i signed a master agreement with Elysian July 2022 for hail damage on my house and unattached garage roof. i didnt get any updates until May 2023. in July 2023 they did the roof on my house but said the garage roof needed to be pre built. time passed with no updates even though i called several times with inquiry. finally they called and said that they would replace my roof in May 2024. they placed a building permit on my front door then nothing. In August they called again and said they were preparing materials and would be bringing a permit. the person i spoke with that day had no paper trail or idea that i had already had this update and there was a permit currently on my door that had been there for months. Now another minnesota winter is approaching and my roofs dont match, my garage roof is damaged and Elysian will not give me straight answers on to when this work will be completed. They did however inform me that it would cost me 20% of the total estimate to back out of the agreement so i can find another company to complete the work. i feel this is criminal. its been over 2 years, very little and very poor communication, no options for me as a consumer to make it right so i can make my house whole again. i need help! i dont know where else to turn.Business response

We signed a contract with Elysian Construction to replace an asphalt roof for a condo rental property we own on 8 April 2024. They said we would have installation around 19 May 2024. We paid them half which was around $3,500 on 8 April 2024 and on 22 May they informed us they would not be installing our roof and they have not refunded the credit card as of 29 May 2024.Business response

In 2022, after incurring storm damage, I filed an insurance claim, and subsequently hired Elysian Construction to replace the roof of my home. During the replacement process, Elysian caused damaged to my property, including my siding, window screens, attic vent, gate to my backyard, specialized cat fencing, gardens, and vehicle. Elysian issued a minimal credit that was not nearly enough to cover the damages that they caused. My back gate remains broken, my window screens remain torn, and I had to patch one of the tires on my vehicle after finding a roofing nail in it. In August 2023, my roof started leaking. Knowing that their work was under warranty, I reached out to Elysian on August 22, 2023 regarding the leak. Elysian did not respond to me until September 18, 2023, and sent someone out on September 19, 2023 to inspect the leak on September 19th. I have not heard from anyone at Elysian Construction since. In the meantime, I reached out to another Contractor in the area to inspect my property. At that time I learned that during the roofing process, Elysian Construction re-used flashing materials (not up-to-code), hammered nails directly through the wood and siding, causing the siding to be cracked, and fall off in areas on the house, which has now created a hole in the side of our house, and used a much cheaper shingle than what I was initially shown and signed off on. Per the Contractor I asked for a second opinion, our entire roof needs to be replaced, along with our siding, window wraps and screens due to the damage that Elysian Construction caused.Business response

We received an email from the customer on Thursday November 2nd stating that she had a leak that had not been fixed.
We had two project mangers who both called the customer later that day offering to have a crew come out andinvestigate the leak and resolve the issue.
The customer declined our offer and said that she didnt want our crewson her roof.
The contract she signed with us states that we have the right of first refusal for repairs.
At this point, the homeowner is not allowing us to do any inspection or repairs. We would gladly do ant repairs and honor our warranty that are necessary and that we are responsible for.
We did have a crew out there in August that looked at the roof and resolved any issues that we occuring at that point and we would be happy to address any ongoing or new issues.
The team member that coordinated that original repair is no longer employed with us, but we have email correspndence he had with the crew that did the service
call and they assured him that any issues were fixed at that time.
Again, we are happy to inspect and service any issues with the work performed and we want to resolve this issue with the customer.

I am rejecting this response because:
When Elysian reached out to me on November 2nd it quickly became apparent to me that they were terribly disorganized and had no idea what was going on. They had difficulties locating my file and previous communications. When Elysian offered to inspect the porch roof and assess the leak, I declined because Elysian had already sent someone out on 9/19, which is detailed in my initial complaint. On 9/19, someone took photos of the exterior and interior of the porch roof and said that he would be submitting the inspection report later that afternoon. Elysian has no record of that inspection being performed or a written report in their possession. Elysian offered to send someone else back out. I declined the re-inspection as I am in the process of gathering second opinions and have an appointment with the City Inspector to review the damages that Elysian caused to my home. I can have no repairs done until the review is complete, which I relayed to them. The only issue that Elysian has even so much as addressed is the leak in our porch roof. Elysian has failed to address the fact that their work was not performed up to code, that they re-used flashing materials, and caused further damages to my home. Elysian's roofing crew re-used flashing materials and hammered nails directly into my siding, resulting in my siding being cracked, and physical pieces of siding falling off of my home. There is now a hole in the side of my house. Per Contractor #2, there are sections of the roof need to be completely replaced, if not the entire roof. Due to the hole in the side of my house, and because the siding on my house is no longer in production, I may need to re-side my entire home. Elysian needs to take accountability for their shoddy workmanship. Despite being told that Elysian would follow-up after our last phone call on 11/2, no one has followed-up, and I have had no further communication with Elysian.Business response

Elysian Construction still wants to do any repair work that is necessary per the contract.
The original leak was reported to ** in August and we sent a crew out and fixed the leak and didn't hear back from the customer until Nov 2nd.
We would like to investigate the issue and if the defect is on us we will repair it.
Our contract states we are allowed to do an investigation and perform repairs as needed.
If the homeowner does the work or has somebody else do it, she is responsible for the costs.

Elysian sales stated that all my out of pocket expenses for a claim filled and processed for roof replacement/garage door replacement due to Hail damage will be credited entirely by Elysian, as credits. Elysian will deal with the insurance claim in its entirety and accept the insurance payout for the contracted work. The claim was processed on May 27 2021. After signing the contract the sales team stated that the work will be completed by August, for which $5000 was taken as advance payment for the work on June 11 2021. There was no communication from Elysian on scheduling the work until September 2021. Roof work was done later in the month of September 2021. There was no communication from Elysian on the garage door replacement. In January, Elysian accounts team started calling demanding payment for the completed work. I informed them that the garage door replacement is still pending. Garage door replacement was later completed in February. I started getting calls from Elysian accounting in March demanding payments. Payment that was released by the insurance was payed out to Elysian, but there were still a balance. Elysian refused to work with insurance company. I asked for a detailed invoice to determine what was not paid by the insurance. Elysian refused to provide any detailed invoice. After multiple follow-**** the insurance released all claim payments and payment was made to Elysian on May 27th. Elysian contracted a lawyer to file a lien on my property to claim the remaining balance which was my out of pocket / deductible. Elysian claimed that there sales team is not authorized to offer credits as referrals to cover any out of pocket expenses. This was not the premise on which i had signed up with Elysian, as the sales team marketed that they would cover all the expenses not covered by insurance. This seems to be fraudulent practice by Elysian to entice customers to get there business. At present i have paid $1999 additionally to avoid a lien on my propertyBusiness response

We apologize for any miscommunication that *** have occurred regarding credits. There is no mention of any credits anywhere in the contract documents between ***************************** and Elysian Construction. We also apologize for the work starting a week later than was originally quoted. We do our best to schedule every customer as quickly as possible however sometimes the weather causes unfortunate delays. Our call logs indicate very frequent communication between our sales and production departments throughout the entire process. There was a hurdle presented for the garage door portion of the project because the cost to replace it increased by 30% from the time we received the original bid to the time we were ready to perform the work. We presented this information to the insurance company but they denied that additional cost. For the sake of good customer service, ******************** decided to absorb that additional cost and replace the garage door anyway. Elysian Construction performs all work per the final insurance claim proceeds, and we have provided both the final estimate approved by the insurance company which details the cost of each item paid ando ur invoice created for the customer. ******************** has provided a substantial credit to the homeowner which is reflected on the final invoice to account for any delays in production and miscommunication. We are disappointed that ********************** is dissatisfied however he agreed to this credit and the final invoice/balance that was owed.
