      Was robbed of $3k by Company. Gave me a sob story about getting arrested and used my money to bail himself out. Now he refuses to return ANY of my money.

      The truth of the matter is this, we were hired to do a privacy fence for this customer. We had to wait until the customer had their finances ready to start the job. We were in agreement that a percentage of the total job cost was needed upfront to get materials for the job. It ended up  being right at 3,000.00. So once we had waited a couple weeks for the customer to get material money, we started the job. My foreman and myself spent a couple days on removing old fence and hauling away.(note- we paid $80 for dump fees of old fence). Also the customer wanted us to remove these big metal posts that was on the original fence which was quite a bit of extra work that ended up having to be uppriced and wasn't in the original bid. So we did that with no money upfront and was supposed to be applied to the bid it was right around $900.00.(note- we spent 3 days my foreman and i up to this point).Once that was complete we had to call dig rite and go through the motions before we went any further. That took about a weeks time to get the go ahead to proceed. Once we got approval we rented an auger for 2 days which was right at $90. I purchased all 35 posts which ended up being right at $375. We purchased all 35 bags of concrete which was right at $175. We purchased all the nails needed and hardware needed which was about $25. We drilled all post holes on the sides and front. That took us a day and half to two days setting all those posts. The whole back of the fence couldn't be started because the existing fence was put on the no dig line. So we 66558060F7695their neighbors and they said that was totally fine. Several days went by and we were in the middle of a decent sized job that was priority from storm damage. So two days or three tops after they let us know we were ok to proceed I had got a message of them firing me and telling me I had one week to give them their $3,000 back. After I was in over $1300 or more into this job with labor and materials. In that time frame I had spent some of that money to survive and get by until we were ok to finish the job. So of course I didn't feel like I owed $3000. I would say I owed $1000 or $1500 at most. So a week and a half later from them firing me I had reached out telling them I had $500 and I was ok with giving them back what was fair but would have to be in two or three payments they ignored me and have done everything in their power to belittle my company, myself and my work all over every social media platform etc. Even after all this I have tried reasoning with them and they will not be reasonable what so ever.

So we had to wait several more days to get approval to continue. So we asked the customer if they minded if we started another job or so while waiting on them they said that was totally fine. Several days went by and we were in the middle of a decent sized job that was priority from storm damage. So two days or three tops after they let us know we were ok to proceed I had got a message of them firing me and telling me I had one week to give them their $3,000 back.       $900.00 for completed work that was added to the original price. 
      $90.00 for auger rental
      $1,200.00 for labor pay of six days to my foreman. (That don't include my labor pay)
      $375.00 was spent on all the main posts
      $175.00 was spent on all the concrete to set all the posts. 
      $80.00 was used for dump fees of the existing fence that was removed.
      $25.00 was used to buy new hardware 
      $150.00 was used on fuel to get to the job and back for all those days.
      That totals $3,995.00 so honestly I don't think I owe them much if anything. But am willing to still work something fair out. As far as stealing their money I did not do. I was fired and they breached the contract for no good reason. And have went on every platform on my business and have slandered and made false accusations about me and my business.

      I am rejecting this response because: We are not going to be doing the back and forth with this owner, as this is why we reached out to the BBB for a moderator to try and settle this. It is also obvious that even with documentation that the money used for a deposit was spent on other liabilities and that this is not going to be resolved through the BBB and will have to continue with legal action and let the judge decide what is owed to us the consumer. Just to be clear that every time we have tried to communication with the company the story is always changing and now I owe more money then what was previously stated, as a consumer I do agree that work was done and materials were purchased but do not agree with the way this was being handled and in our communication was it never discussed him doing other work for Humanitarian purposes just that he was doing other jobs in between taking on our fencing job nor was there ever a signature on a contract that binding us to this contract and again with the communication that we have shows that we gave ample opportunity to continue job but after 2.5 months we decided to go with another contractor who also charged and explained on receipt of work that had to be done and materials that had to be disposed of due to improper placement and cost of materials that were used prior w/ cost of product.
