Our initial contract was for $68,194.00. We had to borrow more money because *** said they hit **** and for extra concrete needed. Per our final contract agreement, we paid *********************** (Wave Scapes LLC) $80,392.00 on May 23, 2023. He then told us there were some extra costs that he incurred that he wanted to be paid for. He said he will only give us the Automatic Pool ************************* Prowler 920 Series, if we paid him more money. In our contract, line 7., we already paid $960.00 for the automatic pool cleaner. We asked him numerous times to come meet with us to discuss the amount that he thinks we owe him. He never met with us or would tell us an amount or reasoning behind the new charges. Over six months has gone by and he has started contacting us via email, text messages and phone calls with an amount of $6,040.00. The new "invoice" he provided included services that he did NOT provide us, and that my wife and I had to do ourself. We have proof that several of the services he claims to have provided are false. We have receipts, pictures, videos and text messages of his false claims. In addition to this, *** and/or his workers broke our sewer pipe, which flooded part of our finished basement with f**** We had to pay $418.00 for an emergency plumber to come out and unclog all of the mud from the pipes, and countless hours soaking up sewage and steam cleaning our carpet. Not only are we not liable for these extra fees he added, but we would like the Automatic Pool ************************* Prowler 920 Series that we paid for and the $418.00 for the plumbers fee. Please let us know if we should provide all of the proof we have or any further details.

I have attached the contract and service agreement between us and ***********************, owner of Wave Scapes. His company installed our in ground pool and when doing so installed the wrong sized gas line causing our ******* btu heater to be damaged, rendering it inoperable. Since Wave Scapes does pool installation and not service functions I contacted Pool Guys of ***************** and a technician came to the house to examine our heater. He determined that the heater was completely damaged due to the poor flow of gas through the inadequate line that Wave Scapes installed. Pentair, the company that manufactured the heater will NOT warranty the heater because of Wave Scapes shoddy install. That's a shame considering that it is under warranty until March of 2024. The heater requires at least a 1 inch gas line to operate, ***********************, owner of Wave Scapes installed a 1/2 inch line. That size line doomed our heater, voided our heater warranty, and put our family in danger. You NEVER shortcut with natural gas. A new gas line will need to be trenched and the proper line will be to be installed and properly connected to the gas service and heater. The heater (Pentair Mastertemp 200) will need to be replaced since the other one is ruined. The company also was to provide us with a Pool robot, Prowler 920. Instead we received the Prowler 910. The 920 is for in ground pools, which we have and the 910 is for above ground pools, which we don't. There is about a three hundred dollar difference between the two. I would like the correct vacuum. These items are on our contract and we paid in full in each required payment phase.
