      My car was towed on August 20th from a parking lot near ******* and Hwy 270 to ***********************. When the operator, Autumn applied tension to the winch line in pulling the car onto the flatbed, the vehicle sustained damage on the front bumper cover when the line geometry was at the most obtuse angle (just before the front tires were positioned on the bed of the truck). The operator recognized the damage immediately and gave us the company and owner information saying the damage would be covered. It was explained that the *** was recorded by the company cameras (although these have never been shared); however, we also captured our own photos and video as well. The video has audio where the driver clearly can be heard saying the event of damage was witnessed. They could not be uploaded on this portal; however, I do have it available and have shared with ********).I spoke to the owner (********) who first said he would be covering the repair costs and I should go to his friend's shop. He didn't send the address to the shop, so I reached out again. He then began to argue with me that the damage could not have occurred during the tow because the strap is not the kind that can cause damage. He said after the car was repaired, he would take a look at it himself to assess if the towing caused the damage. I explained that he does have a conflict of interest in making this type of assessment. Then, he said the damage was already on the car before the tow and he had pictures of it. I asked him to text the photo. I am very aware of condition, the front was recently repainted, car was detailed and covered in PPF (paint protection film).He sent a photo of the car that he said was taken before it was towed. The damage could be seen in the photo. However, upon closer review, the photo was taken at the drop off location - which, of course, was after the damage *********** this point, I asked for his insurance company information so an adjuster could investigate the claim.

      Thank you for bringing the attached complaint to our attention. We take such matters seriously and appreciate the opportunity to respond.

      We have thoroughly reviewed the incident involving Mr.Mattinas vehicle while being towed on August 20th. Based on the photos taken by our tow truck operator and those provided by the customer, we believe it is unlikely that the damage to the vehicle was caused by our tow truck or equipment. Our driver utilized soft straps during the towing process, which significantly reduces the likelihood of causing damage to the vehicle.Additionally, the photos indicate that the damage appears to be pre-existing.

      We made several attempts to investigate the damage further by offering to evaluate the vehicle in person, but the customer declined our request for inspection. We also proposed to cover repair costs should our assessment determine that the damage was indeed caused during the towing process; however, this offer was not accepted.

      We understand the customer's request for our insurance information, but for security purposes, we typically do not disclose this information unless absolutely necessary. Our goal is to resolve this matter amicably without involving insurance.

      Moving forward, we will reach out to the customer again to offer to evaluate the vehicle and cover the cost of the repair if we are at fault. We are committed to ensuring fair treatment and maintaining the integrity of our business practices.

      When ******* contacted me after my complaint, she offered to have Majeed inspect and determine fault. I explained that there is a conflict of interest to have them determine if they are at fault.

      Furthermore, I sent a video recording of there driver saying she witnessed the damage from the tow.

      I am again requesting that a professional adjuster from their insurance company should evaluate the claim. This is the proper protocol and reason they are required to carry liability insurance by the state of **. Once the adjuster determines liability, Majeed would have the option to pay the claim out of pocket in order to preserve any impact to their premium, this would result in a zero pay claim on their policy.

      4 witnesses (including their driver) saw the damage happen. Its on video. Im not sure of a more reasonable plan than using a professional adjuster to assess the damage and evidence.

      On August 7, 2023 I engaged Majeed Towing to transfer my vehicle from my residence to a repair shop. The tow truck driver loaded the vehicle onto an elevated flatbed and drove the the truck through some tree branches in route to the repair shop. I captured photos of the incident in progress and of the resulting damage. The branches caused scratches and scrapes to my vehicle. I reported the damage to Majeed Towing's insurance company who later redirected to instead file the claim directly with Majeed Towing. When I spoke with Kindra and "James Sanders" (manager or owner) at Majeed Towing I was requested to send damage photos and the repair estimate. I provided the detailed photos and body shop repair estimate the same day as requested. After a week of no response I followed up with the company and discovered that my calls were being blocked. The company is also not responding to my emails. It's been more than a month without any follow up from Majeed Towing. I am seeking reparations for the repair work in the amount of $2,156.89.

      Customer made a claim regarding accusation that we damaged his vehicle during tow service directly with National Safe Drivers .  We submitted documentation that proved the damage was prior service.  We were not determined to be at fault for his vehicle we have followed up with National Safe Drivers and we are not obligated to pay for damages.  His vehicle was towed due to vehicular accident and we did not crash his vehicle and we are not at fault.  We can not pay claims that we are not responsible for.

      I am rejecting this response because:   The merchant's response claims that they submitted documentation proving damage occurred prior service. This did not happen. In fact, it is not possible to do so since claimed damage did not occur until after loading my vehicle on tow truck. My photo evidence shows the damage as it occurred when tow truck entered trees resulting in scratch damages. The merchant's insurance company claim adjustor conceded to me that the damage was likely valid although she could not secure approval to approve compensation. She spoke directly with the body shop estimator to address all questions. That said, I am willing to compromise and propose a 50/50 resolution, whereby each party pays 50% for damage repair. This would amount to $1078,45 each. 

      Note: Photographic and repair estimate documentation already provided to merchant prior to opening this complaint.
