******, **************************, **************.

After further investigation I would like to add the information below to my complaint.
There are 2 issues concerning this contractor. The first, defective materials which I explained in the original report. The second which is the most important, ************** failed to build the deck according to Prince Georges County Building Code. I called PG County Inspections Office and was told that he was cited for 3 safety deficiencies which he never completed. Please see a copy of the attached inspection report completed by Inspector *********************** on April 13, 2021. So technically ************** has committed fraud. He collected a final payment for a project that he never completed. Its been 2 years now, so he never intended to complete it. Now I understand why he avoided my phone calls.

A copy of the contract was emailed to drteam@mybbb.org today. I was not able to download a copy of the contract to this site. The contract states 20 year warranty on materials.

After two years of making phone calls and sending text messages to the contractor and sending correspondence to the Better Business Bureau and other organizations for help; He finally contacted me to complete the job. He made 3 attempts to correct the deficiencies. Again, he failed twice per Prince Georges County Inspectors and he finally passed on September 14, 2023. I would not recommend anyone to conduct business with MDP Deck & Patios, owned by ******************** To the staff at the BBB, many thanks for your assistance.Initial Complaint

May 16, 2022: On approximately May 16, 2022, we contacted MDP Deck and Patio for an estimate to build a patio on our home at **** ******** ***** *****, Upper Marlboro MD *****. Ivan Z***** arrived at our home and provided us an estimate for approximate 18,000 to build the patio. My fiancee and I took approximately two weeks to review/consider the MDP offer. June 2, 2022: I contacted Ivan via text message and expressed that we wanted to move forward with MDP to build a patio but that we'd also wanted to add a walk-way from the front our home down to the patio area located in the rear of our home. Ivan came out that day at 2:30pm, took additional measurements and wrote a contract/slash invoice for the total of about 23,000. We selected the materials and Ivan urged me to buy them right away because if I waited until closer to the start date he could mot guarantee the availability of the materials. June 3, 2022: Ivan texted me and asked me to call Mike at Federick Brick to pay for the materials which costs about $5042.00. I called Mike right away and paid the amount due for the materials. June 8, 2022: Federick B**** delivered the materials t my home. I contacted Ivan who suddenly seemed flustered and confused on when he can start the patio. Ivan stated that he didn't realize the order would be delivered so quickly. June 8-13: Ivan has been very difficult to contact. He has not responded to repeated emails, phone calls, and text messages requesting information on when he is available to start his work on building the patio. Meanwhile, I have 5k worth of materials sitting in front of my garage. I now believe Ivan has abandoned the job and breached his contract. Resolution: Pay damages for any increases in costs if another vendor decides to charge more build the patio. Ivan deserted his obligation to build the patio and refused to provide timely contact with me to provide updates on the project and when can start.
