      We&#**;re having a new roof put onto our home, fascia, soffit and gutters by this business. They put the roof on. They have the fascia and soffit in the driveway. In the beginning he told me the total price was $32,750 for the roof, soffit, fascia and gutters. I paid $16,375 up front. Now he&#**;s saying that I need to pay the other half for him to close out the roof. He&#**;s implying that it&#**;s 3 separate jobs with 3 separate contracts. That&#**;s not what we were told up front. We were told it was $32,750 for everything.

      Hired MLK Construction to put on new roof and gutters in October of 2021. There were other complications in this project, but the current issue is quality and installation of new gutters. The gutter cost was $1,500 dollars, plus 3% because I used a credit card The work was completed for the gutter mid November 2021. During the first week of February (02/04), the entire gutter on one side of the house pulled cleaning off the house and fell. When the gutter fell, it damaged the gas meter. I contacted the project manager the day the gutter fell. The following Monday (02/07), he came out and said that the gutter fell because of the icy weather we had, and that they would not repair or replace the gutter. I said how could that be? One day of icy rain can cause a newly installed gutter to fall? The gutters are less than 90 days old. The gutters that were replaced had been on the house for over twenty years and there had been no problems with bending or leaking- I only had them replaced because of their age. The agreement I signed stated that if there was damaged fascia wood that need to be replaced they would replace (at an additional cost), to insure secure and proper attachment of the gutters. As MLK did not indicate a need for any replacement, the integrity of the structure could not be considered a part of the reason that the gutter fell. All of the screws slid out of the structure and the circular rubber attachings broke. There were circular rubber washers that were attaching the gutter in place along with slender screws. This was not how the original gutter was attached to the frame. There were no visible attachments showing. His reply was he would go back to the office and discuss it, but was sure this was an insurance issue. After he left, I did not here from MLK Construction. To date, the company has not honored the workmanship, quality or agreement. MLK used a third party to install the gutters and did not inform me of this in advance.

      Good Morning,

      We have bent over backwards for this customer. We installed a roof and gutters on this property. The day after we installed the roofing system, the customer signed and sent a contract back for a less expensive option. When it came time to pay, the customer wanted to argue about what she agreed to do and what she didn't. Instead of continuing to argue with the customer we negotiated a compromise. She then paid online with a credit card, agreeing to pay the fee associated with the credit card processing service. When she was charged the fee, she once again wanted to argue about getting charged a fee that she agreed to be charged. Instead of fighting with the customer or dealing with a breach of contract. We simply cut her a check for the fee she was charged.

       

      On Feb. 2-3rd of 2022, we had a record 8-13" of snow, we also had an ice storm on the 1st, prior to the snow falling.

       

      Customer called on Feb. 6th to a production managers phone, stating her gutter was damaged. She didn't call the office or contact us via email or fax. The production manager went out and inspected it on Feb 7th. He informed the customer at that time, that the gutter appeared to be installed correctly and simply fell due to the weight of debris and ice in gutter. That every rafter that was able to have a screw in it had one and that the huge amount of weight of the ice/snow/debris caused it to fall. He stated he would present it to **** (the owner) and the customer stated something along the lines of she didn't want to hear or deal with ****'s followed by cursing. 

      Being that the customer wasn't willing to converse in a respectful manner, I thought it not wise to converse with her until she contacted office or an official communication of the office.

      It is the companies standpoint that this is not due to faulty workmanship. This is due to the gutter being full of debris and then historic ice and snow fall the first week of Feb. 2022.

      I am rejecting this response because:

      No resolution was given by the business.

      The excuses given in the response:

      1- Only the project manager was contacted.----------- 

      I had been instructed that if there was an issue I was to contact the individual that was overseeing the work. Throughout both projects that is who I contacted. When he, (the project manager) came out on February 7th, he informed me that  "They"  (he and owner)  had already discussed the fallen gutter, prior to coming out.

      2- There was a record storm on February 4, that caused new gutters that were less than 90 days old to detach from the structure-------------

      Factual data for extreme storms in Saint Louis do not recognize February 4, 2021 as extreme.    Data does show that there were ten extreme storms  between  December 2010 and January 19 2019. with three of these  producing 31.5, 27.4 and 19.8 centimetres  in one day.  The old gutters withstood all of these storms without an issue.

      Date of work is 03/05/2020 Cost paid for work; $4,000.00 Location of work 5923 Maple Ave., St. Louis, Mo. 63112 **** ******* agreed to stop the leak in my roof. The leak is in my bed room just inside of the door and in the closet. The leak only happens when there is ice and snow on the roof. **** ******* the owner of the company came back out to look at the roof and came the conclusion that ice was backing up under the shingles at the transition portion of the roof. I watched most of the instillation of the roof and I am convinced that they did not put the flashing up the 3 feet that is required by the roofing insulation code. Mr ******* is now asking me for another $4,500.00 to solve the problem.

      The only time this has leaked is when the shingle roof or siding was leaking (due to bullet hole in the roof and ice/dam scenario(s)). Not the flat roof.

       

      His flat roofing needed to be replaced along with the shingles and siding. The customer decided not to spend the money twice as he spent the money to have the shingle roof done with an individual that is no longer in business and not a company. I'm empathetic for the scenario and was willing to work with the customer on getting this resolved. I waived our minimums to do the siding and shingles at the same time. Normally this would be almost $8,000.00 worth of work. I offered to do this at about half the cost. He said, "well lets just do the siding". I said we could but it' may not fully resolve the issue by itself. To ensure this doesn't happen again you will have to remove the shingles and the siding. He said he would call me back as it wasn't in the finances. 

       

       

      Please see email sent to customer on Feb 18th 2022 where everything is clearly outlined. We installed flat roof, not shingles or siding.

       

      This appears to be an ice dam scenario, with water infiltrating above the flat roof from the shingles and/or siding. The only way we can guarantee this is to both remove the shingles and the siding and replace.


      Feel free to give me a call if you have any questions or concerns directly at 314-600-5060 but I would attempt to contact the company that put the shingles on and see if they can help you before paying us to rip it all off and replace both the shingles and the siding.




      You first contacted us in Feb 2020 about needed options on your flat roof due to multiple leaks and stated your shingles were new and no issues. We inspected the flat roof at this time and presented bids for new flat roofing options as repairs were not an option. Due to the amount of things wrong with it.

      In Aug of 2020, you stated it was leaking, we came out and found no issues with the flat roof. We found a bullet hole in the shingles directly above the flat and some issues with the siding. We patched both of these while we were there.

      In Feb 2021, you contacted us in regards to a roof leak, we inspected after snow cleared out and determined no issues with the flat roof. The issue was more than likely an ice dam and leaky siding and or shingle portion.

      In Feb 2022, you contacted us about roof leaking again. I personally inspected and my assumption was an ice dam before I got on the roof. When I got on the roof ice and snow was still on the flat roof approx 2-4" of ice was on each side of the dormer on shingles. Unfortunately, this appears to be an ice dam issue with siding and shingles.

      I am rejecting this response because:This information is not acerate , If you would look at what you refere to as ice dams you need to look under the shingles where you should have ran your flashing further under neath the shingles , I have gotten an opinion from another roofer and he indicated that the flashing should have been ran up 36" and the leek is not siding related. 

      When I called you out from the very beginning the first place that we looked at the ceiling in my bed room, there were 3 spots that leaked and then we went out on the roof and you said that a new flat roof would solve my problem, and that is why I paid you $4,00.00. If you would come back out and check how far your workers ran the flashing up under the shingles especially under the fire escape you will see exactly where the problem is

      Mr. *****,

      I've got no problem sending my guys out to remove the area of the shingle tie into the flat roof and install a 6" strip of ice/water shield and install a new row or two of shingles.

      Besides doing that, I can't warrant that you're siding or shingle roof wont leak. The flat roof is watertight.

      The only time your roof has leaked since we installed it besides the one time, we patched a bullet hole in your shingle roof for free. Is in the middle of winter when ice/snow accumulated and backed in under the shingles and the flat roofing.

      We don't offer a warranty for leaks coming in above what we install. I've got no problem servicing your property this last time as an attempt at extending an olive branch but your section of te shingle roof and siding all need to be removed and replaced and an extensive amount of masonry.
