This company alleges I owe them $11,788 dollars. It is on my credit reports. I have no contractual agreement with this business. So unless they can send me an original contract between them and myself, they need to take this off all my credit reports.

Please see the attached response and thank you in advance. We appreciate the opportunity to respond to the above-referenced complaint brought to our attention by your office. Systems and Services Technologies, Inc. (“SST”) is a loan servicing and payment processing company that is committed to resolving customer service issues in a cooperative and expeditious manner. Please know that SST has no ownership in this account and does not purchase loans; it is merely the servicer. Having researched this matter, please be advised of the following:
On July 31, 2018, you, ********* *******, signed an agreement for a Marcus by Goldman Sachs loan (“the Contract”) financing $12,000.00. According to the contract, you agreed to make 36 monthly payments of $433.76, beginning on August 31, 2018.
On or around December 9, 2023, the account was assigned to SST for servicing and a transfer letter sent advising of the new servicer. Consumer permission is not required for transferring loan servicers. The creditor was not changed by the transfer of servicing.
At the time of servicing transfer, the Account had a balance of $11,053.44. Review of the payment history confirms brief and sparse payments made on August 31, 2018, October 31, 2018, December 7, 2018, and January 16, 2019. Validation of Debt has been sent separately.
If you feel this account was opened because of Identify Theft please complete and send to SST the FTC Fraud Affidavit, which you can find at *****************************. Also provide other supporting information to expedite our investigation, including the police report, a copy of your driver’s license, an exemplar of your signature, proof of residence as of the date of the alleged fraud, etc. You may send this information at the below address

In response to the consumer's rebuttal response, please note:

      1. There is no contract between SST and *** *******.  SST represents the creditor, Marcus by Goldman Sachs.  This in no way changes the obligation *** ******* has on his account.

      2. SST will not be modifying any credit reporting at this time.  Note further, that SST has not independently credit reported on this account, at any rate.

Note this account is currently outsourced to a lawfirm, ******* * ********** - for potential lawsuit on the underlying claim.  We would encourage *** ******* to contact them with any further issues.

As seen on this screenshot, it specifically states SST REPORTED Nov. 30, 2023. Contrary to the reply given by them stating they are not on my credit report. Furthermore the debt has been charged off as bad debt and sent to collections.  I.E. the debt has been sold to this company.  They purchased the debt and that has nothing to do with my contract with the original creditor. In conclusion I have no contract with this company. I have no obligation to them. Cease and desist any and all attempts to collect anything from me.  And get off my credit reports as you are on them.

Subject: Formal Complaint Regarding SST Communication Practices I am writing to formally complain about SST's communication practices, which I believe violate the Fair Debt Collection Practices Act (FDCPA). Below are the key issues I have encountered: 1. Failure to Send Written Notice On September 19, 2024, I contacted SST after my ***** line of credit stopped functioning, and SST's information appeared in the app. Prior to this, I had received a suspicious email from SST, which I initially disregarded as potential phishing. Under the FDCPA, SST is required to provide a written notice explaining my rights and validating the debt within five days of initial contact. As of now, I have not received any such notice, nor have I been informed of my right to dispute the debt. 2. Non-consensual Call Recordings During my calls with SST, I was informed that the calls were being recorded. However, I specifically stated I did not want to be recorded. It was only after several calls that I was told there was no option to disable the recordings. This practice raises serious concerns about compliance with California communication laws requiring explicit consent. 3. Lack of Transparency I requested basic information from SST, such as a company address and email, but encountered significant difficulty in obtaining this information. This lack of transparency has heightened my concerns regarding the legitimacy of its operations. 4. Unwarranted Communication Despite submitting a formal dispute on September 20, 2024 via the email provided by SST, I continued to receive communications from SST via texts, emails, and phone calls on several occasions. Specifically, a phone call on September 23, text messages on September 25 and 30 and emails on September 25, 27 and 30th. I believe this conduct violates FDCPA regulations that prohibit further collection activity during an ongoing dispute. Thank you for your prompt attention to this matter. I look forward to your swift response.

      Complaint: 22385673

I am rejecting this response because: This letter does not appear to be a response to the complaint I filed with the Better Business Bureau (BBB), as it is addressed to the Commissioner of Financial Protection and Innovation (DFPI). I am concerned that this may potentially violate California privacy laws, and I would appreciate further clarification on this matter.
Additionally, I am still seeking clarification regarding SST's business standing in California. Specifically, whether SST operates as a licensed debt collector in the state. I have asked this question multiple times, and as of today, SST has yet to provide a response.
Finally, I continue to dispute the accuracy of SST's accounting regarding the amount they claim I owe.

Attached is a copy of a recent letter I have sent SST.

      Sincerely,

      *** *******

My ***** line of credit was transferred to SST as an amortized loan when ***** went out of business. SST raised my interest rate and amortized the loan over 60 months, with a calculated monthly payment of $221.91. On top of this, they added $2.41 to each payment to cover the interest that had accrued since my last ***** payment in August (a total of $144.60 when distributed over 60 months). I was accustomed to paying ***** more than the monthly minimum payment, and on September 9, 2024, I paid SST $300. This should have been applied as $142.98 ($140.57 + 2.41) to interest and $157.02 to principal. However, they applied $227.45 to interest and just $72.55 to principal. I have spent hours on hold with customer service and have been promised attention by "upper management" that was to result in emails and phone calls that have never materialized. So far I have encountered an obstinate refusal to admit a mistake has been made, and blithe assurances that future payments will be handled correctly. I want the additional $84.47 applied to principal as it should have been. I also want to know that SST is capable of applying my future payments correctly, and that they will do so.

      1. Of the $8,344.01 balance at transfer, $144.29 was interest that accumulated at ***** and which remained unpaid at the time of transfer.

      2. SST did not amortize the loans - ***** did so prior to transfer and provided such information to SST.

I am rejecting this response because:

Apparently as to the question of whether the people running this company are dishonest or just incompetent, the answer is they are *both*.

I have gone ahead and paid off my account. Originally I paid all except the $84.47 they stole from me, but in the end I paid that as well, as a gift to myself. I will be relieved of any further interaction with this execrable company, and they will be denied the thousands of dollars in interest they thought they would be reaping over the next five years.

I had a loan with ****** ** ******* and it was reassigned to SST. I had a large medical bill I had to pay and requested a payment deferment from SST. I was approved for a two month deferment for the payments due May 23, 2024 and June 23, 2024. I resumed my payments with the July 23, 2024 payment. SST has failed to update my account in a timely manner and still has my account showing as past due when I have documentation of the approved payment deferment. I have called in several times and have been advised my credit will be corrected but it is showing it has not been re-aged based on the payment deferment. Last week when I called SST, I asked why this was taking so long and was basically told they are busy with a lot of requests so it may take more time. I feel I have given SST plenty of time to fix this, but now it is negatively impacting me. I was turned down for an apartment due to SST's inability to submit a request to update my Credit Report timely. At this point, I might have to seek legal remedies because I feel like they have violated the FCRA in some way. I don't know if SST has significant staffing issues, but it has been over 2 months since trying to resolve this, which is unacceptable. I am seeking assistance from the BBB to help resolve this situation because there is no urgency with SST. I will consider this matter resolved once SST updates/re-ages my account timely based on the payment deferment and send something to the three major credit reporting agencies (Experian, Equifax, Transunion) removing any late payments and reflecting my account as current. I will also be filing a complaint with the Federal Trade Commission against SST. I have been more than fair in allowing time to fix this and even gave a timeframe if not resolved and that I would be filing a complaint with the BBB. Thank you for your time.

Complaint against System and Service Technologies Inc I discovered that there was an account reporting on my credit by a company called SST. I have had no prior contact, and I do not have any account with this company. On 5/13/2024 I sent a request for validation to SST Inc. See attached. They received this letter on 5/16/2024, see attached proof of delivery certified mail. They were required to send me notices and follow the proper procedure for validation. They did not. Instead, they sent me a letter saying it was serviced by another company and yet did not provide any details as to the nature of the debt. They were asked to investigate the validity of this debt. They did not. They have violated the FDCPA and the FCRA in that they did not validate the debt, did not investigate the debt, did not provide any proof of the debt including amounts owed and their right to collect this debt. In fact, aside from a 1 paragraph letter saying they didn’t service the account they have not contacted me or responded with the correct information. Yet they continue to report this account on my credit report and have recently responded to a TransUnion Dispute stating that the debt was accurate, which is it not. This company refuses to comply with the FCRA and the FDCPA and is currently in violation of both. See attached proof of my statements. ***** *******.

I am rejecting this response because:

this is being reported on my credit. You are the entity that is reporting this. I have disputed this directly with you  because it is inaccurate  you are absolutely accountable to the FCRA as the furnisher of the information  it is also held that the act of reporting is an attempt to collect a debt  therefore you are also under obligation to adhere to the FDCPA .

if you wish to absolve your self of this then send me a letter stating that you do not wish to have this information reported on my credit . And that it is a mistake. This I will then take up with Trans Union and refrain from holding you accountable . However  you must validate this is true with Trans Union. I’m not certain why you can’t just contact Trans Union and correct this yourself.

if you refuse to resolve this I will have no other recourse but the court system. If you think you can not be held accountable for your reporting on my credit then I will need demonstrate that you are mistaken.

SST took over servicing a loan a had taken out from a different vendor. Since then this account has been reported incorrectly multiple times on my credit report, first being shown as closed with no balance; second, as transferred to another lender; third, showing they have the account and it has a balance; and now as the account is again apparently no longer with this company they refuse to report it accurately on my credit. They are saying we don't have an account with them, but they are still reporting to my credit, will not update the the account to show it in charged-off status on my credit, report it was transferred to another company and will not provide me with documentation that my account has been charged off. I have disputed it with the credit bureaus, but SST refuses to supply complete and accurate information upon their request.

I am filing this complaint because I have reached an impasse. The company labelled as 'SST PIONEER' is reporting a tradeline on my credit reports with Transunion, Equifax, and Experian that they are refusing to correct. I have disputed this account to no avail the completeness and accuracy of the account yet the argue that it is accurate recklessly as if I am stupid and don't know the obligations and standards, they are held to under the Fair Credit Reporting Act. I have disputed the accuracy and completeness of the account they furnished since August 2023 of last year. I have disputed this account for months with no improvement or fair resolution. The inaccuracies that I speak of include the absence of most of the payment history on the account and 3 consecutive "120 days late" payment rated notations. No late payment notations are legally supposed to duplicate itself for a series of months. it either increases in number or changes to a different notation depending on the status of the account. This company has been "verifying" the inaccurate account by default numerous times to no avail each month after each dispute with the CRAs despite my supportive documentation. They are required to conduct a reasonable investigation, consider all relevant information, and update the account to its correct state or delete the account should the issue remain unresolved according to the FCRA section 1681s-2(b)(1)(E). The are ruining my general reputation, credit standing, and are affecting my mode of living. This has caused me damages. I have demanded this company delete their tradeline from my credit report due to their multiple failures, but they are being stubborn in that regard. They are causing unnecessary misery and stress in my life. This is my final attempt to mitigate for a proper and fair resolution before this matter goes to my attorney. I want the account deleted from the consumer reporting agencies because they did not and still will not correct the account errors.

I am rejecting this response because it is not my responsibility to call and have to point out exactly what is wrong with your company's tradeline information when I have already disputed it several times. The FCRA is clear when it tells the consumer to point out an item of information which is either inaccurate or incomplete (which I did) and notify the CRAs with respect to the issue to trigger an investigation with both the CRA and the furnisher according to 15 USC 1681i(a)(1)(A). Data furnishers are required to conduct a reasonable investigation under the FCRA section 1681s-2(b)(1)(A) which includes looking beyond their 'internal data system'. I have already triggered both a reinvestigation and an investigation in regard to the completeness and accuracy of the account. Several times I have initiated a dispute with clear and concise details about the issues of account from your company and yet it continues to be "verified and updated". This is either negligence or willful noncompliance on your company's part. Clearly no reasonable investigation is being performed considering that I have disputed this account monthly since August 2023 and was very clear and specific providing a credit report highlighted with the circled inaccuracies brought to your attention. Clearly ALL relevant information was not considered. This complaint to the BBB is a final attempt to mitigate and have this issue resolved before this matter is escalated. Just to highlight, the FCRA section 1681s-2(b)(1)(E)(ii) states that an unverifiable, inaccurate, or incomplete account must be deleted if the furnisher fails to correct this issue pointed out on the account. FCRA section 1681s-2(b)(1)(E)(ii) "If an item of information disputed by a consumer is found to be inaccurate or incomplete or cannot be verified after any reinvestigation under paragraph (1), for purposes of reporting to a consumer reporting agency only, as appropriate, based on the results of the reinvestigation promptly— (ii) delete that item of information". This action was not performed for whatever reason, even after SST PIONEER did not resolve the disputed account issues which is questionable. I have noticed during my dispute with SST PIONEER that when something is disputed, it either deflects accountability, redirecting the issue to "owed debt" or carelessly verifies the account while the issues remain. Please keep in mind that even if a tradeline account has been "transferred", if your company's name is still on that account and if your company has not removed the tradeline, it still must report 100% accurately. There are penalties in place for noncompliance according to section 1681n of the Fair Credit Reporting Act. As relief, I want this account deleted from my credit reports because the disputed issues have not been resolved. I will attach evidence to support my claims.

Please carefully consider that I am attempting to communicate in good faith.

      Sincerely,

      ****** *******

SST's credit disputes resolution team acts in accordance with the requirements under the FCRA, including the requirement that it conduct a reasonable investigation in response to a consumer's dispute.  SST believe that it has acted in accordance with these requirements, and that it is correctly credit reporting *** ********* account.   In that she has not provided us any further information upon which to add to our investigation, there is nothing further we can do with respect to her issues.  Should she have anything further to provide SST to assist with resolution of this issue, SST encourages her to reach out to us at her convenience.

My account has been paid in full as of 6/25/2024. I have contacted the company to mark this account as paid and submit it to the credit bureaus. When I spoke with the representative they said I would receive a letter in the mail in 20 days showing my account was paid and it would be updated with the credit bureaus. I have never received any correspondence from this company showing my payments. This account still shows active and unpaid on all of my credit reports. I have filed a claim on credit karma and there has been zero response. I want this account marked as paid in full and updated/removed from my credit report. I have attached proof of payments I made and that the account still shows I have a balance.

We appreciate the opportunity to respond to the above-referenced complaint your office brought to our
attention. Systems and Services Technologies, Inc. (“SST”) is a loan servicing and payment processing

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********. While I find that this resolution is satisfactory to me, the company made no effort to report my paid in full debt until I made my initial complaint. This company has several derogatory reviews regarding their dishonest practices when it comes to loan servicing. I do believe this company should be investigated further.

      Sincerely,

      ***** *******
